OVERSIZED VEHICLE PARKING PENALTIES

RECOMMENDATION
ADOPT RESOLUTION NO.2011-; A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF RANCHO PALOS VERDES ESTABLISHING A PENALTY FOR
PARKING VIOLATIONS ASSOCIATED WITH OVERSIZED VEHICLES WITHIN THE
CITY OF RANCHO PALOS VERDES.
DISCUSSION
In 2009,the City Council adopted Ordinance No.492,establishing regulations for On-
Street Parking of Oversized Vehicles (RPVMC Chapter 10.36).The new Oversized
Vehicle Parking Permit Program,as provided by RPVMC Section 10.36.040,went into
effect on January 2,2010.While the City Council established permit fees for the
program through the adoption Resolution No.2010-15 (currently $50.00),the City also
needs to establish a penalty amount for violations.
The County of Los Angeles does not have any regulations regarding the parking of
oversized vehicles,and thus has no established fees or fines associated with this
activity that can be used as a basis for comparison.However,staff surveyed other
adjacent communities and found the following cities have similar programs with the
following associated penalties:
City of Rolling Hills Estates:
$100 first offense
$200 second offense
$500 every offense thereafter
City of Redondo Beach:
$120
City of Torrance:
$125

In establishing the penalty amount,the City should consider the original permit fee
($50);the penalty amounts other surrounding jurisdictions impose;and,setting the fine
at an amount that encourages the public to comply with the permit program rather than
risk receiving a citation.Given these considerations,staff recommends establishing the
penalty amount at $120.Staff does not recommend a graduated scale,as is used in
Rolling Hills Estates,due to greater ease of administration and because RPVMC
Section 10.36.050A states:"Each day a violation is committed shall be considered a
separate offence subject to the issuance of a separate citation."This provision in
combination with the fine amount should be sufficient to persuade any repeat offenders
to comply with the City's regulations.
FISCAL IMPACT
Any net revenues derived from the collection of penalties would accrue to the General
fund.Based on current permit activity and complaint levels,staff expects this annual
amount to be minimal.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES ESTABLISHING A PENALTY FOR PARKING VIOLATIONS ASSOCIATED
WITH OVERSIZED VEHICLES WITHIN THE CITY OF RANCHO PALOS VERDES
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY
RESOLVE,DETERMINE,AND ORDER AS FOLLOWS
Section 1:Resolution No.2003-62 is hereby amended to add a penalty for violations of
Chapter 10.36 (On-Street Parking of Oversized Vehicles)of the Rancho Palos Verdes Municipal
Code.
Section 2:Civil penalties for parking and related violations as authorized by the
California Vehicle Code and Chapter 10.36 of the Rancho Palos Verdes Municipal Code are
hereby established as follows:
''The penalty for specific violations of Rancho Palos Verdes Municipal Code Section
10.36.020 (Restrictions on parking of oversized vehicles)is hereby established at $120.00 per
offence."
Section 3:The City Council hereby determines that the civil penalties for parking and
related violations as established herein are,to the extent possible,consistent with the parking
penalties levied by other agencies within Los Angeles County that generally surround the City's
boundaries.
Section 4:This Resolution shall become effective immediately upon the date of
adoption.
Section 5:The City Clerk shall certify to the passage and adoption of this Resolution and
enter it into the book of original Resolutions.
