RPVCCA_CC_SR_2012_05_01_A_Abalone_Cove_Sewer_Pump_RepairsMEMORANDUM TO: FROM: DATE: SUBJECT: REVIEWED: STAFF L1ASON: HONORABLE MAYOR AND CITY COUNCIL MEMBERS TOM ODOM,DIRECTOR OF PUBLIC WORK~ MAY 1,2012 ABALONE COVE SEWER PUMP STATION REPAIRS CAROLYN LEHR,CITY MANAGER oY-- RON DRAGOO,SENIOR ENGINEE~ RECOMMENDATIONS Review and reconfirm by four/fifths (4/5)vote,the City Council's previous action taken on February 21,2012,authorizing staff to continue with the actions taken to perform emergency repairs to the Abalone Cove Sewer Pump Station located within the Abalone Cove Shoreline Park. BACKGROUND On February 21,2012,the City Council found that an emergency exists,which will not permit a delay arising from a competitive solicitation for bids to enter into a contract with a contractor,to perform emergency sewer pump and electrical control panel repairs which are needed to repair the failing sewer pump station at Abalone Cove's Shoreline Park. Accordingly,the City Council approved a contract with Multi W Systems,Inc.to re-establish a safe and operational sewer pump station. DISCUSSION Approval of the emergency for this work required a four-fifths (4/5)vote of the City Council under Public Contract Code Section 22050(a)(1).In addition,Public Contract Code Section 22050(c)(1)requires that when a governing body takes action under Section 22050(a)(1),it must review this action and reaffirm it by a four-fifths (4/5)vote at each subsequent regularly scheduled meeting until the work is completed and accepted. At this time the pump station has been retrofitted with the new control panel which controls one of the new three phase pumps which is operational.A single phase backup pump has been temporarily configured to assist in the pumping operation if needed and is operational. A-1 The second three phase pump was damaged during shipment and has been returned to the vendor.A new pump has been ordered,is being assembled and is expected to arrive early in May.Once the pump is received,the installation,tuning and testing of the new pumps should be completed quickly.Accordingly,because the work has not been entirely completed,staff has placed this item on tonight's agenda.This item will be placed on each subsequent agenda until all the work is completed and the City Council accepts the project as complete.Staff anticipates bringing the Notice of Completion for this project to the City Council at a meeting in May. CONCLUSION Staff recommends that the City Council review and reconfirm by fourlfifths (4/5)vote,their previous action taken on February 21,2012,authorizing staff to continue with the actions taken to p~rform emergency repairs to the Abalone Cove Sewer Pump Station located within the Abalone Cove Shoreline Park.
