BACKGROUND The City has exclusive single-family and multi-family residential solid waste and recycling agreements with EDCO Disposal Corporation (EDCO)for 95%of the City and Universal Waste Systems,Inc.(UWS)for the remaining 5%of the City,concentrated in the coastal and landslide areas of the City.Both agreements commenced on July 1,2010 and will terminate on June 30,2017.Additionally,both agreements have an extension option of up to 36-months,at the City's sole discretion. Per their residential agreements,EDCO and UWS are eligible for annual adjustments to the maximum permissible rates they can charge.The increases are based on national published price indices and solid waste disposal facility gate rates.The City establishes the cap for the maximum allowable rates EDCO and UWS can charge their residential 3-2 UWS Public Hearing June 5,2012 Page 2 customers.UWS's agreement only allows a straight pass-through of costs.Their agreement does not allow any other increases.Rate adjustment requests are due to the City by March 30 of every year.EDCO and UWS both submitted their requests for rate adjustments for FY 12-13 prior to that deadline.Staff placed notices of the public hearing i~the Palos Verdes Peninsula News on May 24,and May 31,2012. DISCUSSION On May 2,2012,staff met with the Solid Waste Subcommittee comprised of Mayor Misetich and Councilmember Duhovic.After review of the exhibits,discussions with staff and UWS representative,the Subcommittee approved staff's recommendation of bringing this rate adjustment request to the full City Council for consideration and approval. During the recent residential contracts procurement process,one of the City's goals was providing identical Citywide maximum rates (caps)and services for automated curbside collection.Therefore, when City Council approved UWS's residential agreement in May 2009,that approval was contingent on the cap for UWS's automated curbside rates matching the cap for EDCO's automated curbside rates.The proposed maximum permissible FY 12-13 automated curbside rates were discussed in EDCO's staff report. Per the agreement,UWS would match EDCO's current and future approved capped rates. Therefore,this report will focus on UWS's other services (non-automated)which includes manual unlimited backyard collection,manure collection,and multi-family bin service. Similar to EDCO,UWS has a City approved rate adjustment methodology (RAM).The RAM is based on the average percentage changes,both increases and decreases,for a 12 month period.The rate adjustment evaluation period effective FY 12-13 begins with the calendar year 2011 (January 2011 to December 2011).If approved,the new maximum permissible rates become effective on July 1,2012,six months after the evaluation period. Furthermore,in accordance with Section 6.3 of UWS's agreement (see attached): "Adjustments to the maximum rates is subject to the approval of the City Council at a public hearing,although the Council's discretion shall be limited to determining,based on substantial evidence,whether the requested maximum rate adjustment meets the requirements as set forth herein." The RAM has two cost components:a Service/Collection Cost Component,and a Disposal Cost Component. 1)Service/Collection Cost Component:UWS's service/collection cost increases are based on the percentage of increases/decreases in several national indices from the U.S. Department of Labor,Bureau of Labor Statistics for calendar year 2011.These indices are identical to the ones used by EDCO,and are specifically tailored to solid waste collection operations.Hence,UWS's collection cost component is 1.9%,the same as EDCO's. W\LAUREN\STAFFRPnREFUSE\2012\UWS rate adjustment fy 12-13 .doc 3-3 UWS Public Hearing June 5,2012 Page 3 2)Disposal Cost Component:UWS's disposal cost increases are based on the percentage increases at the Puente Hills County owned landfill for one year,from January 1,2011 to January 1,2012.Disposal costs at Puente Hills for solid waste increased from $38.26/ton to $38.41/ton,which is a 0.4%increase during this period.(Attachment B- Exhibit 5A,Row 4C). Approximately 17%of UWS's overall costs are related to disposal costs and 83%related to service/collection costs.UWS's total weighted residential rate adjustment,which reflects both disposal and service cost components,is 1.7%(See attached table Exhibit 5A,Row 11 F).Therefore,in accordance with these indices,the landfill gate rate,and per the provisions in the City's agreement with UWS,a 1.7%increase for the manual unlimited backyard,manure,and multi-family services is being requested.This 1.7%is not in addition to EDCO's 2.3%requested rate increase.This 1.7%increase is independent and is for other services that UWS provides to a different group of its customers. This requested increase would allow UWS to pass-through the incurred cost increases from 2011.Similar to EDCO,UWS's agreement only allows a straight pass-through of costs.It does not allow UWS to have any further increases or additional costs added to the rates.Comparatively,last year mainly due to fuel costs,UWS's rate increase was 2.5%. As mentioned earlier in the report,UWS's automated curbside services would increase 2.3%similar to EDCO's.Staff and HDR Engineering,the City's AB 939 consultant,have reviewed the data and calculations provided by UWS,and found them accurate.(See Attachment B). FEES DISTRIBUTION/ALLOCATION:UWS currently pays the City 12%of their gross receipts for Collector Fees (estimated at $39,000/year)and 3%for Environmental Fees (estimated at $9,000/year).The proposed rate adjustment,if approved,would increase UWS's gross receipts between 1.7%and 2.3%.Resulting in a slight increase in the total fees paid by UWS to the City. W:\LAUREN\STAFFRPl\REFUSE\2012\UWS rate adjustment fy 12-13 .doc 3-4 UWS Public Hearing June 5,2012 Page 4 The allocation of the fees is at the discretion of the City Council.Staff proposes to have the same allocation of the Collector and Environmental Fee percentages among City funds as EDCO does.Additionally,UWS provides the City an annual Recycling Rebate of $16,000,which is deposited in the Beautification-Recycling Fund.There will be no change in the Recycling Rebate amount in FY 12-13. ALTERNATIVE The City Council may choose to change the proposed Collector Fee,Environmental Fee, and/or Recycling Rebate distribution as otherwise deemed appropriate. FISCAL IMPACT Approving staff's recommendations will increase UWS'gross receipts by 2.3%for automated customers and 1.7%for manual,manure and multi-family customers.Thus,in FY 12-13 the General Fund revenues will increase by approximately $800 and Waste Reduction by approximately $200. Contractor shall impose no other charges for 'services provided to Customers unless approved in advance in writing by the City Manager. Contractor shall not charge for Collection at Premises owned and/or operated by the City now and in the future. 6.3 Schedule of Future Adjustments Beginning with the Rate Year starting July 1,2011 and ending on June 30,2012 and for all subsequent Rate Years,Contractor may request an annual adjustment to the maximum rates shown in Exhibit 4.The Contractor shall submit its request in writing, to be received by City in Person or via certified mail,by the preceding March 30,and shall be based on the method of adjustment described in Section 6.4.Failure to submit a written request by March 30 shall result in Contractor waiving the right to request such an increase for the subsequent Rate Year.Missed rate adjustments may not be added to rate adjustment applications in ensuing years.Adjustment to the maximum rates is~Ubject to the approval of the City Council at a public hearing,although the Council's discretion shall be limited to determining,based on substantial evidence,whether the requested maximum rate adjustment meets the requirements as set forth herein. 6.4 Method of Adjustments 6.4.1 General Pursuant to Section 6.3,the Contractor may request an adjustment to the maximum rates according to the method described below and the formulas shown in Exhibit 5, 3-6 UWS Article 6 (cont'd) subject to review and approval of City.All future adjusbnents are to be effective July 1 of the same year. 6.4.2 Cost Components for Rate Adjustment Indices The approved rates consist of the following cost component categories.Each cost component may be adjusted by the change in the corresponding index below.See Se ti 643 f d ail d d'dcon..or et e rate a llusbnent proce ures. See Exhibit 5. Step One -Calculate the percentage increase or decrease in each index listed in Section 6.4.2.The increase or decrease in the published indices for fuel,equipment and all other (CPI,less food and energy)will be the change in the average annual published index between the calendar year ended the December prior to the Rate Year anniversary date and prior calendar year. Step .Two -The first rate adjustment cost components as a percentage of total costs are provided in Section 6.4.2 above,with subsequent components calculated in Step Four of the rate adjustment.For Step Two of each subsequent rate adjustment,use the cost components recalculated in Step Four during the previous rate adjustment. Multiply the percentage changes for each rate adjustment component by that component's weighting and add these resulting percentages together to get the total weighted change to the rates. Step Three -Multiply the total weighted percent change from Step Two by the existing Customer rates to calculate the increase or decrease to the maximum rates.Add the rate increase or decrease to the existing rates to derive the newly adjusted rates. Step Four -Recalculate weightings for the following year based upon these changes.
