RPVCCA_CC_SR_2012_05_15_N_Accepting_Street_Rights_Tract_Map_50667CITY OF MEMORANDUM TO: FROM: DATE: SUBJECT: RANCHO PALOS VERDES ADOPT RESOLUTION NO.2012-XXX A RESOLUTION OF THE CITY OF RANCHO PALOS VERDES ACCEPTING RIGHT-OF-WAY FOR TWIN HARBORS VIEW DRIVE,ISTHMUS VIEW DRIVE,EMERALD VIEW DRIVE AND CAPE POINT DRIVE AS IDENTIFIED AND RECORDED ON TRACT MAP 50667 BACKGROUND Vesting Tract Map No.50667,a residential planned development on a 107.5 acre site with thirty-six (36)single family lots,portions of a public golf course,and public open space in connection with the Trump National Golf Club project is bounded by Palos Verdes Drive South on the north,Vesting Tentative Tract Map No.50666 for the Trump project on the west,the Pacific Ocean on the south and the City's Shoreline Park on the east.The conditions of approval for Vesting Tentative Tract Map 50667,originally approved on June 1,1992,required dedicatation of Twin Harbors View Drive,Isthmus View Drive,Emerald View Drive and Cape Point Drive for public use and street purposes.The City accepted the street dedications subject to improvements.The Street and Highways Code of the State of California requires a resolution by the City to accept a city street or road into the City's street system for maintenance. N-1 DISCUSSION Vesting Tract Map No.50667 was recorded by Los Angeles County on October 12, 1999,which includes dedication for public use,Twin Harbors View Drive,Isthmus View Drive,Emerald View Drive and Cape Point Drive,subject to improvement.The Public Works Department has verified that street and sidewalk improvements have been completed satisfactorily. Division 2.5 "City Streets"of the California Streets and Highways Code outlines the process to follow for accepting public streets into the City street system for maintenance.In accordance with Section 1806(b)of the Code,no public or private street or road shall become a city street or road until the governing body,by resolution, has caused the street or road to be accepted into the City street system.The City need to only adopt a Resolution citing specific facts that allows for the dedication of the street right-of-way - a Public Hearing is not required. Although the Public Works Department has verified that the street and sidewalk improvements were completed to the satisfaction of the City,subsequent action to officially accept these streets had not been taken.The streets are currently guarded by barricades and are monitored by a private security service hired by the Trump Organization.If the City Council chooses to accept staff's recommendation to formally accept the streets,staff will request immediate removal of the barricades so that the streets and sidewalks will be opened for public use. Staff recommends that the City Council adopt Resolution No.2012-xxx,which will accept the right-of-way for Twin Harbors View Drive,Isthmus View Drive,Emerald View Drive and Cape Point Drive on Vesting Tract Map No.50667,and described in Exhibit "A"of the attached Resolution. FISCAL IMPACT Adopting staff's recommendation will not result in an impact to the FY 2011-2012 budget.However,these streets are located in Residential Pavement Rehabilitation Zone 7 and will be included in the rehabilitation program during FY 2016-2017. Attachments: Resolution No.2012-_A RESOLUTION OF THE CITY OF RANCHO PALOS VERDES ACCEPTING RIGHT-OF-WAY FOR TWIN HARBORS VIEW DRIVE, ISTHMUS VIEW DRIVE,EMERALD VIEW DRIVE AND CAPE POINT DRIVE AS IDENTIFIED AND RECORDED ON VESTING TRACT MAP 50667 N-2 RESOLUTION NO.2012-_ A RESOLUTION OF THE CITY OF RANCHO PALOS VERDES ACCEPTING STRET RIGHTS-OF-WAY FOR TWIN HARBORS VIEW DRIVE,ISTHMUS VIEW DRIVE,EMERALD VIEW DRIVE AND CAPE POINT DRIVE AS IDENTIFIED AND RECORDED ON TRACT MAP 50667 THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND,ORDER AND RESOLVE AS FOLLOWS: WHEREAS,the City of Rancho Palos Verdes approved Vesting Tentative Tract Map 50667 on June 1,1992,said map being for a residential planned development on a 107.5 acre site with thirty-six (36)single family lots,portions of a public golf course,and public open space in connection with the Ocean Trails Project located in coastal Subregions 7 and 8;and, WHEREAS,on October 12,1999,Final Map No.50667 was recorded with the County of Los Angeles;and, WHEREAS,Twin Harbors View Drive,Isthmus View Drive,Emerald View Drive and Cape Point Drive on Tract Map No.50667 were offered for dedication to public use for street purposes to the City of Rancho Palos Verdes;and WHEREAS,Twin Harbors View Drive,Isthmus View Drive,Emerald View Drive and Cape Point Drive were offered for dedication on Tract Map No.50667 and were accepted by the Rancho Palos Verdes City Council provided that all streets,as shown on Tract Map No.50667 shall not be accepted into the City street system until improvement thereof has been completed to the satisfaction of the Director of Public Works,and until a resolution so accepting said streets into the City street system has been adopted by the City Council;and WHEREAS,the streets shown on Tract Map No.50667,Twin Harbors View Drive,Isthmus View Drive,Emerald View Drive and Cape Point Drive were improved, inspected,and the condition of the streets was approved by the Director of Public Works;and WHEREAS,Division 2.5 "City Streets"of the California Streets and Highways Code (Section 1800 et.seq.)outlines the process to follow for accepting public streets into the City's street system for maintenance;and WHEREAS,pursuant to Section 1806 9b)of the California Streets and Highways Code,no public or private street or road shall become a city street or road until the 1423910-1 N-3 governing body,by resolution,has caused the street or road to be accepted into the city street system. NOW,THEREFORE THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY RESOLVE AND ORDER AS FOLLOWS: Section 1.Required Findings.The City Council of the City of Rancho Palos Verdes,hereby accepts the offer of dedication made for street purposes for Twin Harbors View Drive,Isthmus View Drive,Emerald View Drive and Cape Point Drive as identified on Tract Map No.50667 attached hereto as Exhibit "A:and made a part thereof by this reference. Section 2.The City of Rancho Palos Verdes hereby declares that the acceptance of the offer of dedication of Twin Harbors View Drive,Isthmus View Drive, Emerald View Drive and Cape Point Drive of Tract Map No.50667 vests title to these streets in the City of Rancho Palos Verdes for public street purposes and that the improvements thereof have been completed to the satisfaction of the City Council.
