(UWS) can charge single-family and multi-family residential customers in FY 13-14. BACKGROUND The City has exclusive single-family and multi-family residential solid waste and recycling agreements with EDCO Disposal Corporation (EDCO) for 95% of the City and Universal Waste Systems, Inc. (UWS) for the remaining 5% of the City, concentrated in the coastal and landslide areas. Both agreements commenced on July 1, 2010 and will terminate on June 30, 2017. Additionally, both agreements have an extension option of up fo 36- months, at the City's sole discretion. The City establishes an annual cap on the permissible rates EDCO and UWS can charge their residential customers. Per their residential agreements, EDCO and UWS are eligible for annual adjustments. The only permissible rate adjustments are those outlined in the Agreement. The rate adjustments are based on changes to national published price indices and solid waste disposal facilities' gate rates. The rate adjustment requests are due to the City by March 30 of every year. EDCO and UWS both submitted their requests for rate adjustments for FY 13-14 prior to that deadline. During the 2009 residential contracts procurement process, one of the City's goals was to provide identical Citywide caps on rates for automated curbside collection. Therefore, when City Council approved UWS's residential agreement in 2009, that approval was contingent on the cap for UWS's automated curbside rates matching the cap for EDCO's automated curbside rates. 2-2 UWS Request for Rate Adjustment FY 13-14 June 4, 2013 Page2 The proposed cap on authorized FY 13-14 automated curbside rates are discussed in EDCO's staff report. Therefore, per the agreement, UWS would match EDCO's current and future capped rates. EDCO's request is addressed in a separate staff report. Staff placed notices of the public hearing in the Palos Verdes Peninsula News on May 23, and May 30, 2013. DISCUSSION This report will focus entirely on UWS's other residential collection services which are non-automated and include: manual unlimited backyard, residential manure, and multi- family bin collection and service. Subcommittee Meeting: On May 8, 2013, staff met with the Solid Waste Subcommittee (Subcommittee) comprised of Mayor Pro Tern Duhovic and Councilman Campbell. After review of the exhibits, discussions with staff and UWS representative, the Subcommittee approved staff's recommendation to bring this rate adjustment request to the full City Council for consideration. Similar to EDCO, UWS's City approved rate adjustment methodology (RAM) has two cost components: 1) Disposal Cost Component and 2) Service/Collection Cost Component. The RAM is based on the average percentage changes, both increases and decreases, for 12 months. For rate adjustments effective FY 13-14, the calendar year 2012 (January 2012 to December 2012) is considered. Once approved, the authorized cap on rates is effective July 1, 2013, which is 6 months later. 1) Disposal Cost Component: UWS's disposal cost increases are based on the percentage increases at the Puente Hills County owned landfill for the calendar year 2012. In 2012, disposal costs at Puente Hills for solid waste material did not increase and remained $38.41/ton. Therefore the percentage change is 0%. 2) Service/Collection Cost Component: UWS's service/collection cost increases are based on the percentage increases/decreases in several national indices from the U.S. Department of Labor, Bureau of Labor Statistics for calendar year 2012. These indices are identical to the ones used by EDCO, which are specifically tailored to solid waste collection operations. UWS's collection cost component is 0.4%. UWS's total weighted residential rate adjustment, which reflects both disposal and service cost components, is 0.4%. Therefore, in accordance with these indices, lack of change in the landfill gate rate, and per the provisions in their agreement, UWS is requesting an increase of 0.4% in the cap on permissible rates for manual unlimited backyard, manure, and multi-family bin services in FY 13-14. This 0.4% is not in addition to EDCO's 1.2% requested rate increase. The 0.4% is for separate and different (non-automated) collection services provided by UWS. Comparatively, due to higher fuel costs, in FY 11-12 UWS's rate increase was 2.5%, and in FY 12-13 it was 1.7%. There are no additional costs or surcharges added to their requested rate increase. For example, the cap on the permissible rate for a 3-yard bin picked up once a week would increase by $0.40/month from $100.10/month to $100.50 /month. In conclusion, if approved UWS's automated curbside services would increase 1.2% similar to EDCO's, while their other non-automated services would increase 0.4%. Staff and HOR Engineering, the City's AB 939 consultant, have reviewed the data and calculations provided by UWS, and found them accurate. (See attached spreadsheets for proposed authorized cap on rates for all single and multi-family service levels). Recycling Rebate to Customers: Previously UWS provided the City an annual Recycling Rebate of $16,000, which was deposited in the Beautification-Recycling Fund. In November 2012, Council approved issuing a rebate to residential ratepayers. This rebate results in a credit of $1.31 per month per customer/unit and is retroactive to January 1, 2013. Thus, UWS's July statement will include a line item reflecting a 6-month retroactive credit of $7.86 (January to June 2013) and a quarterly credit of $3.93 (July to September 2013). The minor difference in UWS's monthly credit amount compared to EDCO is due to the difference in the ratio of the number of UWS customers to its contractual annual recycling revenue due to the City, as compared to EDCO's. Fee Distribution/Allocation: UWS currently pays the City 12% of its gross receipts for Collector Fee (estimated at $39,000/year) and 3% for Environmental Fee (estimated at $9,000/year). The allocation of the fees among City funds will be similar to EDCO's. As mentioned in EDCO's staff report, one Subcommittee member suggested issuing an additional credit for the increased portion of the City's FY 13-14 fees which totals $375. FISCAL IMPACT Approving staff's recommendation would permit UWS to increase customers' FY 13-14 rates by up to 1.2% for automated and by up to 0.4% for manual unlimited backyard, manure and multi-family bin services. This would also result in an increase in the Collector Fee of approximately $300 and Environmental Fee of approximately $75.
