BOARD (WCB) FOR FUNDS RELATED TO THE PURCHASE OF
REAL PROPERTY IN MALAGA CANYON FOR THE PURPOSE OF
OPEN SPACE CONSERVATION

RECOMMENDATION
Adopt City Council Resolutions No. 2013-_ and No. 2013-_, authorizing the execution of
grant agreements between the City and the Wildlife Conservation Board (WCB) and
agreeing to all of the agreement's terms and conditions related to WCB's grants totaling
$1, 114,500 for the acquisition of approximately 58 acres of real property in Malaga
Canyon.
BACKGROUND
In late 2011, the U.S. Fish and Wildlife Service (USFWS) notified the City and the Palos
Verdes Peninsula Land Conservancy (PVPLC) about the availability of grant monies for the
acquisition of open space on the Palos Verdes Peninsula. The USFWS noted their desire
to use said funds to preserve additional habitat on the Palos Verdes Peninsula to augment
the City's NCCP Preserve. Thus, working with the USFWS and the State Wildlife
Conservation Board (WCB), City and PVPLC staff identified a number of privately owned
open space properties in the City that contain protected habitat for possible acquisition.
After following up with the owners of all the identified properties, two willing sellers
emerged. Specifically, Dr. Roger Giani (Angeles, LLC) agreed to sell 41.63 acres to the
City for $659,500, and Ya Yi May agreed to sell 16.25 acres to the City for $455,000.
On October 1, 2013, the City Council approved the purchase agreements with the two
willing sellers. On October 29, 2013, the City Council approved a revised purchase
agreement with Dr. Giani.

DISCUSSION
On November 21, 2013, the California Wildlife Conservation Board (WCB) is scheduled to
allocate two WCB grants and accept and sub-grant two USFWS Habitat Conservation
Planning Acquisition grants to the City of Rancho Palos Verdes to acquire the properties
. described above (see attached Notice ofWCB Meeting and Agenda). In orderforWCB to
disburse the funds, the attached Resolutions must be adopted by the City Council, one for
each transactions. Staff and the City Attorney have reviewed the Resolutions and believe
that all the findings can be made. Therefore, Staff is recommending that the City Council
adopt the attached Resolutions which authorize execution of the grant agreement by the
Mayor.

WILDLIFE SERVICE AND AUTHORIZING THE ACQUISITION OF ALL OR A PORTION

006, TOTALING APPROXIMATELY 41.63 ACRES, IN THE CITY OF RANCHO PALOS
VERDES, LOS ANGELES COUNTY, CALIFORNIA.
WHEREAS, Malaga Canyon consists of undeveloped open space in the northern part of
the City of Rancho Palos Verdes ("City") within the Grandview neighborhood. The Canyon runs
primarily in a North-South direction crossing under Montemalaga Drive and flowing into the
City of Palos Verdes Estates; and
WHEREAS, In August 2004, the City Council adopted the Rancho Palos Verdes Natural
Communities Conservation Plan ("NCCP"), which proposed the establishment of a habitat
preserve by the City in exchange for allowing 50 years' worth of City projects (and certain
private projects) that will impact protected habitat in the City on an as needed basis. Since that
time, through the dedication of unimproved properties owned by the City and the Palos Verdes
Peninsula Land Conservancy, along with major open space land acquisitions in 2005 and 2009,
the creation of a 1400-acre NCCP Preserve was completed; and
WHEREAS, coastal sage scrub habitat, which provides habitat for threatened species that
reside on the Palos Verdes Peninsula is located within Malaga Canyon; and
WHEREAS, Angeles, LLC, the owner of the property that is described in Exhibit "A"
hereto, is willing to sell said property to the City so that additional habitat and open space can be
provided;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES HEREBY FINDS, ORDERS AND RESOLVES AS FOLLOWS:
1. The acquisition of the parcels that are described and depicted in Exhibit "A"
hereto ("Identified Property) for the preservation of habitat and open space is
exempt from the provisions of the California Environmental Quality Act;
2. The Identified Property possesses high ecological and habitat value and will
provide habitat for threatened or endangered species that inhabit the Palos Verdes
Peninsula;
3. The use of the grant funds referenced herein for acquisition of the Identified
Property is an appropriate expenditure;
4. The staff reports and recommendations therein that have been prepared regarding
this item are hereby adopted and incorporated herein by this reference;

5. The Mayor of the City is hereby authorized to execute the California Wildlife
Conservation Board Grant Agreements for Acquisition of Fee Interest and the
City Manager is hereby authorized to accept the grant funds from the listed
agencies for the purpose of acquisition of the Identified Property;
6. The City Manager is hereby authorized to accept fee title to the identified
property on behalf of the City; and
7. The City Manager is hereby authorized to do any and all acts necessary to carry
out this resolution and any recommendations made by the City Council.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES
AUTHORIZING THE CITY TO ENTER INTO A GRANT AGREEMENT WITH THE
CALIFORNIA WILDLIFE CONSERVATION BOARD TO ACCEPT A GRANT FROM THE
STATE OF CALIFORNIA AND A SUB-GRANT FROM THE UNITED STATES FISH AND
WILDLIFE SERVICE AND AUTHORIZING THE ACQUISITION OF ASSESSOR'S
'PARCEL NUMBER(S) APN: 7578-003-004 & 7578-003-007, TOTALING
APPROXIMATELY 16.25 ACRES, IN THE CITY OF RANCHO PALOS VERDES, LOS
ANGELES COUNTY, CALIFORNIA.
WHEREAS, Malaga Canyon consists of undeveloped open space in the northern part of
the City of Rancho Palos Verdes ("City") within the Grandview neighborhood. The Canyon runs
primarily in a North-South direction crossing under Montemalaga Drive and flowing into the
City of Palos Verdes Estates; and
WHEREAS, In August 2004, the City Council adopted the Rancho Palos Verdes Natural
Communities Conservation Plan ("NCCP"), which proposed the establishment of a habitat
preserve by the City in exchange for allowing 50 years' worth of City projects (and certain
private projects) that will impact protected habitat in the City on an as needed basis. Since that
time, through the dedication of unimproved properties owned by the City and the Palos Verdes
Peninsula Land Conservancy, along with major open space land acquisitions in 2005 and 2009,
the creation of a 1400-acre NCCP Preserve was completed; and
WHEREAS, coastal sage scrub habitat, which provides habitat for threatened species that
reside on the Palos Verdes Peninsula is located within Malaga Canyon; and
WHEREAS, Ya Yi May, the owner of the property that is described in Exhibit "A"
hereto, is willing to sell said property to the City so that additional habitat and open space can be
provided;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES HEREBY FINDS, ORDERS AND RESOLVES AS FOLLOWS:
1. The acquisition of Assessor's Parcel Numbers APN: 7578-003-004 & 7578-003-
007, which are more particularly described in Exhibit "A" hereto ("Identified
Property) for the preservation of habitat and open space is exempt from the
provisions of the California Environmental Quality Act;
2. The Identified Property possesses high ecological and habitat value and will
provide habitat for threatened or endangered species that inhabit the Palos Verdes
Peninsula;
3. The use of the grant funds referenced herein for acquisition of the Identified
Property is an appropriate expenditure;
4. The staff reports and recommendations therein that have been prepared regarding
this item are hereby adopted and incorporated herein by this reference;

5. The Mayor of the City is hereby authorized to execute the California Wildlife
Conservation Board Grant Agreements for Acquisition of Fee Interest and the
acceptance of grant funds from the listed agencies for the purpose of acquisition
of the Identified Property;
6. The City Manager is hereby authorized to accept fee title to the identified
property on behalf of the City; and
7. The City Manager is hereby authorized to do any and all acts necessary to carry
out this resolution and any recommendations made by the City Council.

The California Department of Fish and Wildlife (CDFW), through the Wildlif&,Conservation
Board (WCB), is involved in a land acquisition program that is focused on the long-range
protection and enhancement of habitat for fish and wildlife. Possible sites for acquisition are
identified by the CDFW in response to public interest, legislative mandate and departmental
goals.
This letter is to advise you that the WCB will consider the allocation of a grant to the City of
Rancho Palos Verdes to assist in its acquisition of 58± acres of land for the preservation
and enhancement of wildlife habitat located in the City of Rancho Palos Verdes and
identified as Assessor's Parcel Nos. 7546-022-008, 7578-002-009/010, 7578-003-001/006,
7578-003-004 and 007. This proposal is scheduled for the November 21, 2013, Board
meeting. A copy of the preliminary agenda is enclosed for your review. A full agenda will

To consider the allocation for a grant to the Pacific Coast Fish, Wildlife
and Wetlands Restoration Association for a cooperative project with the
Redwood National Park and the Fisheries Restoration Grant Program to
restore approximately 1,600 linear feet of Strawberry Creek for
anadromous salmonids including coho salmon and steelhead trout,
located one mile west of the City of Orick in Humboldt County. The
purposes of this project are consistent with the authorized uses of the
proposed funding source, which allows for the acquisition, restoration or
enhancement of riparian habitat and aquatic habitat for salmonids and

Wildlife and the acceptance of a U.S. Fish and Wildlife Service Recovery
Land Acquisition grant to acquire 8Q* acres of land for the protection of,
wetland and upland habitat areas and linkages supporting the State and
federally-listed endangered Amargosa vole and the Amargosa niterwort,
located just north of the community of Tecopa Hot Springs, in Inyo County.
The purposes of this project are consistent with the proposed funding
source that allows.for the acquisition and protection of habitat to protect
rare and endangered species, wildlife corridors and significant natural

opportunities, located near the City of Earlimart, west of State Route 99, in
Tulare County. The purposes of this project are consistent with the

Isabella, in Kern County. The purposes of this project are consistent with
the authorized uses of the proposed funding source, which allows for the
acquisition of habitat to protect deer and mountain lions and the
preservation or enhancement of wildlife values to protect or enhance

Control Board for a project to remove three instream barriers to steelhead
trout, providing access to 4.5± miles of good quality habitat on Arroyo Sequit
Creek, located west of the City of Malibu in the Leo Carillo State Park in Los
Angeles County. The purposes of this project are consistent with the
authorized uses of the proposed funding source, which allows for the
acquisition, protection and restoration of coastal watersheds and adjacent

To consider the allocation for a grant to the East Contra Costa County
Habitat Conservancy (ECCCHC) and the acceptance of two U.S. Fish and
Wildlife Service Habitat Conservation Planning Acquisition grants and the
approval to subgrant these federal funds to the ECCCHC for a cooperative
project with the East Bay Regional Park District to acquire 1,885± acres of
land for the protection and preservation of existing regional wildlife
linkages, including grassland and oak woodland savannah habitat areas
within the East Contra Costa County Natural Community Conservation
Plan/Habitat Conservation Plan, located in the Diablo Mountain Range,
above the City of Antioch in Contra Costa County. The purposes of this
project are consistent with the proposed funding source that allows for the
acquisition and protection of habitat for areas in and around the
Sacramento-San Joaquin Delta that assist in the establishment of Natural

west side of Friant Road in Fresno County. The purposes of this project ~)>

which allows for implementation of river parkway projects identified by the

To consider the allocation for a grant to the Regents of the University of
California to construct a new administrative building and housing for
visiting researchers, renovate a staff residence and laboratory, expand
wireless network infrastructure and improve the water system at the
Granite Mountain Desert Research Center; located 16± miles south of
Kelso in San Bernardino County. The purposes of this project are
consistent with the proposed funding source that allows for the
construction and development of facilities that will be used for research
and training to improve the management of natural lands and the

watershed, supporting numerous migratory birds and threatened and
endangered species, located along the Pacific Flyway migratory bird
corridor in the southern end of the San Joaquin Valley, south of the City of
Wasco in Kern County. The purposes of this project are consistent with
the authorized uses of the proposed funding source, which allows for the
acquisition and protection of hclbitat containing natural communities and
for the protection of rare, endangered, threatened, or fully protected

properties, 16± acres and 42± acres in size, for the protection and
preservation of existing regional wildlife linkages and species located
within the Ocean Trails Habitat Conservation Plan and the pending
Natural Community Conservation Plan (NCCP) areas. The purposes of

the acquisition and protection of habitat to help implement or assist in the

of wetlands at CDFW's Imperial Wildlife Area, Wister Unit, located six
miles northwest of Niland in Imperial County. The purposes of this project
are consistent with the authorized uses of the proposed funding source,
which allows for the acquisition, enhancement or restoration of wetlands

7 22. Tijuana River Valley Mesa Trails
San Diego County

To consider the allocation for a grant to the San Diego County Department
of Parks and Recreation for a project to construct and rehabilitate trails,
provide signs and trailhead facilities and restore 15± acres of coastal sage
habitat on the south side of the Tijuana River Estuary, located three air
miles south of Imperial Beach in San Diego County. The purposes of this
project are consistent with the authorized uses of the proposed funding
sources, which allow for the development of public access facilities for
hunting, fishing and other wildlife compatible recreational activities
[Wildlife Restoration Fund, Local Assistance]; and the acquisition,
protection and restoration of coastal wetlands identified in the Southern
California Coastal Wetlands Inventory, located within the coastal zone,
other wetlands connected and proximate to such coastal wetlands and
