RECOMMENDATION
Authorize the City Manager to accept the donation of a vacant property in the Cherry
Hill Lane area (Assessor's Parcel No. 7572-004-002), subject to the verification of
acceptable title and condition of the property; and adopt Resolution No. 2013-_, a
resolution of the City Council of the City of Rancho Palos Verdes, amending Resolution
No. 2013-43, the Budget Appropriation for FY 2013-14, to pay for the cost of the current
property taxes and "due diligence" review for the vacant property to be donated to the
City from the City's General Fund.
BACKGROUND
On October 15, 2013, Maureen Werner offered to donate her property in the Cherry Hill
Lane area in the Portuguese Bend community to the City, contingent upon the City's
payment of the current property taxes. On November 6, 2013, and earlier this evening,
the City Council considered this offer in closed session. Assuming that the City Council
accepts Ms. Werner's offer and directs Staff to pursue the acquisition of her property, it
will also be desirable for the City to complete certain "due diligence" review of the
property. At the November 5th meeting, the City Council authorized Staff to proceed
with the "due diligence" review for this property. Staff is now proposing a budget
adjustment to cover the cost of the current property taxes and the "due diligence" review
to accept the donation of this property.
DISCUSSION
The City and the Successor Agency currently own a total of twelve (12) parcels in the
vicinity of Cherry Hill Lane in the active Portuguese Bend landslide area. Ms. Werner's

property directly abuts one of the City-owned parcels, and is close to several other
parcels owned by the City or the Successor Agency. Staff believes that accepting the
donation of Ms. Werner's property would enhance the City's access to Portuguese
Canyon for landslide abatement and roadway maintenance purposes. This would be
consistent with the direction that the City Council recently provided to Staff in
authorizing the acquisition of two (2) other nearby tax-defaulted parcels on August 6,
2013.
Ms. Werner has offered to donate her property to the City, contingent upon the City
paying the current property taxes due (estimated at $600). If the City were to accept
this donation, it would be Staff's intent to ensure that the property is free of any
encumbrances to its title and is not affected by any recognized environmental conditions
(i.e., hazards). Therefore, Staff recommends preparing a Preliminary Title Report and
completing a Phase 1 Environmental Site Assessment of the property as a part of the
City's "due diligence" review prior to accepting the donation. The estimated cost of the
title report would be $2,500 and the estimated cost of the Phase 1 study would be
$5,000. Since these expenditures were not included in the FY 2013-14 budget, Staff
has prepared the attached resolution approving a budget adjustment in the amount of
$8,100.
ADDITIONAL INFORMATION
Contingent upon the City Council's decision tonight, the Planning Commission is
scheduled to consider the consistency of accepting the donation Ms. Werner's property
with the City's General Plan on December 10, 2013.
CONCLUSION
In conclusion, Staff recommends that the City Council authorize the City Manager to
accept the donation of Ms. Werner's vacant property in the Cherry Hill Lane area
(APN 7572-004-002); and approve a budget adjustment to pay for the cost of the
current property taxes and "due diligence" review for the vacant property to be donated
to the City from the City's General Fund.
ALTERNATIVES
If the City Council decides not to accept Ms. Werner's offer of donation, the.re is no need
to take action on this item, other than to receive and file.
FISCAL IMPACT
The recommended action will result in a City expenditure of $8, 100. Since this
expenditure is not budgeted in the City's current FY 2013-14 budget, a budget
adjustment is necessary. The proposed budget adjustment would allocate $8, 100 from
the City's General Fund to the Land account within the City Manager's budget. Prior to
this adjustment, the estimated June 30, 2014, General Fund balance is $9,859, 180,
which is $11,971 over the Reserve Policy threshold. The City Attorney's Office will draft G-2

the deed and other documents needed to effectuate the transfer of the property to the
City, the cost of which will be borne under the current FY 2013-14 City Attorney's
budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES, AMENDING RESOLUTION NO. 2013-43, THE BUDGET APPROPRIA-
TION FOR FISCAL YEAR 2013-14, FOR A BUDGET ADJUSTMENT TO THE
CITY'S GENERAL FUND.
WHEREAS, Section 3.32 of the Rancho Palos Verdes Municipal Code provides that all
expenditures in excess of budgeted allocations must be by supplemental appropriation of the City
Council; and,
WHEREAS, on June 18, 2013, the City Council of the City of Rancho Palos Verdes adopted
Resolution No. 2013-43, approving a spending plan and authorizing a budget appropriation for the
2013-2014 fiscal year; and,
WHEREAS, the City Council has directed Staff to accept the donation of a vacant property in
the Cherry Hill Lane area (Assessor's Parcel No. 7572-004-002), which requires the City pay the
current property taxes and to prepare a Phase 1 Environmental Site Assessment and a Preliminary
Title Report for the property as a part of its "due diligence" review prior to acceptance; and,
WHEREAS, a budget increase in the City Manager Program of the General Fund is
necessary to pay for the cost of the property taxes and "due diligence" review.
NOW BE IT, THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES:
