Conduct the public hearing on the proposed levy of the annual sewer service charge for the Abalone Cove Sewer System for Fiscal Year 2013/14, which provides for a maximum increase of 2% in the fees collected. 2. Adopt Resolution No. 2013-, a Resolution of the City Council of the City of Rancho Palos Verdes approving a report in connection with the sewer service charge established pursuant to Chapter 13.06 of the Rancho Palos Verdes Municipal Code, determining the amount of such charge for Fiscal Year 2013/14, and ordering that such charge be collected on the tax roll. EXECUTIVE SUMMARY • The Abalone Cove Sewer Service Charge (Charge) has been in existence since July 2001. • Revenues collected through the Charge help pay for maintenance of the sewer system within the Abalone Cove Landslide Abatement District (ACLAD). The system is divided into four zones (subsystems) including 50 grinder pumps, four lift stations and thousands of feet of pressure and gravity flow pipes. • Since inception the total annual revenue from the Charge has ranged from $21,595 (FY 2001/02 and FY 2002/03) to the $49,370 which was collected in FY 2012/13 (see Attachment C, Operation & Maintenance, City Contribution & Total Charge). R6876-0001\1228581 v1 .doc 2-2 • The Charge for each parcel is determined pursuant to the specific subsystems used by each parcel. • At the inception of the Charge, the City established a policy of subsidizing the cost of maintenance of the system in an effort to reduce the charges to property owners and provide funding to adequately maintain the system. However, in 2010, the City Council directed staff to develop a procedure that would ultimately eliminate the taxpayer subsidy which is currently needed to maintain the sewer system infrastructure. The annual subsidy has ranged from a maximum of $35,000 in FY's 2001/02 and 2002/03 to $8, 190 in FY 2011/12 (see Attachment D, Parcel Charges by Zone). BACKGROUND To insure funding for the on-going operation and maintenance of the sewer facilities in the ACLAD area, the City Council established the Sewer Service Charge (Charge) on July 17, 2001. The Charge insures a fair and equitable levying of the necessary costs of operating and maintaining the facilities. The City Council annually reviews the current and projected costs for operating and maintaining the sewer facilities and sets rates for the ensuing fiscal year, which begins July 1 and ends June 30. In setting the annual rates, the City Council will consider any new or updated maintenance costs in the attached FY 2013/14 Engineer's Report (Attachment A, FY 2013/14 Engineer's Report), and any fund balances or shortages, and adjust the rates accordingly. The Charge is levied under the authority of the California Health and Safety Code Sections 5471 et seq. (the "Code"). Payment of the Charge for each parcel will be made in the same manner and at the same time as payments are made for property taxes for each property. To levy the Charge for fiscal year 2013-14, the City must hold a public hearing. An estimate of the total annual operating costs of the Abalone Cove Sewer System and the corresponding Charge required of each property is provided in Attachment A (FY 2013/14 Engineer's Report). The Charge for FY 2013/14 will be submitted to the County for collection through the tax rolls. To that end, the City Council annually adopts a resolution approving the report and ordering collection of the Charge on the tax rolls (Attachment 8, Resolution No. 2013 -__ ). ANALYSIS The estimated annual cost to operate and maintain the Abalone Cove Sewer System for FY 2013/14 is $96,380, which is higher than the actual amount for FY 2012/13. The increase represents increased maintenance requirements and funding a grinder pump maintenance plan to increase the reliability of the budgeted maintenance estimate for the low pressure grinder pumps. During the past year the maintenance requirements associated with the grinder pumps was excessive. Many of the pumps in service are 2-3 failing and need replacement. Staff is working out the details of a maintenance contract with the factory authorized repair facility to provide the maintenance required to all low pressure pumps operational. The negotiated cost of the service is $14, 700 and it will cover all of the low pressure pumps in the Abalone Cove System. Other additional maintenance work anticipated this year includes inspecting and cleaning all of the manholes in the system and video inspecting 17 ,000 feet of the sewer mainline. The historical Operation and Maintenance costs, City contributions (subsidy), and the charges for past fiscal years are shown in Attachment C (Operation & Maintenance, City Contribution & Total Charge). Through the budget process prior to the completion of the FY 2013/14 Engineer's Report (Report), the City budgeted funds to accommodate a subsidy of $10,700. The Report proposes a subsidy of $40,050 is needed. The Report groups parcels in the Abalone Cove Sewer Service area into various rate zones based on the specific combination of sewer subsystems used by each parcel. The proposed FY 2013/14 charge for a single-family parcel ranges from $163.92 to $718.57. The charges for all zones (A, B, C and D) are at the maximum allowable rates. A description of the various zones and their historic and proposed FY 2013/14 charges are shown in Attachment D (Parcel Charges by Zone). The proposed Charge varies by zone. The zones with the highest charges, Zones B and D, are the zones with the highest per parcel cost for maintenance. For the Abalone Cove Sewer System, the in-street pump stations historically have the highest per parcel costs to maintain and therefore these properties have had the highest charges and subsidies. Previous projects which retrofitted two single phase lift station pumps with three phase pumps and the associated electrical control system reduced the cost of operating Zone D. However two lift stations still operate with single phase pumps and the maintenance estimate for this Zone D still reflects anticipated maintenance. This year Zone C, which includes the low pressure systems, is anticipated to have high maintenance costs. Some of the low pressure pumps are reaching the end of their useful life and need repairing or replacing. Staff will put in place a low pressure pump program to help lower the cost of repairing and replacing the low pressure pumps which should result in a cost savings over previous years. The cost of other maintenance associated with the low pressure systems is expected to increase and the net result is a small overall increase which results in a requirement for a higher subsidy for this Zone. The system of zones was developed to identify the specific combination of subsystems used by each contributing parcel. The Ordinance establishing the Charge also established the maximum service charge that can be levied, which is adjusted each year based on changes in the Consumer Price Index (CPI). The maximum service charges by zone for the FY 2013/14 are as follows: FY 2012/13 Max. Rates Zone A $163.92 /ERU ZoneB $660.00 /ERU ZoneC $222.51 /ERU ZoneD $718.57 /ERU 2-4 City Council has directed staff to develop a procedure to reduce the City subsidy to zero. Harris & Associates has been retained to assist Staff with this effort. In coming months Staff plans to bring forward a citywide sewer system funding plan for Council consideration. CONCLUSIONS The City Council is required to conduct a public hearing and adopt a resolution (confirming the Charge) prior to collecting the Charge on the tax roll for FY 2013/14. By adopting staff's recommendation, Council will be levying single-family parcels ranging from $163.92 to $718.57 and subsidizing the system in the amount of $40,050. ALTERNATIVE ACTIONS • Reduce or eliminate the Charge • Reduce, eliminate or increase the subsidy Impact: The City is required by law to ensure the safe operation and maintenance of the sewer systems it owns. The Engineer's Report includes the best estimates of the necessary revenues to operate and maintain the system. Thus, the City would need to increase the subsidy or be subject to regulatory fines in the event of system failures if the Charge was reduced or eliminated. FISCAL IMPACT By adopting the staff recommendation, Council will be approving a total sewer service charge of $56,330 and a City subsidy of $40,050 in general funds to maintain the Abalone Cove sewer system for FY 2013/14. Because the Council has included funding for these costs in the FY 2013-14 budget, additional funding is not needed. Attachments: A. 8. C. D. This Sewer Maintenance Fee ensures a fair and equitable levying of the necessary costs of operating and maintaining of the facilities and was established in compliance with the provisions of Proposition 218, Article XIIID of the California Constitution, Section 6(b ). Mailed notices were sent to all affected property owners and the Public Hearing was held on July 17, 2001. Since there was not a majority of written protests, the Fee was established with a maximum annual escalator of seven percent (7%). This report, as signed and presented to the Council for approval, has been prepared according to the methodology and rates approved by the City Council in 2001. The Cit)r Council annually reviews the current and projected year's costs for the operation and maintenance of the sewer facilities and sets the rates for the ensuing fiscal year, which runs between July 1 and June 30. Equivalent Residential Units The sewer flow rates used to calculate this User Fee are based on the Los Angeles County Sanitation District (LACSD) standards, as outlined in their Master Service Charge Ordinance of South Bay Cities Sanitation District of Los Angeles County, as adopted on March 18, 1998. This ordinance describes the user categories and mean loading of sewer usage for flow in the South Bay Cities Sanitation District of Los Angeles County. Using these standards, residential parcels with single family homes are assigned a flow rate of 260 Gallons Per Day (GPD). Therefore, 260 GPD is defined as 1 Equivalent Residential Unit (ERU) and all other parcels are charged based on the number of ERUs calculated on their property for their particular use. (The total flow rate for each parcel is divided by 260 to calculate the number of ER Us assigned to the parcel.) Vacant parcels have no sewer flow associated with them and therefore would be assigned 0 ERUs. The Abalone Cove Beach property flow rate has been calculated based on the future improvements to the beach. These future improvements consist of 7 toilet facilities and 2 showers. The flow rates for these facilities are based on information provided by the City of Los Angeles Bureau of Sanitation, and are shown below in Table 2. Table 2 provides a summary of the user categories in the Abalone Cove sewer service area, the assigned flow rates, and the ERU calculation for each. These different and integrated subsystems collect flows from the sewer service area and ultimately convey it to the LACSD outfall. Flows generated by each parcel are conveyed through one or more of these subsystems. Parcels that contribute flow to a subsystem will be charged for the operation and maintenance of that subsystem. Because the entire Abalone Cove sewer system flows into the Palos Verdes Drive Pump Station and the 6-inch force main and gravity system between the pump station and the LACSD outfall, all users of the system will be charged for the operation and maintenance of these facilities. • Gravity Subsystem. Gravity systems are the most basic of sewer systems and require minimal routine maintenance. Parcels connected to the Gravity Subsystem would be responsible for sharing the costs associated with maintenance of the gravity system. All parcels within the service area contribute to this subsystem, as sewage flows contributed by each parcel are eventually discharged into the gravity subsystem + Force Main Subsystem. Force main subsystems include pump station and pressurized pipes in addition to gravity lines. Parcels connected to the Force Main Subsystem would be responsible for sharing the additional costs associated with the operation and maintenance of those components. The pump stations for these lines are located at Thyme Place, Sweetby East and Sweetby at Altimira Canyon. + Low Pressure Subsystem. Low pressure subsystems include grinder pumps at each user connection to the system as well as low pressure pipes. Parcels connected to the Low Pressure Subsystem would be responsible for sharing the associated operation and maintenance costs of those components. · A few parcels that are connected to the gravity subsystem or the force main subsystem require the use of a grinder pump to get their flow into the system These parcels share in the cost of grinder pump maintenance and are considered to be a part of the low pressure subsystem. Rate Zones A system of zones was developed to identify the specific combination of subsystems used by each contributing parcel. The City Council finds: A. Pursuant to Chapter 13.06 of the Rancho Palos Verdes Municipal Code and Ordinance No. 367U (the "Ordinance"), the City levies an annual sewer service charge (the "Charge") on each parcel of real property in the Abalone Cove Landslide Abatement District that is connected to the sanitary sewer system. The Charge is levied to finance the costs of on-going operation and maintenance of sewer facilities and services ("Sewer Services"). B. As authorized by Section 5473 of the California Health and Safety Code, the Charge is collected for each fiscal year on the County of Los Angeles tax roll in the same manner, by the same persons, and at the same time as, together with and not separately from, the general taxes of the City. C. A written report (the "Report") has been filed with the City Clerk, containing a description of each parcel of real property receiving Sewer Services and the amount of the Charge for each such parcel for Fiscal Year 2013-14 (commencing July 1, 2013 and ending June 30, 2014), computed in conformity with the Ordinance. Such Report is on file in the office of the City Clerk and incorporated herein by reference. D. The Report provides that the Charge for Fiscal Year 2013-14 be increased from the Charge for the prior Fiscal Year; but the charge does not exceed the maximum amount authorized pursuant to the Ordinance. E. The City Clerk caused notice of a hearing on the Report to be published in the Palos Verdes Peninsula News on May 30, 2013 and June 6, 2013. F. The City Council held a public hearing on the Report on June 18, 2013. At such hearing, the City Council heard and considered all objections and protests, if any, to the Report and all testimony regarding the proposed levy of the Charge for Fiscal Year 2013-14. Section 2. The City council hereby overrules any and all objections to the Report; determines that no majority protest against the Report, determined in accordance with Health and Safety Code Section 5473.2, exists; approves and finally adopts the Report as filed; determines that the Charge for Fiscal Year 2013-14 against R6876-0001\1228579v1 .doc 2-19 each parcel described in the Report shall be as described in the Report; and orders that the Charge shall be collected for Fiscal Year 2013-14 on the County of Los Angeles tax roll in the same manner, by the same persons, and at the same time as, together with and not separately from, the general taxes of the City. The City Clerk is directed to file a copy of the Report, with a statement endorsed on the Report over the City Clerk's signature that the Report has been approved and finally adopted, with the City Treasurer on or before August 8, 2013 pursuant to Section 5 of the Ordinance.
