RECOMMENDATION 1.Accept the work as complete. 2.Authorize the City Clerk to file a Notice of Completion with the L.A.County Registrar- Recorder Office and if no claims are filed within 35 days after recordation,and upon the contractor posting an acceptable warranty bond,notice the surety company to exonerate the Payment and Performance bonds. 3.Authorize the Director of Public Works to release the retention payment in the amount of $94,499.32 to Sully-Miller Contracting Company 35 days after recordation of the Notice of Completion by the L.A.County Recorder contingent upon no claims being filed on the project,and the contractor posting an acceptable warranty bond. BACKGROUND Every year,the City implements a residential street resurfacing project as part of its street improvement program.This project included rehabilitation of several residential streets in Area 4 and a portion of Area 8,which includes residential streets bordering Crenshaw Boulevard,Crest Road,Palos Verdes Drive East,and Miraleste Drive.All streets included in the resurfacing project are consistent with the City's Pavement Management Program. E-1 DISCUSSION The project's scope included residential roadway rehabilitation consisting of removal of failing asphalt concrete and base material and replacing it with full-depth asphalt concrete, cape seal resurfacing,slurry seal resurfacing,installation of ADA-compliant curb access ramps,removal and replacement of damaged sidewalk panels and curb and gutter, replacement of damaged or faded traffic signs,and replacement of existing striping and pavement markers. The contract retention amount is currently $131,204.32.Sully-Miller will be assessed $24,000 in liquidated damages due to delays in completion of the scheduled work.In addition,Sully Miller has agreed to credit the City $12,075 for potential repairs to several cul- de-sacs within the project limits.Although test results show that the cul-de-sacs are structurally stable,there are surface blemishes and spot repairs that staff plans to rework in the next pavement rehabiHtation project.The credit remaining,if any,after such repairs are made,will be returned to Sully-Miller.This credit signifies the City's willingness to close out the project but reserve the right to make future repairs as needed.Therefore,the final reduced retention amount after liquidated damages and credit is $94,499.32, which shall be returned to Sully-Miller upon successful conclusion of the Notice of Completion filing period. Table 1 provides a summary of project costs.
