PALOS VERDES DRIVE SOUTH LANDSLIDE DRAINAGE GRADING CAROLYN LEHR,EXECUTIVE DIRECTOR 0.9---- RON DRAGOO,SENIOR ENGINEE~ RECOMMENDATIONS:1)Based on the facts set forth in this report,find that an emergency exists which will not permit a delay arising from a competitive solicitation for bids and that the actions taken below are necessary to respond to the emergency;2)Approve and authorize the Chairman of the Board of Directors to execute a Contract with Mike Drews Construction Company,Inc.,to remove approximately 1000 feet of vegetation located to the south of the Palos Verdes Drive South roadway and to accommodate the re-grading of the drainage path within the Landslide;and 3)Approve and authorize the Chairman of the Board of Directors to execute a Contract with Hardy &Harper,Inc.to install drainage pipe to the south of the roadway once the drainage re-grading has been completed within the Landslide;and 4)Adopt Resolution 2011-_,A RESOLUTION OF THE BOARD OF THE RANCHO PALOS VERDES REDEVELOPMENT AGENCY,AMENDING RESOLUTION 2010-09,THE BUDGET APPROPRIATION FOR FISCAL YEAR 2010-11,TO INCREASE THE BUDGET IN THE PORTUGUESE BEND CAPITAL PROJECTS FUND. BACKGROUND The Portuguese Bend Landslide is moving at the rate of approximately 7 to 8 feet per year in the area that is south of Palos Verdes Drive South ("the Road").This is the most active area of the Landslide.The City Geologist has explained that the loss of the beach,which previously provided a buttress to the Landslide due to wave erosion,along with the recent increased rainfall,has accelerated the land movement so that large cracks and fissures have developed seaward of the Road.The cracks and fissures have affected the existing drainage system of y"round Corrugated Metal Pipes (CMP)to the point where they no longer convey runoff from the roadway to the ocean.In fact the ground movement in the area coupled with the disjointed drainage y"pipe drainage path now allow more water to enter the Landslide,which exacerbates the land movement.This situation has adversely affected the integrity and viability of the Road and has increased the amount and cost of the annual work that the City performs to keep the Road in a useable condition. RDA E-1 The movement of the Portuguese Bend Landslide also has caused earth to be moved from the property that is owned by the Redevelopment Agency ("RDA"),which is located to the south of the road,onto adjacent property to the east,which is owned by the Portuguese Bend Club ("the Club").For many years,the Club performed remedial grading pursuant to a permit that was issued by the Planning Commission in 1996,pursuant to the recommendations of former City Geologist Perry Ehlig.The grading permit allows the Club to perform remedial grading on an as needed basis in order to maintain specific gradients identified on an approved grading plan.This action consists of taking dirt that is deposited on the Club's property by the Landslide and to relocate it onto the RDA Property at a location determined acceptable by former City Geologist Perry Ehlig.Club represen,tatives have undertaken these actions to preserve the Club's private road (Yacht Harbor Drive) as well as to protect the homes that are located on the western side of their residential subdivision.The Club and City recently performed repairs,using Mike Drews Construction to relocate 60,000 cubic yards of dirt,pursuant to its grading permit,and in conjunction with the Palos Verdes Drive South Stabilization project. The Palos Verdes Drive South Stabilization project used soil that was removed from Bend Club property as described above and placed it adjacent to the roadway in an effort to help stabilize the roadway. The Club is again performing work through their grading permit to reestablish their roadway and has approximately 20,000 yards of soil that can be used to accomplish the needed drainage grading work in the area.See map of the area of work,Attachment A. DISCUSSION The City Geologist recommends that grading be performed on the RDA's property that is located to the south of the Road.The purpose of the grading is to fill the cracks and fissures that are within the existing and newly created drainage paths so water will not enter the Landslide so easily and to install drainage pipe on the seaward side of the Road to provide a functional path for the runoff drainage that is generated by Palos Verdes Drive South and to accommodate runoff from properties to the north.Re-establishing the drainage system will help remove runoff from the area and ultimately extend the useful life of the roadway. The stability of the Road is vitally important to the public and to the City's ability to provide law enforcement and fire suppression services to residents who reside on the south side of the City,since it is one of the City's main arterials. The intent of the proposed project is to enhance the stability of the area that was graded last year,which staff believes will have the corresponding benefit of increasing the stability of this portion of the Landslide area and of the Road itself.Thus,the proposed project will help maintain the viability of the major roadway that is located on the south side of the City,which extends from the eastern boundary to the western boundary of the City.Albeit it is difficult to estimate the amount of movement (and associated cost of repairs)the Road will be subject to during anyone year,this project should have the additional benefit of reducing,to some RDA E-2 extent,the City's annual cost to maintain the Road,which has been approximately $400,000 per year,during recent years. The Director of Public Works estimates that the RDA will need approximately 20,000 cubic yards of earth to fill in the cracks and fissures and provide the path on the seaward side of the Road to re-establish the drainage facility,ultimately enhancing roadway stability.As discussed above,the Club is in the process of removing approximately 20,000 cubic yards of earth from the western side of the Club's property,during the grading operation to re- establish the private road within the Club's boundaries.This soil is being placed back on the RDA's property and is available to be used to facilitate the grading operation needed to re- establish the drainage system.~ Environmental requirements include filing a plan with the Regional Water Quality Control Board,filing a Storm Water Improvement Protection Plan (SWIPP)or a Notice of Intent (NOI)whichever is determined necessary (estimated cost $2,000),mediating the affected area against the affects of erosion (hydroseeding the area at an estimated cost of $10,000) and video taping the area prior to construction (estimated cost of $2,000).Consultants will be used to accomplish these tasks at an estimated total cost of $14,000. Due to the immediate need to perform this grading work to fill the cracks and fissures and re- establish the drainage system which will help stabilize the area and the Road,Staff is recommending that the RDA enter into a contract with Drews Construction to perform the grading work that is necessary and to enter into a contract with Hardy and Harper,Inc.to re- establish the drainage system as recommended by the City Geologist.Drews Construction has provided a proposal to the RDA to remove the vegetation in the area where the cracks are located,fill the cracks and fissures and grade the area to accommodate the drainage pipes for an estimated cost of $39,750.Likewise,Hardy and Harper,Inc.has provided a proposal to re-establish the drainage system for an estimated cost of $67,000.Because of the benefits of addressing several different problems by doing all of this work at once,and the immediate need to provide additional stability to the Road,Staff recommends that the RDA find by a 4/5 vote that an emergency exists,approve the agreement with Drews Construction,and authorize the Chairman to execute the contract. ADDITIONAL INFORMATION Staff contacted two other contractors to obtain additional bids for the grading work.Hardy and Harper submitted an incomplete proposal for the required grading in the amount of $38,475.The proposal was incomplete as it did not including providing the soil that will be needed to complete the grading and it did not include the cost to remove and dispose of vegetation.The other company,S.P.Pazargad,did not submit a proposal to Staff. CONCLUSION The RDA needs approximately 20,000 cubic yards of earth to fill cracks and fissures, enhance the stability of the Landslide area and improve the stability of the Road.The Club has 20,000 cubic yards of dirt available from the private road re-establishment effort. RDA E-3 Accomplishing both tasks at once is cost effective and efficient and will eliminate hazardous conditions that are adversely affecting the Road and residents of the City and the Redevelopment Project Area.Accordingly,Staff recommends that the Agency Board take the actions recommended by Staff. FISCAL IMPACT The total cost of this project is estimated to be $120,750. WHEREAS,Section 3.32 of the Rancho Palos Verdes Municipal Code provides that all expenditures in excess of budgeted allocations must be by supplemental appropriation of the Agency Board:and WHEREAS,on July 6,2010,the Board of the Rancho Palos Verdes Redevelopment Agency adopted Resolution 2010-09,approving a spending plan and authorizing a budget appropriation for FY1 0-11: and WHEREAS,grading has become necessary for landslide mitigation to re-establish the drainage system in the Portuguese Bend portion of the Redevelopment Project Area;and WHEREAS,the Agency Board has determined that the specific grading and drainage expenditures should be completed in FY1 0-11;and BE IT,THEREFORE,RESOLVED BY THE BOARD OF THE RANCHO PALOS VERDES REDEVELOPMENT AGENCY: The following adjustment is made to the FY1 0-11 budget: Increase the Redevelopment Agency's Portuguese Bend Capital Projects Fund budget as follows: Portuguese Bend #375-3075-461-73-00 Improvements $120,750 PASSED,APPROVED,AND ADOPTED THE 151 DAY OF FEBRUARY 2011.
