RECOMMENDATION
Take no action,as the City Council required State inspection of the two temporary modular
buildings has occurred and proof of the structure's compliance with State code has been
submitted.
BACKGROUND
In April 2005,the Community Development Director approved a Special Use Permit (SUP)to
allow 2 temporary modular buildings to be used as temporary offices during the remodeling of
the Administration building.Although the construction of the Administration building was
completed in June 2007,Green Hills Memorial Park made multiple requests for continued use of
the two temporary modular buildings (see attached timeline for a more history).The most recent
request was denied by both the Community Development Director and Planning Commission,
but on May 17,2011 the City Council approved the applicant's appeal request,with conditions
specifying that the approval be for only 30 months and that the City and State inspect the two
temporary modular buildings within 6-months of the City Council's decision.On December 7,
2011,this 6-month deadline passed with only the City having conducted inspections of the two
temporary modular buildings.
On December 13,2011,the City notified the applicant that the Special Use Permit will be

deemed null and void due to non-compliance with the City Council adopted conditions of
approval (Resolution No.2011-33).Subsequently,on December 14,2011,the applicant
submitted a letter (attached)requesting an opportunity to be heard before the City Council on
the consideration of revocation of the permit.
On January 19,2012,Staff mailed notices of the public hearing to all properties within 500 feet
of Green Hills Memorial park and the notice was also published in the Palos Verdes Peninsula
News on January 19,2012.In response to the notice,no letters were received by Staff.On
February 2,2012,the State inspector conducted an inspection of the two temporary modular
buildings and documentation that the inspection resulted in no violations was submitted to the
City.
DiSCUssiON
As noted in the background section of the report,the City Council granted approval for
continued use of the two temporary modular buildings at Green Hills Memorial park contingent
that within 6-months of approval they be inspected by both the City and the State,as no
inspections had taken place for these structures since their installation in 2005.Specifically,the
Council wanted them to be inspected to ensure there were no significant adverse affects to the
public health,safety and welfare,and that the two temporary modular buildings continued to
comply with the requirements of the original Building Permit issued by the City,as well as
compliance with the State Code that governs such structures.
The City's inspection of these two structures did occur within the 6-month deadline,having
conducted an initial inspection on November 10,2011 and a SUbsequent inspection on
November 30,2011.However,upon the December 7,2011 deadline,no inspection by the State
had occurred.As such,a permit revocation hearing was scheduled.On February 2,2012,
documentation was submitted to City by the applicant verifying that the two temporary modular
buildings were inspected by the State and found·to be in compliance (attached).Staff believes
the intent of the City Council condition of approval has been met and there is no longer a need
to consider revocation of the Special Use Permit.
CONCLUSION
Based upon the submittal of documentation that the two temporary modular buildings comply
with State regulations,Staff recommends that the City Council take no action regarding the
approved Special Use Permit.
