RPVCCA_RDA_SR_2010_06_01_C_PVDS_Landslide_And_Road_Stability_GradingMEMORANDUM TO: FROM: DATE: SUBJECT: CHAIRMAN WOLOWICZ AND BOARD MEMBERS OF THE RANCHO PALOS VERDES REDEVELOPMENT AGENCY DIRECTOR OF PUBLIC WORKS(j&.{}.f.~ JUNE 1,2010 PALOS VERDES DRIVE SOUTH LANDSLIDE (EAST END) LANDSLIDE AND ROAD STABILITY GRADING REVIEWED:CAROLYN LEHR,EXECUTIVE DIRECTOR oSL- STAFF L1ASON:RON DRAGOO,SENIOR ENGINE~ RECOMMENDATIONS:1)Based on the facts set forth in this report,find that an emergency exists which will not permit a delay arising from a competitive solicitation for bids and that the actions taken below are necessary to respond to the emergency;2)Approve and authorize the Chairman of the Board of Directors to execute a Contract with Mike Drews Construction Company,Inc.,to remove approximately 1000 feet of vegetation located to the south of the Palos Verdes Drive South roadway and to re-grade a portion of the roadway shoulder and adjacent slope to eliminate cracks and fissures adjacent to Palos Verdes Drive South,and 3)Adopt Resolution 2010-_,A RESOLUTION OF THE BOARD OF THE RANCHO PALOS VERDES REDEVELOPMENT AGENCY,AMENDING RESOLUTION 2009-07,THE BUDGET APPROPRIATION FOR FISCAL YEAR 2009-10,TO INCREASE THE BUDGET IN THE PORTUGUESE BEND CAPITAL PROJECTS FUND. BACKGROUND The Portuguese Bend Landslide is moving at the rate of approximately 7 to 8 feet per year in the area that is south of Palos Verdes Drive South ("the Road").This is the most active area of the Landslide.The City Geologist has explained that the loss of the beach,which previously provided a buttress to the Landslide due to wave erosion,along with recent increased rainfall,has accelerated the land movement so that large cracks and fissures have developed seaward of the Road.The cracks and fissures,in turn,allow more water to enter the Landslide,which exacerbates the land movement.This situation has adversely affected the integrity and viability of the Road and has increased the amount and cost of the annual work that the City performs to keep the Road in a useable condition. The movement of the Portuguese Bend Landslide also has caused earth to be moved from the property that is owned by the Redevelopment Agency ("RDA"),which is located to the south of the road,onto adjacent property to the east,which is owned by the Portuguese Bend Club ("the Club").For many years,the Club has been performing remedial grading R6876-00011232443.2 RDA C-1 pursuant to a permit that was issued by the Planning Commission in 1996,pursuant to the recommendations of former City Geologist Perry Ehlig.The grading permit allows the Club to perform remedial grading on an as needed basis in order to maintain specific gradients identified on an approved grading plan.This action consists of taking dirt that is deposited on the Club's property by the Landslide and to relocate it onto the RDA Property at a location determined acceptable by former City Geologist Perry Ehlig.Club representatives have undertaken these actions to preserve the Club's private road (Yacht Harbor Drive)as well as to protect the homes that are located on the western side of their residential subdivision.The Club recently entered into a contract with Mike Drews Construction to relocate 60,000 cubic yards of dirt,pursuant to its grading permit,and has requested that the City or RDA take over this effort. DISCUSSION The City Geologist recommends that grading be performed on the RDA's property that is located to the south of the Road.The purpose of the grading is to fill the cracks and fissures close to the Road so water will not enter the Landslide so easily and to create a 2:1 slope on the seaward side of the Road to provide support and increased stability for the Road.The stability of the Road is vitally important to the public and to the City's ability to provide law enforcement and fire suppression services to residents who reside on the south side of the City,since it is one of the City's main arterials. The intent of the proposed project is to enhance the stability of the area that is being graded, which will have the corresponding benefit of increasing the stability of this portion of the Landslide area and of the Road itself.Thus,the proposed project will help maintain the viability of the major roadway that is located on the south side of the City,which extends from the eastern boundary to the western boundary of the City.Albeit it is difficult to estimate the amount of movement (and associated cost of repairs)the Road will be subject to during anyone year,this project should have the additional benefit of reducing,to some extent,the City's annual cost to maintain the Road,which has been approximately $350,000 per year,during recent years. The Director of Public Works estimates that the RDA will need approximately 40,000 cubic yards of earth to fill in the cracks and fissures and provide the 2:1 slope on the seaward side of the Road to enhance its stability.As discussed above,the Club seeks to have approximately 60,000 cubic yards of earth removed from the western side of the Club's property,which could adversely affect the homes and private road within the Club's boundaries,and taken back to the RDA's property or placed somewhere else where it will not adversely affect their properties. Due to the immediate need to perform this grading work to fill the cracks and fissures and stabilize the area and the Road,as well as the need to remove the dirt that the Landslide pushed from the RDA's property onto the Club's property,Staff is recommending that the RDA enter into a contract with Drews Construction to perform the work that is being recommended by the City Geologist.Drews Construction has provided a proposal to the RDA to remove the vegetation in the area where the cracks are located,fill the cracks and R6876-000 1/1232443.2 RDA C-2 fissures and build the 2:1 slope adjacent to the Road with dirt that currently is located on the Club's property for the cost of $213,750.Because of the benefits of addressing several different problems by doing all of this work at once,and the immediate need to provide additional stability to the Road,Staff recommends that the RDA find by a 4/5 vote that an emergency exists,approve the agreement with Drews Construction,and authorize the Chairman to execute the contract. ADDITIONAL INFORMATION Staff contacted two other grading contractors to obtain additional bids for this work.Cooper &Cooper submitted a proposal in the amount of $225,390,which was higher than the proposal of Drews Construction.The other company,Hardy and Harper,did not submit a proposal to Staff. CONCLUSION The RDA needs approximately 40,000 cubic yards of earth to fill cracks and fissures, enhance the stability of the Landslide area and improve the stability of the Road.The Club has more than 40,000 cubic yards of dirt that the Landslide has moved onto its property from the RDA's property that could adversely affect property within the Club,which the Club is requesting the RDA to remove.Accomplishing both tasks at once is cost effective and efficient and will eliminate hazardous conditions that are adversely affecting the Road and residents of the City and the Redevelopment Project Area.Accordingly,Staff recommends that the Agency Board take the actions recommended by Staff. FISCAL IMPACT The cost of this project is $213,750. WHEREAS,Section 3.32 of the Rancho Palos Verdes Municipal Code provides that all expenditures in excess of budgeted allocations must be by supplemental appropriation of the Agency Board:and WHEREAS,on June 30,2009,the Board of the Rancho Palos Verdes Redevelopment Agency adopted Resolution 2009-07,approving a spending plan and authorizing a budget appropriation for FY09-10:and WHEREAS,grading has become necessary for landslide mitigation in the Portuguese Bend portion of the Redevelopment Project Area;and WHEREAS,the Agency Board has determined that the specific grading expenditures should be completed in FY09-10;and BE IT,THEREFORE,RESOLVED BY THE BOARD OF THE RANCHO PALOS VERDES REDEVELOPMENT AGENCY: The following adjustment is made to the FY09-10 budget: Increase the Redevelopment Agency's Portuguese Bend Capital Projects Fund budget as follows: Portuguese Bend #375-3075-461-73-00 Improvements $213,750 PASSED,APPROVED,AND ADOPTED THE 1st DAY OF JUNE 2010.
