(Supports 2012 City Council Goal -City Trail Systems Enhancement) CAROLYN LEHR,CITY MANAGER@ter (:.'- Project Manager:So Kim,Associate Planner$l/v RECOMMENDATION Adopt Resolution No.2012-_,authorizing the City Manager or Community Development Director to execute an easement agreement dedicating to the City a public access and recreation easement over a portion of the property owned by the Salvation Army located at 30840 Hawthorne Blvd. BACKGROUND In February 2008,the Planning Commission considered an application for a dormitory addition at the Salvation Army property.At that time,Staff and the public raised questions about the Salvation Army's interest in providing a public trail easement along Palos Verdes Drive South in order to connect existing trails on the Upper Point Vicente property with the remainder of the Preserve trail system.Since there was no nexus between the proposed dormitory expansion and the need for a public trail easement,that project was not conditioned to require a public trail easement dedication.The Salvation Army indicated that it was willing to dedicate the sought-after trail easement to the City even without the condition,but eventually communication between the Salvation Army and Staff ceased. In September 2011,the Planning Commission approved Case No.ZON2011-00152, allowing the Salvation Army to construct second story additions to seven separate residential structures on its property.At the public hearing,the Planning Commission D-1 expressed its disappointment with the inability of the City to obtain a trail easement from the Salvation Army in 2008.As a result,Staff noted that since the City cannot require the Salvation Army to dedicate the trail easement,it was up to the Salvation Army to uphold its previous commitment to dedicate a public trail easement.In response,Captain Nolan,a Salvation Army representative,stated that Salvation Army would proceed with a trail easement dedication to the City and requested a formal and more detailed documentfrom the City in order to move the matter forward.The Salvation Army and the City have worked together to draft an easement agreement,which was reviewed and approved by the City Attorney and the Salvation Army. DISCUSSION The City's Conceptual Trails Plan (CTP)identifies a continuous trail along Palos Verdes Drive South (PVDS)leading from the City Hall property extending eastward through the Salvation Army property and the adjacent Peninsula Pointe residential development and into the City's Nature Preserve.Currently,there is an existing trail on the City's Upper Point Vicente property along PVDS (City Hall Segment -CTP AS)that leads to the Salvation Army property,and there is a trail to the east of the Salvation Army property along the Peninsula Pointe residential tract that connects to the City's Nature Preserve (Seahill Segment -CTP A7).However,because there is no trail easement or improved trail along the Salvation Army property,there is a gap in the trail.Accepting the Salvation Army's public trail easement (Salvatipn Army Segment -CTP A6)would provide the opportunity for the City to construct a trail that would allow trail users to traverse from the City Hall trails to the core area of the RPV Nature Preserve,as identified in the CTP.In addition,such a trail would allow Terranea guests to traverse from the coastal trails on the resort to the preserve areas around City Hall to the northwest or to the preserve areas around Portuguese Bend to the northeast. The CTP notes that the Salvation Army trail segment should be kept as far from the road as possible with a provision for crossing Crestmont Lane (the private access roadway to the Salvation Army from PVDS).The CTP further states that the preferred route for this trail is on the southern edge of the Salvation Army parcel on the bank above PVDS with an alternative location being within the street right-of-way.One of the contingencies for the Salvation Army to dedicate a trail easement on its property to the City at no cost was that the trail location not create security or privacy concerns for the Salvation Army.For all these reasons,the trail location that has been agreed upon by the Salvation Army minimizes the amount of easement needed on the Salvation Army's property and maximizes the use of the City's street right-of-way. As shown in the attached aerial map,the public trail will be within the public right-of-way of PVDS along the easterly portion of the Salvation Army property.The reason for this is to facilitate a connection to the existing improved trail fronting the adjacent Peninsula Pointe residential development,to provide a signalized pedestrian crossing of Crestmont Lane,as called out in the CTP,and to adhere to the Salvation Army's request of keeping the trail easement as far away from the cadets'residences as possible.Moving westward,the trail will leave the right-of-way and enter onto a small portion of easement on the Salvation Army property to go around a large existing drainage outlet.As the trail approaches the D-2 western side of the Salvation Army property,the trail will veer onto the main portion of the new trail easement,leading up to a viewing node,which will then lead onto the existing trails on the City's Upper Point Vicente Park property.The location of the public trail along PVDS will allow the trail users a view of the Rancho Palos Verdes coastline and of Catalina Island.The viewing node,which will be located on the City property,adjacent to the westerly edge of the Salvation Army property,will allow trail users to capture an even better view,given its high elevation relative to PVDS. FISCAL IMPACT Typically,dedication of a public trail easement to the City by a private entity must be compensated by the City at the fair market value of the easement area.However,in this situation,the Salvation Army has agreed to dedicate the public trail easement to the City for no compensation.In exchange,the City has agreed to pay for all of the costs of preparing the easement documents,surveying the easement location and recording the public easement.The cost of said City tasks is estimated at $7,200.These costs have been paid for from the existing Community Development and Public Works Department budgets.Additionally,the City has agreed to construct the trail,including relocating a portion of the fence on the Salvation Army's property.Staff does not yet have estimates of how much this construction work will cost. ADDITIONAL INFORMATION Once the public easement is recorded,the City will initiate construction of the trail.The City's Public Works Department is currently working with a City consultant in putting together the trail construction plans.It is anticipated that the trail construction will commence sometime in early 2013.
