DISCUSSION On October 20,2009,the City Council authorized the Mayor and City Clerk to execute a Transfer Agreement with the County of Los Angeles to transfer a remainder parcel associated with Robert E.Ryan Park to the City of Rancho Palos Verdes (see attached staff report).On March 30,2010,the County Board of Supervisors took action to declare the 3,551 square foot parcel as surplus and authorized the Chief Executive Officer to execute the necessary documents to convey the property to the City.In order to complete the transaction,the Council needs to adopt a resolution accepting the transfer. A draft of the resolution,which has been reviewed and approved by the City Attorney,is attached for the Council's consideration. NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND,DETERMINE,AND RESOLVE AS FOLLOWS: Section 1:That the transfer of the County-owned property,as depicted on the attached legal description and map,incorporated hereto as Exhibits "A"and "B,"would be consistent with and preserve the existing public recreational use of Robert E.Ryan Park. Section 2:That the transfer of the surplus County property in order to preserve lands for park purposes is Categorically Exempt under Section 15325 of the California Environmental Quality Act. Section 3:That the City Council of the City of Rancho Palos Verdes hereby accepts the transfer of the surplus real property and directs that City Manager and City Clerk to execute and transmit a Certificate of Acceptance associated with the transfer to the Council of Los Angeles. BACKGROUND As the result of a request from Verizon Wireless to place a telecommunications facility at Robert E.Ryan Park (30359 Hawthorne Boulevard),the City learned that a portion of the park still belongs to the County of Los Angeles.The area in question is a small section of the entrance driveway and adjacent landscaped area running parallel to Hawthorne Boulevard (see attached diagram).The area is a portion of Assessor Parcel No.7588-018-902,which is part of the County's Los Verdes Golf Course.The City owns the two parcels on either side of the subject area (APN 7588-018-901 and APN 7588-22-900). From the City's records,it appears that the County quit claimed the majority of Ryan Park (APN 7588-018-901),which is 10.51 acres in size,to the City in 1974 anc:l quit claimed the driveway entrance at Dupre Drive that was originally part of Tract No. 32673 (APN 7588-22-900),which is 4,400 square feet in size,to the City in 1982.It does not appear that the portion of the park entrance driveway that remains in County ownership (approximately 4,000 square feet in area)has any residual use associated with the adjacent public golf course. DISCUSSION Given the facts and circumstances described above,City ownership of the portion of the County property would be desirable in order to provide consistent ownership of the access to and improvements associated with Ryan Park.Therefore,in May 2009,the City arranged for the preparation of a meets and bounds description of the remainder parcel and submitted a request to the County to transfer the ownership of the area to the City (see attached letter). 4 - 6 Topic:Transfer Agreement with Los Angeles County for Remainder Parcel at Ryan Park Date:October 20,2009 Page 2 The County has agreed to transfer the parcel to the City at no cost and provided the City with the attached Transfer Agreement.The City Attorney has reviewed the Agreement and while she finds the form and content to be acceptable,she noted that a title report,title insurance and Phase I environmental review have not been conducted, as is typical when the City acquires real property.However,given the small size of the parcel,its use as a driveway and landscape area for over 35 years,and the fact that this would be a transfer rather than a purchase,staff believes that the risk to the City would be minimal and therefore recommends proceeding with the acquisition at this time. ALTERNATIVES 1.Direct staff to obtain a title report,title insurance and Phase I environmental review prior to Council taking action on the Transfer Agreement. 2.Decline the transfer of the subject parcel. FISCAL IMPACT None associated with the request,unless the Council directs staff to arrange for a title report,title insurance and Phase I environmental review of the subject property.The total cost to complete the studies would be approximately $2,000 to $3,000.The source of funding for the studies would be the General fund.
