RPVCCA_CC_SR_2012_12_18_D_NOC_Miraleste_Plaza_Storm_Drain_ImprovementsCrrvOF MEMORANDUM TO: FROM: DATE: SUBJECT: REVIEWED: Project Manager: HONORABLE MAYOR &CITY COUNCIL MEMBERS JIM HENDRICKSON,INTERIM DIRECTOR OF PUBLI<{7AQ \f WORKS ~ DECEMBER 18,2012 NOTICE OF COMPLETION FOR THE MIRALESTE PLAZA STORM DRAIN IMPROVEMENTS (SUPPORTS 2012 CITY COUNCIL GOAL FOR PUBLIC INFRASTRUCTURE) CAROLYN LEHR,CITY MANAGER ~ Andy Winje,Associate Engineer RECOMMENDATIONS 1.Accept the work as complete. 2.Authorize the City Clerk to file a Notice of Completion with the L.A.County Registrar- Recorder Office and if no claims are filed within 35 days after recordation,and upon the contractor posting an acceptable warranty bond,notice the surety company to exonerate the Performance bond. 3.Authorize the Director of Public Works to release the 5%retention payment in the amount of$10,471.66 to MG Enterprises,Inc.35 days after recordation ofthe Notice of Completion by the L.A.County Recorder contingent upon no claims being filed on the project and the contractor posting an acceptable warranty bond. BACKGROUND The City Council awarded a contract on August 21,2012 to MG Enterprises,Inc.to construct improvements to the storm drain system in and around Miraleste Plaza.The contractor's work is now finished and has been successfully reviewed for conformance to the project plans and specifications. D-1 DISCUSSION The project scope included construction of about 840 linear feet of 18~inch reinforced concrete pipe,five manholes,curb and gutter repair and re~establishment of the storm drain outfall.Additional and previously unforeseen work was also accomplished to improve the Plaza and nearby drainage system elements including 25 feet of valley gutter in the alley behind the Plaza,a point repair to a drain on nearby Via De Anzar and improvements to inlet structures in the Plaza itself.The cost of the additional work is included as a balancing change order totaling $13,033.18. The total project construction budget,including contingencies,authorized by the Council is $216,400.The project,including the additional work,was completed for $209,433.18,about 97%of the authorized budget,yielding a savings of $6,966.82.These figures are summarized in the table below. CONCLUSION MG Enterprises,Inc.has successfully completed all work in accordance with the plans and specifications.Therefore,the work should be accepted as complete and a Notice of Completion filed. FISCAL IMPACT The project was funded through the Water Quality and Flood Protection Program and was completed within the authorized budget.The recommended action will have no fiscal impact.
