RECOMMENDATION:
Adopt Resolution No. 2013-, a Resolution of the City Council of the City of Rancho
Palos Verdes revising the Salary and Hourly Schedule for the Competitive,
Management and Part-Time Positions, by adding the City Manager position to
aforementioned Schedule, and rescinding Resolution No. 2011-82 (Exhibit A).
DISCUSSION:
On October 4, 2011, the City Council approved the adoption of Resolution No. 2011-82,
which set forth the salary ranges for Competitive, Management and Part-time positions
for the City of Rancho Palos Verdes (Exhibit C).
Staff attended an educational symposium by the Law Firm of Liebert Cassidy Whitmore
regarding CalPERS in November 2013. From that, Staff determined that the City's pay
schedule was not compliant with Cal. Code Regs., tit. 2, § 570.5, "Requirement for a
Publicly Available Pay Schedule" (Exhibit 8). Under§ 570.5(a)(2), the City's pay
schedule should identify the position title for every employee position and under§
570.5(a)(3), it should show the pay rate for each identified position, which may be
stated as a single amount or as multiple amounts within a range. The City Manager
position was not included in Resolution No. 2011-82, and the proposed Resolution No.
2013-includes the position of City Manager and sets the salary to what the City
Council adopted under the "Fourth Amended and Restated Employment Agreement
Between the City of Rancho Palos Verdes and Carolyn R. Lehr". This amendment
became effective as of September 23, 2011.

In 2011, CalPERS implemented regulations setting forth the requirements of "pay
schedule" that must be met in order for a member's pay rate to be credited by
CalPERS. The pay rate shall be limited to the amounts listed on a pay schedule that
meets all of the requirements listed in CCR § 570.5. Whenever an employer fails to
meet the requirements for a "publicly available pay schedule" as set forth by CCR §
570.5, CalPERS may, at its discretion, determine a member's pay rate based on
consideration of various types of other information. By adopting this Resolution the City
will be in compliance with CalPERS Regulations.
ADDITIONAL INFORMATION:
Staff would like to reiterate to the Council that other than adding the City Manager
position ·and the City Manager's pay rate, in no other manner has the Salary and Hourly
Schedule for Competitive, Management and Part-Time Positions been adjusted from
the resolution adopted by the City Council in October 2011.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES REVISING THE SALARY AND HOURLY SCHEDULE
FOR THE COMPETITIVE, MANAGEMENT AND PART-TIME
POSITIONS, BY ADDING THE CITY MANAGER POSITION TO
AFOREMENTIONED SCHEDULE, AND RESCINDING RESOLUTION
NO. 2011-82.
WHEREAS, on October 4, 2011 the City Council adopted Resolution No.
2011-082 revising salary and hourly ranges for all competitive, management and
part-time employee job classifications; and,
WHEREAS, California Code of Regulations, Title 2, § 570.5 requires the
City to adopt a publicly available pay schedule that identifies the position title and
pay rate for every employee position.
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS
FOLLOWS:
Section 1: The salary and hourly ranges for City job classifications are
adopted as outlined in the attached Exhibit "A", and are effective December 3,
2013.
Section 2: Resolution No. 2011-82 is hereby rescinded and replaced by
this resolution.
PASSED, APPROVED and ADOPTED this 3rd day of December 2013.

§ 570.5. Requirement for a Publicly Available Pay Schedule.
(a) For purposes of determining the amount of "compensation earnable" pursuant to
Government Code Sections 20630, 20636, and 20636.1, payrate shall be limited to
the amount listed on a pay schedule that meets all of the following requirements:
(1) Has been duly approved and adopted by the employer's governing body
in accordance with requirements of applicable public meetings laws;
(2) Identifies the position title for every employee position;
(3) Shows the payrate for each identified position, which may be stated as a
single amount or as multiple amounts within a range;
(4) Indicates the time base, including, but not limited to, whether the time
base is hourly, daily, bi-weekly, monthly, bi-monthly, or annually;
(5) Is posted at the office of the employer or immediately accessible and
available for public review from the employer during normal business hours or
posted on the employer's internet website;
(6) Indicates an effective date and date of any revisions;
(7) Is retained by the employer and available for public inspection for not less
than five years; and
(8) Does not reference another document in lieu of disclosing the payrate.
(b) Whenever an employer fails to meet the requirements of subdivision (a) above,
the Board, in its sole discretion, may determine an amount that will be considered to
be payrate, taking into consideration all information it deems relevant including, but
not limited to, the following:
(1) Documents approved by the employer's governing body in accordance
with requirements of public meetings laws and maintained by the employer;
(2) Last payrate listed on a pay schedule that conforms to the requirements
of subdivision (a) with the same employer for the position at issue;
(3) Last payrate for the member that is listed on a pay schedule that
conforms with the requirements of subdivision (a) with the same employer for
a different position;
(4) Last payrate for the member in a position that was held by the member
and that is listed on a pay schedule that conforms with the requirements of
subdivision (a) of a former CalPERS employer.
