RICHARDS AND SHERI E. RICHARDS, TRUSTEES OF THE RICHARDS REVOCABLE FAMILY TRUST TO ALLOW FOR THE PARTIAL FILLING AND MAINTENANCE OF SAN RAMON CANYON AS PART OF THE SAN RAMON CANYON PROJECT CAROLYN LEHR, CITY MANAGER cfJ__ Project Manager: Ron Dragoo, Senior Engin~ RECOMMENDATION Authorize the Mayor and City Clerk to execute an agreement with Jeffery J. Richards and Sheri E. Richards, Trustees of the Richards Revocable Family Trust for the Purchase of 0.4396 acres of land for the purpose of filling a portion of the San Ramon Canyon for the San Ramon Canyon Stormwater Flood Reduction Project. BACKGROUND/DISCUSSION The San Ramon Canyon Stormwater Flood Reduction Project design calls for the partial filling of the San Ramon canyon from the upstream inlet structure in the canyon to the downstream City Boundary for a distance of 1, 140-feet. Most of the canyon fill will occupy City owned land; however there is a small portion of the fill that will occupy private property owned by the Richards Revocable Family Trust. The City has been in negotiations to acquire a portion of the property, with Jeff Richards, one of the trustees of the Richards Revocable Family Trust, which owns the parcel of land at the end of Tarapaca Road, known as APN 7561-039-002 that extends into the Canyon. The majority of the Tarapaca Landslide is within this property. An area of less than 1,000 square feet is required for the fill. Due to the topography, a limited amount of maintenance is anticipated to be required to keep the rip-rap channel of the newly elevated canyon bottom clear. This will require an additional area resulting F-1 in the need to acquire a total area of 19, 150 square feet. Jeff Richards has agreed to sell to the City, a 35-foot wide strip of land along the entire length of the property adjacent to the canyon for the amount of $18,700. The Tarapaca landslide extends onto the property being acquired. Filling the canyon is expected to buttress the toe of the landslide; however it is important to note that the landslide is anticipated to continue to "weather" for some time until gravity and the effects of the weathering stabilize it. Pursuant to prior direction from the City Council, the City retained the Source Group to perform a Phase 1 environmental site assessment with respect to the property. The Source Group found as follows: "No recognized environmental conditions (REC's) were identified during the Phase I assessment". The MND that was prepared for the San Ramon Project already analyzed the environmental effects of the San Ramon Project, including the placement of the fill in the canyon and on the subject property. So, the City has complied with CEQA. The City has obtained a preliminary title report to verify the condition of the title to the Property. We will provide the agreement to the agreement to the City Council at the meeting Tuesday evening. CONCLUSIONS Adopting staff's recommendations will authorize the Mayor and City Clerk to execute the attached Agreement for the purchase of 0.4396 acres of land from Jeffery J. Richards and Sheri E. Richards, Trustees of the Richards Revocable Family Trust. FISCAL IMPACT Adopting staff's recommendation will incur a cost of $18,700 to the City of Rancho Palos Verdes. A mid-year budget adjustment resolution will include the purchase price and the cost to obtain the title report and Phase 1 assessment.
