BACKGROUND In December 2011,the Planning Commission conducted public hearings for a proposed code amendment that would amend the City's interpretation procedure to allow property owners greater flexibility to adjust the location of the OH boundary line on their property without having to process a costly and time-consuming code amendment.The proposed code amendment is a separate item on the Council's February 7,2012 agenda.As a result of the public meeting requests for said code amendment,some residents in the Eastview section of the City raised concerns to Staff about the depiction of the OH boundary line in the Eastview area.Staff investigated the matter and concluded that the OH areas in the Eastview area had been incorrectly depicted on the City's Official Zoning Map when the Eastview area was annexed into the City in 1984.The purpose of this item is to correct the City's Zoning Map. DISCUSSION When Eastview was annexed into the City in 1984,a Zoning Map amendment was approved which established the zoning for the area.Along with the residential and commercial zoning districts,three natural canyon areas were zoned Open-Space Hazard. The extent of the OH zoning for these three canyons was depicted in an exhibit attached to the ordinance which adopted the Eastview zoning (Ordinance No.184).As noted earlier, as a result of the proposed amendment related to adjusting the location of the OH zoning I-1 City Council Meeting Revised Official Zoning Map February 7,2012 districts Citywide,it came to Staffs attention that there is a discrepancy between the Open- Space Hazard (OH)areas depicted on the Official Zoning Map and the OH areas depicted on the exhibit for Ordinance No.184 (attached),which approved the zoning for the Eastview area when it was annexed in 1984.In analyzing the exhibit for Ordinance No. 184 and the City's Official Zoning Map,it appears that the OH areas on the Zoning Map were drawn larger than the areas in the exhibit to Ordinance No.184. Since Staff had no reason to believe that the City's Official Zoning Map was drawn incorrectly,this discrepancy has been in place since 1984.Staff discussed this issue with the City Attorney,who opined that the OH areas depicted on the exhibit to Ordinance No. 184 take precedence over the depiction that was subsequently made on the Official Zoning Map,and thus the Official Zoning Map needs to be corrected in order to be consistent with the adopted Ordinance No.184.Working with the City's GIS Staff,Staff has made the necessary corrections to the City's digitized Official Zoning Map so that the OH areas in the Eastview area match the exhibit for Ordinance No.184. Additionally,Staff is taking this opportunity to label the overlay control district for Mira Vista "OC-5"and the residential zoning district "rs-5"zoned areas within Eastview on the corrected Zoning Map.This is simply to provide further clarity as to the extent of these existing zoning districts. As such,Staff is recommending that the City Council introduce an Ordinance that corrects the Official Zoning Map so that the mapped OH areas match the exhibit for Ordinance No. 184. ADDITIONAL INFORMATION Public Notice The Council's approval of a corrected Zoning Map does not require a public notice or public hearing since the Council's action is not amending the Zoning Map but is simply correcting the zoning map to match the amendment that was approved in 1984 by the City Council at duly noticed public hearings when the Eastview area was annexed in 1984. CONCLUSION Based upon the discussion above,Staff recommends that the Council introduce Ordinance No._,approving the corrected Official Zoning Map. WHEREAS,on November 1,2011,the City Council adopted Ordinance No.528, accepting the updated digitized Zoning Map as the City's Official Zoning Map;and WHEREAS,on December 2,2011,the updated digitized Official Zoning Map went into effect;and WHEREAS,upon the discovery that the City's Official Zoning Map differed from Ordinance No.184,which adopted the zoning for the Eastview area that was annexed into the City in 1984,an additional revision to the Official Zoning map is necessary so the Open-Space Hazard Areas located on the Official Zoning Map match the Exhibit to Ordinance No.184;and WHEREAS,the terms for the overlay control district "OC-5"and residential zoning district "rs-5"were added to the Zoning Map;and NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND,DETERMINE,AND RESOLVE AS FOLLOWS: SECTION 1:The Official digitized Zoning Map,as previously adopted by Ordinance No.528,shall be corrected to eliminate any discrepancies between the Official digitized Zoning Map and Exhibit A to Ordinance No.184,so as to achieve consistency and accuracy. SECTION 2:The terms of "OC-5"and "rs-5"shall be added to the Eastview area on the updated digitized Zoning Map to provide further clarity of the existing zoning and overlay""districts. SECTION 2:The revised digitized Zoning Map as set forth in Exhibit 'A'hereto shall be the Official Zoning Map of the City of Rancho Palos Verdes. WHEREAS,the City Council has held a public hearing on this matter on August 7,1984,at which time all interested parties were given an opportu- nity to be heard and present evidence; WHEREAS,the Planning Commission has slso reviewed this matter on March 27,May 8,May 22,and June 12,1984,and has recommended approval in Resolution P.C.No.84-17. _NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES ORDAIN 'AS FOLLOWS: / Section 1:The City Council has reviewed and considered the contents.of Bnvironmental Assessment No.450 Initisl Study and Negative Declaration in reaching its decision on Zone Change No.13 and finds that this zone change will not result in a significant environmental effect. Further,the City Council does hereby certify thst all of the requirements pursusnt to the California Environmental Quality Act and the City of Rancho Palos Verdes have been met. Section 2:The City Council has reviewed the adjacent land uses, densities and the potential impacts on the area and has found that the proposed land uses are consistent with what is existing on neighboring lots. Section 3:The City Council finds that the proposed zone change is consistent with the General Plan (Amendment No.14). Section 4:The City Council of the City of Rancho Palos Verdes hereby approves Zone Change No.13,and amends the official zoning on the East- view area as shown in "Exhibit A"attached. Section 5:The City Council hereby directs the City Clerk to cause said ·changes to be made to the Official Zoning Map. Section 6:The City Council hereby repeals Ordinance No.177U.
