RPVCCA_SR_2010_06_15_08_Cherry_Hill_Lane_Property_PurchaseMEMORANDUM TO: FROM: DATE: SUBJECT: REVIEWED: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL CAROLYNN PETRU,DEPUTY CITY MANAGE~ JUNE 15,2010 RESOLUTION FOR CHERRY HILL LANE TAX-DEFAULTED PROPERTY PURCHASE CAROLYN LEHR,CITY MANAGER Q5L RECOMMENDATION ADOPT RESOLUTION NO.2010-_,A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AUTHORIZING THE PURCHASE OF TAX- DEFAULTED PROPERTY FROM THE LOS ANGELES COUNTY TAX COLLECTOR LOCATED AT 43 CHERRY HILL LANE IDENTIFIED AS APN 7572-004-022, PURSUANT TO CHAPTER 8 AGREEMENT NO.2637. DISCUSSION On December 2,2008,the City Council authorizing the Mayor and City Clerk to sign an Agreement to Purchase Tax-Defaulted Property to acquire a .64-acre vacant parcel located at 43 Cherry Hill Lane.The subject property is located north of Palos Verdes Drive South,west of Peppertree Drive and east of Portuguese Canyon,and is identified as Assessor's Parcel Number 7572-004-022.On December 11,2008,the City submitted the necessary paperwork associated with Chapter 8 Agreement No.2637 to the County. On June 3,2010,staff was notified that the Chapter 8 Agreement became effective on May 27,2010,thereby requiring the City to submit payment of $5,268.95 for the property by June 18,2010.One of the requirements to complete the transaction is a City Council resolution authorizing the purchase of the property.A draft resolution is attached for Council's consideration. Attachment: Resolution No.2010-_; 8-1 RESOLUTION NO.2010- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AUTHORIZING THE PURCHASE OF TAX-DEFAULTED PROPERTY FROM THE LOS ANGELES COUNTY TAX COLLECTOR LOCATED AT 43 CHERRY HILL LANE AND IDENTIFIED AS APN 7572-004-022 PURSUANT TO CHAPTER 8 AGREEMENT NO.2637 WHEREAS,on December 2,2008,the City Council authorized the Mayor and City Clerk to enter into an Agreement to Purchase Tax-Defaulted Property with the Los Angeles County Tax Collector for the purchase of a .64-acre vacant parcel located in the active Portuguese Bend Landslide area on the north side of Palos Verdes Drive South,between Peppertree Drive on the west and Portuguese Canyon on the east;and, WHEREAS,on December 11,2008,the City submitted the paperwork associated with Chapter 8 Agreement No.2637 to the County of Los Angeles Treasurer and Tax Collector for the purchase of the 43 Cherry Hill Lane property identified as APN 7572-004-022;and, WHEREAS,the City was recently informed by the County that the City Council's resolution must reference the sUbject property's Assessors Parcel Number. NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND,DETERMINE AND RESOLVE AS FOLLOWS: Section 1:That acquisition of the property known as APN 7572-004-022 by the City of Rancho Palos Verdes would increase the City's access from Cherry Hill Lane to the bottom of Portuguese Bend Canyon where there are existing drainage improvements.Maintenance of existing and future drainage improvements is critical to the effectiveness of landslide abatement efforts in the area.Further,the property directly abuts the City's Palos Verdes Nature Preserve and the active use area within the Preserve that has been designated for a Gateway Park and Equestrian Center.City ownership of this property could potentially assist with future efforts to develop public equestrian and pedestrian trails through the area.
