MEMORANDUM TO: FROM: DATE: HONORABLE MAYOR & MEMBERS~F CITY COUNCIL JOEL ROJAS, COMMUNITY DEVELOP DIRECTOR SEPTEMBER 3, 2013 SUBJECT: ABALONE COVE SHORELINE PARK-STATUS UPDATE ON THE PROJECT PLAN RELATED TO THE LAND AND WATER CONSERVATION FUND GRANT AWARD (SUPPORTS 2013 CITY COUNCIL GOALS -INCREASE CITIZEN INVOLVEMENT) REVIEWED BY: CAROLYN LEHR, CITY MANAGER uQ_ Project Manager: Ara Mihranian, Deputy Director of Community Development ~ RECOMMENDATION Receive and file a status update on the final project plan for the Abalone Cove Shoreline Park Improvement Project pursuant to a Land and Water Conservation Fund (LWCF) State grant previously awarded to the City. BACKGROUND On November 1, 2010, pursuant to Council authorization, the City filed a Land and Water Conservation Fund (LWCF) grant application with the California State Parks and Recreation Department for improvements at Abalone Cove Shoreline Park. On December 7, 2011, State Parks notified the City that it is the recipient of the LWCF grant (50% reimbursement grant), in the amount of $332,588, for the Abalone Cove Park Improvement Project (the total cost for the Project is estimated at $665, 176). The conceptual project plan for which the grant was awarded to the City was developed using a Focus Group made up of the following community stakeholders: neighbors of Abalone Cove; representatives of the former PUMP Committee; City Council; Los Serenos de Point Vicente; PVPLC; Library District; School District; Terranea; Park Rangers; and staff from the Community Development and Recreation & Parks Departments. Once the grant was awarded, the same Focus Group was engaged to assist the City and Melendrez 3-1 ABALONE COVE SHORELINE PARK-STATUS UPDATE TO THE LWCF GRANT SEPTEMBER 3, 2013 (the project's landscape architect) in finalizing the project plan . At the April 2, 2013 City Council meeting, Staff provided a status update on the project plan being developed for the Abalone Cove Shoreline Park Improvement Project pursuant to the LWCF grant awarded to the City. The project plan presented to the Council at the April 2nd meeting was approximately 50% complete and Staff indicated that the Focus Group would continue to meet until the final details of the plan were completed. Subsequently, the Focus Group continued to provide input on various design aspects of the project, such as trail routes, park furnishings (benches and picnic tables), trash bins, shade structure, trailhead features, outdoor classroom, exploration play area, etc. Based on their input, the construction plan (85% complete) was reviewed and accepted by the Focus Group at its August 1 ih meeting. This evening, Staff is providing the Council and the public with the updated project plan (85% complete) before initiating the construction bid process with construction anticipated to occur in early 2014. DISCUSSION The attached project plan represents a design that has been vetted by the Focus Group, City Council and members of public (see attachment). The City's website has also been updated throughout the design process to include the presentations given at each of the focus group meetings so that the public can follow and provide input on the design process. The Project Plan proposes to: • Improve trailheads and trails (including ADA-compliant trails); • Construct an exploration play area; • Replace picnic tables and benches; • Improve picnic areas; • Install park benches; • Install new native plants and irrigation lines; • Install three replacement trees (California Oak); • Construct an outdoor classroom with shade structure; • Replace trash receptacles; • Install mutt mitt dispensers; • Install two ADA-compliant binoculars along the bluff top trail; • Replace bluff top fencing; • Install interpretive signs; and, • Improve viewing areas. The Focus Group was asked to participate (voting via email) in the selection process of the various furnishings described above, such as selecting the style, material, and finish forthe park benches, picnic tables, trash receptacles, and shade structure to name a few. The selected furnishings are described in the specifications of the construction plans and images are attached for the Council's review (see attachment). Staff will show the Council the selected color and material swatches at the Council meeting. Staff believes that the 3-2 ABALONE COVE SHORELINE PARK -STATUS UPDATE TO THE LWCF GRANT SEPTEMBER 3, 2013 furnishings selected for this project are of high quality and natural materials suitable for the City's coastline. In fact, Staff anticipates phasing in similar furnishings along the public trails and at parks located along the City's coastline in the future to achieve a uniform appearance. The attached Plan is identified as 85% complete not because of an incomplete design, but because of pending construction specifications from the project's design team. Additionally, at the request of Councilman Knight at the August 1 ih Focus Group meeting, Staff consulted with the City Geologist to ensure that the proposed irrigation and drainage will not adversely impact the existing landslide. In response to comments from the City's Geologist, the Project plans have been updated by replacing the drainage pits with drainage pipes located below the trail surface that naturally convey sheet flow across the surface of the property (but not over the trail surfaces). This change minimizes drainage flows percolating into the ground within the landslide area. Once constructed, these park improvements will significantly improve access and the educational experience at the park while maintaining the overarching objective of preserving the natural setting of the site by utilizing a "light touch" with the proposed features. Moreover, these park improvements are consistent with the General Plan Land Use Map designation of Recreation-Passive and the Open Space Recreation (OR) zoning designation. ADDITIONAL INFORMATION Construction Budget As previously reported, the LWCF grant (50% reimbursement grant) awarded to the City is in the amount of $332,588 for a total Project cost of $665, 176 (including designer and consultant fees). In accepting the terms of the grant, on February 21, 2012, the Council funded the City's matching share of $332,588. Throughout the design process, costs associated with the proposed improvements were considered as various improvements were selected. With the design finalized, in order to foresee the probable construction cost of the project prior to going to bid, the City requested that Melendrez provide an estimated construction cost based on industry standards (see attached estimated cost table). According to the attached Project plan and the amenities described herein, the cost of the project is estimated to be over budget by approximately $200,000 (including $56,530 for designer fees and $3, 125 for surveying consultant fees not listed in the attached table). It is important to note that this budget shortfall is based on projected costs estimated by Melendrez with an understanding that actual construction bid costs may be less or more depending on the bids submitted to the City. Once construction bids are received, Staff will know for certain whether this is a budget shortfall. If there is a budget shortfall, Staff will either reduce the scope of work, request a budget adjustment to absorb the added construction costs, or a combination of both 3-3 ABALONE COVE SHORELINE PARK -STATUS UPDATE TO THE LWCF GRANT SEPTEMBER 3, 2013 depending on the amount of the actual shortfall. LWCF Grant Time Limits According to the terms of the LWCF grant, this project is required to be completed by June 30, 2014 (unless a time extension is granted by State Parks). Due to this deadline, the City is operating under an aggressive schedule. After tonight's meeting, the construction bid process will be initiated. Actual construction is anticipated to begin early next year and should take approximately 5 months to complete. If all goes according to schedule without any major delays, the project is expected to be completed in advance of the grant deadline. Memorandum of Unrecorded Grant Agreement The award of the recent LWCF grant requires that a Memorandum of Unrecorded Grant Agreement (MOUGA) be executed and recorded against the Property. By so doing, notice of the grant agreement and its restrictions will be provided. The MOUGA refers to the Grant Agreement, which states that the property has restrictions for future improvements; that the property is to be maintained and operated for public outdoor recreational purposes as described in the Section 6(f)(3) map, and that the property cannot be sold or transferred without written approval from the State of California. Any future contemplated improvements or modifications are subject to approval by the State of California. This restriction will encumber the entire property, including the portions that are proposed to be within the City's Palos Verdes Nature Preserve (which will also be subject to deed restrictions from conservation easements). Since the subject property is owned by the Successor Agency, on August 6 , 2013, the matter related to the MOU GA was considered by the Successor Agency. At that time, the Board of Directors of the Successor Agency approved the Agreement and the Deed Restrictions that are associated with the Land and Water Conservation Fund grant and authorized the MOUGA be recorded against the Park property. Because the document is to be recorded against the Park property, at the August 28th meeting, Staff also requested the Oversight Board to accept the terms of the Grant Contract and the associated Deed Restrictions, and to authorize the Memorandum of Unrecorded Grant Agreement be recorded against the Property. For the same reasons, Staff also intends to present these items for approval to the State Department of Finance. Abalone Cove Long Range Pro p erty Management Plan At the next meeting of the Successor Agency in September, Staff anticipates presenting the Long Range Property Management Plan to both the City Council and the Board of Directors of the Successor Agency, which will include a recommendation that the Abalone Cove Park Property be kept in governmental use. This means that the Park property would be transferred to the City so the City would be able to keep the Property and use it for park and open space purposes , which are consistent with the City's General Plan and purposes of the grants that were awarded to the County and the City. 3-4 ABALONE COVE SHORELINE PARK -STATUS UPDATE TO THE LWCF GRANT SEPTEMBER 3, 2013 CONCLUSION Based on the aforementioned discussion, Staff recommends that the City Council receive and file the status update report on the final project plan for the Abalone Cove Shoreline Park Improvement Project.
