RPVCCA_SR_2010_01_19_12_Mayors_Appt_San_ DistsCITY OF MEMORANDUM RANCHO PALOS VERDES TO: FROM: DATE: HONORABLE MAYOR AND CITY CO.~UNC~MEMBERS CARLA MORREALE,CITY CLERK ~ JANUARY 19,2010 SUBJECT: REVIEWED: MAYOR'S APPOINTMENT OF CITY COUNCIL MEMBER TO SANITATION DISTRICT NO.5 AND THE SOUTH BAY CITIES SANITATION DISTRICT CAROLYN LEHR,CITY MANAGER ~ RECOMMENDATION Appoint a member of Council to serve as either the Alternate or the Temporary Alternate to the Los Angeles County Sanitation District No.5 and the South Bay Cities Sanitation District. DISCUSSION The City Council Members represent the City on various intergovernmental agencies and associations that consider policy and legislation that directly impacts the City.In addition,Council Members serve on City Subcommittees (Ad Hoc and Standing)and as liaisons to several entities. At the January 5,2010 City Council Meeting,the Mayor appointed Council Members to the various organizations and associations for the 2010 calendar year.At that meeting, Councilman Misetich was appointed to serve as the Alternate,and Mayor Pro Tem Long was appointed to serve as the Temporary Alternate to the Los Angeles County Sanitation District No.5 and the South Bay Cities Sanitation District. On January 14,2010, Councilman Misetich notified staff and the City Attorney that he might have a conflict of interest in serving on the Sanitation Districts'Board due to the fact that he was just informed that the company he works for has recently secured a contract with the Los Angeles County Sanitation Districts.Based on these facts,the City Attorney has advised that Councilman Misetich should not represent the City in connection with the Sanitation Districts due to the provisions of Government Code 12-1 Mayor's Appointments -Sanitation District NO.5 and South Bay Cities San.District January 19,2010 Page 2 of2 Section 1090 and the Political Reform Act.Therefore,the Council will need to discuss the availability of other Council Members to serve in this capacity so that the Mayor can make another appointment. 12-2
