BACKGROUND On June 1, 2010, the City Council adopted Resolution No. 2010-42, approving with Conditions of Approval, the Marymount Facilities Expansion Project (also known as the Campus Master Plan). During the processing of the planning applications for the Expansion Project, concerns were raised regarding student parking on neighboring streets, specifically PVDE and Crest Road. In order to address this concern, the project EIR suggested that the City Council consider, as a separate item from the project approval, establishing street parking restrictions in the immediate area of the Marymount to prevent the student overflow parking from impacting neighboring streets. Generally speaking, parking restrictions can typically be achieved by either red-curbing (this is not identified as an option because it is overly restrictive), posting restricted times, or implementing a permit parking program. 6-1 According to Condition No. 158, the University is required to implement Parking Management Strategies, on an annual basis, to the satisfaction of the Community Development Director and the Director of Public Works, to minimize street parking by students and visitors. · On October 4, 2011 and November 1, 2011, staff presented updates to the City Council regarding the parking conditions at the University, particularly on the implementation of the Parking Management Strategies. At the time, the City Council affirmed staff's approach at utilizing Condition No. 158 as a means to minimize street parking by students and visitors. At both meetings, several members of the public expressed strong opinions regarding the persistent parking problems on the public streets adjacent to Marymount. Additionally, the Council directed Staff to explore establishing some form of parking restrictions along the street to discourage student parking. In response, the University completed construction of a permanent parking lot which increased the on-campus parking from 343 spaces to 463 spaces, resulting in a total of 120 new parking spaces on site. The permanent parking lot was completed and in operation for the Fall 2013 academic year. Upon completion of the new parking lot, student parking on the public streets was significantly reduced until Marymount implemented an on-campus parking permit program and fee. The fee for the current academic year (2014/2015) is $150. During the first two weeks of a semester, the university offers a grace period whereby no citations are issued for unpermitted vehicles parked on campus. The grace period for this semester ended on Monday, September 15, 2014, and once again, the City observed a significant increase in student parking on the streets adjacent to Marymount (ranging between 30-40 cars). City Staff is currently working with Marymount to prevent students from parking on the street through the University's Code of Conduct. PVDE at Marymount University looking west towards Crest Road East 6-2 Notwithstanding, the impact of student parking on public streets continues to be the source of concern for many residents that live near the University. As a result, staff is recommending establishing street parking restrictions in the immediate area of the University to prevent the University's overflow parking from impacting neighboring streets as suggested in the Project EIR. DISCUSSION Palos Verdes Drive East (PVDE) is generally a narrow, north-south two-lane roadway that serves as a primary traffic artery for the Palos Verdes Peninsula. In the vicinity of Marymount University where it intersects Crest Road East, the roadway has two lanes in each direction with on-street parking on both sides of the roadway. The posted speed limit is 35 miles per hour in this area . On-street parking near Marymount University has been under observation since 2011. On many occasions, it has been recently observed that between 30-40 University-related vehicles have been parked on PVDE and Crest Road East between 9am and 4pm on a consistent basis, while several parking spaces on-campus remain unoccupied. Palos Verdes Drive East looking north towards Crest Road East Intersection Although public streets, both PVDE and Crest Road East have limited residential frontage that could be potentially impacted by the imposition of parking restrictions. The option for those residents would be to apply and petition for permit parking. Some of the safety issues that have been observed over the years include: students parking in prohibited zones (i.e. in front of or too close to fire hydrants and red curbed areas), vehicles partially blocking driveways and preventing the placement of refuge cans along the curbside, vehicles making unsafe turning movements and creating traffic hazards as well as students unsafely crossing at unsuspecting mid-block locations. 6-3 Staff has determined the best course of action is to restrict parking on both sides of PVDE from Casilina Drive to San Ramon Drive and Crest Road East from PVDE to 700' west during the hours of 9am to 4pm. Attachment A displays the parking restriction limits. The Traffic Safety Committee, at its September 26, 2011 meeting, discussed and concurred with staff's recommended course of action to implement parking restrictions along Palos Verdes Drive East and Crest Road east in the vicinity of Marymount University. Many of the nearby residents are in agreement with the recommended approach. There have been some concerns expressed by a resident that lives near San Ramon Drive that the parking restrictions may create adverse impacts to her since she has caregivers and service workers that utilize the parking on Palos Verdes Drive East. Since permit parking is currently in place and available to the residents of San Ramon Drive, the resident was reminded that service/maintenance workers displaying a vehicle decal can temporarily park on a street that has permit parking restrictions. If a resident of Palos Verdes Drive East or Crest Road East in the vicinity of the proposed parking restriction zone feels that the parking restrictions will create an adverse impact, permit parking is a viable option. The proposed parking restrictions along PVDE and Crest Road East are outlined in the attached Resolution No. 2014--- CONCLUSION In light of the continued presence of Marymount University students parking on public streets with the implementation of parking management strategies by the University, staff recommends the City Council establish parking restrictions on PVDE and Crest Road East, consistent with the suggested recommendation of the Marymount's Facilities Expansion Project EIR. FISCAL IMPACT Adopting staff's recommendation will not result in an impact to the FY 2014-2015 budget. We are continuing our efforts to advise students to get these permits and to park on campus. We have focused our education and enforcement efforts on those students and expect to see reductions in on-street parking soon. Jim To better understand his response, Marymount is currently charging a parking permit fee of $150 per year for student parking. The grace period to purchase a parking permit ended on Friday. So students who did not purchase a permit started parking on the street yesterday. Pursuant to the 14-15 Parking Management Strategies, Staff has asked Marymount to increase its security presence at the entrance driveway to direct students to on-campus parking. Additionally, Staff is asking Marymount to uphold its Student Code of Conduct by issuing fines to the students who chose to park on the street (PVDE and Crest Rd) rather than purchasing a parking permit or using the shuttle service. It is Staff's opinion that if the penalty for disobeying the Student Code of Conduct exceeds the parking permit fee, students will be more inclined to purchase the permit or seek alternative transportation to the campus. Mr. Reeves is working on increasing security presence and Staff will continue monitoring the street parking over the next two weeks. If the street parking situation doesn't improve, Staff will revisit the Parking Management Strategies to identify added measures to address this latest issue (such as significantly reducing or eliminating the parking fee). I should note that according to Diane Smith, there were ample parking spaces available on-campus yesterday. In addition to the above, it is my understanding that Public Works will be taking an item to the City Council on September 3Qth to establish parking restrictions along PVDE adjacent to and near Marymount. The parking restrictions will likely be times rather than complete prohibition (red curb) to allow the adjacent property owners the ability to use street parking during non-peak school hours (evenings, weekends, holidays, etc.). However, I am continually amazed by the disdain with which Marymount treats RPV City Council, Staff and taxpayers. This isn't a new problem, should not be treated as such, and should have been resolved by the school the week after the initial parking lot was constructed. Jim Reeves' response is an insult to the residents who have followed the issue for years, to the City Council and to Staff. I hate to think of the hours and hours of Staff time wasted on this. WHEREAS, Palos Verdes Drive East, a public roadway from Casilina Drive to Crest Road East and Crest Road East, a public roadway from Palos Verdes Drive East to 700' west, has experienced parking-related impacts due to student related parking pertaining to Marymount California University ("University"); and WHEREAS, the residents in the surrounding neighborhoods have requested the City to prohibit student parking on Palos Verdes Drive East and Crest Road East to address the public safety issues associated with student parking; and WHEREAS, the establishment of a "No Parking 9 A.M. to 4 P.M., Monday through Friday" restriction by erecting signs on both sides of Palos Verdes Drive East from Casilina Drive to San Ramon Drive and on both sides of Crest Road East from Palos Verdes Drive East to 700 feet west, will reduce traffic hazards created by nonresident vehicular parking on both sides of Palos Verdes Drive East and on Crest Road East, and is necessary to provide safe and efficient ingress and egress for the benefit of residents and their guests; NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: 1759304v1 6-16 Section 1. Required Findings. The City Council finds that the establishment of a "No Parking 9 AM. to 4 P.M. ,Monday through Friday," restriction by erecting signs on both sides of Palos Verdes Drive East from Casilina Drive to San Ramon Drive and on both sides of Crest Road East from Palos Verdes Drive East to 700 feet west , is necessary to reduce traffic hazards created by nonresident vehicular parking. For these reasons, the City Council finds that the establishment of these parking restrictions for the portion of the streets listed in Section 2 of this Resolution is necessary to avoid the adverse impacts upon residents and their guests caused by cars associated with the University being parked on nearby streets. Section 2. Designation of Restricted Parking Area. Based upon the findings in Section 1, the following areas are hereby designated with the following parking restriction: "No Parking 9 AM. to 4 P.M., Monday through Friday,": Palos Verdes Drive East (both sides from Casilina Drive to San Ramon Drive) Crest Road East (both sides from Palos Verdes Drive East to 700 ' west). Section 3. Designation of Parking Restrictions . Pursuant to Section 22507 and paragraph (n) of Section 22651 of the Vehicle Code, the parking restriction on the portion of the streets listed in Section 2 above shall be as follows: Signs stating: "No Parking 9 AM. to 4 P.M ., Monday through Friday," shall be posted along both sides of Palos Verdes Drive East from Casilina Drive to San Ramon Drive and both sides of Crest Road East from Palos Verdes Drive East to 700 ' west. Section 4. Posting of Signs. The parking prohibitions contained in Section 3 of this Resolution shall not become effective until signs have been posted giving adequate notice of the parking restrictions imposed by this resolution . The Director of Public Works is hereby authorized to erect such signs. Section 5. The City Clerk shall certify to the passage and adoption of this Resolution .
