BACKGROUND A Congestion Management Program (CMP)was enacted by the State Legislature in 1990 to improve traffic congestion in California's urban areas.In accordance with the State statute,the Los Angeles County Metropolitan Transportation Authority (MTA)[previously known as the L.A.County Transportation Commission (LACTC)]adopted the first CMP for Los Angeles County on November 18,1992. The MTA has updated and adopted several Congestion Management Programs since 1993.Most recently,the Metro Board adopted the 2010 Congestion Management Program (CMP)for Los Angeles County.The 2010 CMP summarizes the results of eighteen years of CMP highway and transit monitoring and fifteen years of monitoring local growth.The implementation guidelines for local jurisdictions are also contained in the 2010 CMP. 1-2 In accordance with the 2010 CMP,the purpose of this agenda item is for the City Council to adopt the attached self-certification conformance resolution,thereby adopting the City's 2012 Local Development Report (LOR)and self-certifying the City's conformance with the CMP requirements.The attached LOR is a reporting form,which calls for information on new net development in our City within the 2011-2012 fiscal year.Upon adoption,the resolution and 2012 LOR will be transmitted to the MTA for its review and approval. DISCUSSION In adopting the attached self-certification resolution,the City resolves that it is in conformance with all the applicable requirements of the 2010 CMP and has taken,or will take,each of the following four specific actions (the requisite action appears in bold type and the City's response in normal type): 1.By June 15,of odd numbered years,the City will conduct and transmitto the MTA traffic counts and calculated levels of service for selected arterial intersections, consistent with the requirements identified in the CMP Highway and Roadway System Chapter. The current year of 2012 is not an odd numbered year and therefore the requisite action is not applicable.Next year's (2013)report will address this action. 2.The City has locally adopted and continues to implement a Transportation Demand Management (TDM)Ordinance,consistent with the minimum requirements identified in the CMP Transportation Demand Management Chapter. On February 2,1993,the City Council adopted the required TOM Ordinance (Municipal Code Chapter 10.28)and staff continues to implement the TOM Ordinance,where applicable.As part of the Development Code Amendment proceedings,completed in May 1997,the TOM Ordinance was incorporated into the Development Code by reference. 3.The City has locally adopted and continues to implement a land use analysis program,consistent with the minimum requirements identified in the CMP Land Use Analysis Program Chapter. On September 17,2002,the City Council adopted an amended set of Local CEQA Guidelines,which incorporated the County's CMP Land Use Analysis program into the City's environmental review procedures.City staff continues to implement the land use analysis program where applicable. 4.The City has adopted a 2012 Local Development Report consistent with the requirements identified in the CMP.The LDR tracks new development,exempted development,and development adjustments as a result of building permits issued between June 1,2011 and May 31,2012. 1-3 During the period between June 1,2011 and May 31,2012,there were building permits issued for six new single-family units and a permit for one 16,902fF institutional project (St. John Fisher).Additionally,there were demolition permits issued for two single-family residential units and 7,S05fF of institutional structures (St.John Fisher).Based on this data,there was a net increase of four residential units and 9,1 OOfF of institutional building space in the City during the 12-month monitoring period. ADDITIONAL INFORMATION The 2010 Congestion Management Program guidelines specify that a resolution of conformance must be adopted by the local jurisdiction's governing board at a noticed public hearing.A public notice was published on June 2Sth for the City Council public hearing on July 31,2012.There have been no public comments in response to the public notice. CONCLUSION The City Council,through a noticed public hearing,must adopt a self-certification conformance resolution,whereby the City agrees to conform to the local responsibilities required by the 2010 CMP,including preparation of the 2012 LDR.As documented in this Staff Report,the City is in conformance with all applicable requirements of the 2010 CMP and has taken all of the required actions of the Deficiency Plan.Therefore,Staff recommends that the City Council adopt the attached Resolution No.2012 -_.
