JONES, II, INTERIM DIRECTOR OF PUBLIC ~ JUNE 4, 2013 ~ RESIDENTIAL SOLID WASTE AND RECYCLING RATE ADJUSTMENT FOR EDCO DISPOSAL CORPORATION FOR FY 13-14 (Supports 2013 City Council Goal of government efficiency, fiscal control and transparency) CAROLYN LEHR, CITY MANAGER Q9.__ Lauren Ramezani, Senior Administrative Analyst '-fvf-- RECOMMENDATION Approve the cap on permissible rates that EDCO Disposal Corporation can charge single-family and multi-family residential customers in FY 13-14. BACKGROUND The City has exclusive residential solid waste and recycling agreements with EDCO Disposal Corporation (EDCO) and Universal Waste Systems, Inc. (UWS). Both agreements commenced on July 1, 2010 and will terminate on June 30, 2017. Additionally, both agreements have an extension-Option of up to 36-months, at the City's sole discretion. The City establishes an annual cap on the permissible rates EDCO and UWS can charge their residential customers. Per their residential agreements, EDCO and UWS are eligible for annual adjustments. The only permissible rate increases are those outlined in their agreement. The rate adjustments are based on changes to national published price indices and solid waste disposal facilities' gate rates. The rate adjustment requests are due to the City by March 30 of every year. EDCO and UWS both submitted their requests for rate adjustments for FY 13-14 prior to that deadline. Staff placed notices of the public hearing in the Palos Verdes Peninsula News on May 23, and May 30, 2013. UWS's request is addressed in a separate staff report. DISCUSSION On May 8, 2013, staff met with the Solid Waste Subcommittee (Subcommittee) comprised of Mayor Pro Tern Duhovic and Councilman Campbell. After review of the exhibits, 1-2 EDCO Rate Adjustment Request June 4, 2013 Page2 discussions with staff and EDCO representatives, the Subcommittee approved staff's recommendation to bring this rate adjustment request to the full City Council for consideration. In accordance with Section 6.3 of EDCO's agreement with the City: "Adjustments to the maximum rates is subject to the approval of the City Council at a public hearing, although the Council's discretion shall be limited to determining, based on substantial evidence, whether the requested maximum rate adjustment meets the requirements as set forth herein." The City has a specific rate adjustment methodology (RAM), which was prepared by the City's procurement consultant and was subsequently approved by the City Council when the EDCO agreement was approved in November 2009. The RAM outlines the acceptat?le cost variables and national approved indices, and provides detailed guidelines on how future rate adjustments are calculated. This helps calculation accuracy, while it also protects the City from sudden rate spikes. Similar methodologies are used by various cities in their recent solid waste franchise agreements. The RAM is based on the average percentage changes, both increases and decreases, for a 12-month period. The rate adjustment evaluation period effective FY 13-14 begins with the calendar year 2012 (January 2012 to December 2012). If Council approves the request, the City's new authorized cap for EDCO's rates become effective on July 1, 2013, which is six months after the rate adjustment evaluation period. The RAM has two cost components: a Service/Collection Cost Component, and a Disposal Cost Component. They are explained in detail below: 1) Service/Collection Cost Component: EDCO's service/collection cost increases are based on calendar year 2012 and reflect the percentage of increases/decreases in several national indices from the U.S. Department of Labor, Bureau of Labor Statistics. These selected indices were specifically chosen since they are tailored to solid waste collection operations. A weighted average of the various service/collection changes is calculated and used in the RAM formula. The national indices include: (US Dept. of Labor) Index /Commodity % Change in 2012 Consumer Price Index (CPI} Increased 2.1% Producer Price Index (PPI) for Fuel-Natural Gas * (Decreased 31 %) PPI for heavy-Duty Truck Manufacturing Increased 2.4% Hourly Labor Costs ** Increased 4.6% Total Weighted Average Increased 0.3% Service/Collection Component (Exhibit 5A, Row 13G) * EDCO has CNG trucks. There was a significant reduction in fuel costs between 2011 and 2012. ** Based on previously contract approved labor rates 2) Disposal Cost Component: EDCO's disposal cost increases are based on the percentage changes at county owned disposal facilities for calendar year 2012. To increase accuracy, a weighted average of the various disposal facilities' rate changes is calculated and used in the RAM formula. To derive the weighted average, the W:\LAUREN\STAFFRPnREFUSE\2013\EDCO rate adjustment fy 13-14 rwg.docx 1-3 EDCO Rate Adjustment Request June 4, 2013 Page3 percentages of where each commodity (trash and green waste) was delivered to, and the quantity taken to each facility are considered. A straight average is not used because different facilities are used for disposal of trash and processing green waste. The total weighted average disposal cost component changed from $24.63 to $25.52. The disposal facilities list and gate rates include: Disposal Facility Gate Rate$ Gate Rate% Change/ton Change/ton Puente Hills-Solid Waste (Same as previous yr) 0% $38.41/ton Puente Hills-Green Waste $22.95/ton to 4.4% $23.97/ton County of Orange -Solid Waste $22.68/ton to 2.2% $23.18/ton Southeast Resource Recovery Facility $47/ton to 6.4% (SERRF)-Long Beach waste to energy $50/ton facilitv $24.63/ton 3.6% Total Disposal Cost Component to $25.52/ton (Exhibit SA, Row (Weighted Average) 14G) Puente Hills Landfill is scheduled for closure in October 2013. In anticipation of the closure and the potential domino effect on disposal sites, EDCO has recently opened EDCO Recycling & Transfer in Signal Hill. The facility accepts and transfers all EDCO collected trash in the City to alternative disposal sites. Additionally, EDCO has an importation agreement with the County of Orange until 2016, which should help stabilize landfill rates for the City after Puente Hills' closure. Approximately 72% of EDCO's overall costs are related to service/collection costs which increased 0.3% in 2012. Approximately 28% of EDCO's overall costs are related to disposal costs which increased 3.6% in 2012. Therefore, EDCO's total weighted residential rate adjustment, reflecting both service and disposal cost components is 1.2%. (See attached Table labeled Exhibit SA, Row 24G) In accordance with the national indices, the disposal facilities' gate rates and per the provisions of the City agreement with EDCO, EDCO is requesting a 1.2% increase in the cap on permissible rates for FY 13-14. This requested increase allows EDCO to adjust their rates to reflect the cost increases they incurred in 2012. There are no additional costs or surcharges added to their requested rate increase. The average single-family customer, with a 64-gallon cart, would receive a $0.29/month increase in their trash bill. Some of the proposed authorized caps on EDCO's rates for FY 13-14 are listed on the next page: W:\LAUREN\STAFFRPT\REFUSE\2013\EDCO rate adjustment fy 13-14 rwg.docx 1-4 EDCO Rate Adjustment Request June 4, 2013 Page4 Service Level Current Cap on Monthly Single-family Rates (one trash cart) FY 12-13 Curbside 35-gallon $18.51 Curbside 64-gallon $23.81 (most popular size) Curbside 96-gallon $29.11 Proposed Cap on increase in Monthly Rates FY 13-14 $0.22 $0.29 $0.35 Proposed Proposed Cap on Capon Monthly Rates for Monthly Seniors Rates ( 10% discount) FY 13-14 FY 13-14 $18.73 $16.86 $24.10 $21.69 $29.46 $26.51 Multi-family accounts would have a similar proposed increase cap of 1.2%. For example, the cap on the permissible rate for a 3-yard bin picked up once a week would increase by $1.38/month from $115/month to $116.38/month. Staff and HOR Engineering, the City's AB 939 consultant, have reviewed the data and calculations provided by EDCO and found them accurate. (See attached spreadsheets for proposed authorized cap on monthly rates for all EDCO single and multi-family service levels). The FY 13-14 rate adjustment request is relatively low due to decreases in fuel costs in recent years. Previous rate adjustments were 3.7% in FY 11-12 and 2.3% in FY 12-13. Furthermore, the City of Rolling Hills Estates has received a request from Waste Management for a FY 13-14 residential solid waste and recycling rate increase of 1.2%. Recycling Rebate to Customers: Previously EDCO provided the City an annual Recycling Rebate of $280,000, which was deposited in the Beautification-Recycling Fund. In November 2012, Council approved issuing a rebate to residential ratepayers. This rebate results in a credit of $1.58 per month per customer /unit and is retroactive to January 1, 2013. Thus, EDCO's July statement will include a line item reflecting a 6-month retroactive credit of $9.48 (January to June 2013) and a quarterly credit of $4.74 (July to September). This credit is equivalent to approximately 6.5% of an average monthly rate, which would more than offset the 1.2% proposed increase. Fee Distribution/Allocation: EDCO currently pays the City two fees: a Collector Fee and an Environmental Fee. EDCO includes these fees in the rates, they are not segregated or "line itemed" separately. The purpose of these fees is to help compensate the City for expenses the City incurs due to on-going hauler collection operations and programs. The allocation of the fees among the various City funds is at the discretion of the City Council. The Collector Fee is deposited into two funds: 1) General Fund, and 2) Waste Reduction fund. The residential and arterial streets' wear and tear due to heavy truck traffic is addressed through the General Fund programed projects such as the annual residential overlay and slurry seal, arterial rehabilitation, and ongoing pothole, curb and gutter repairs. The administration of EDCO's contract, assisting in customer service issues, implementing ongoing Citywide recycling and waste reduction activities, special events, and complying with state mandates and reports is paid through the restricted Waste Reduction Fund. W:\LAUREN\STAFFRPnREFUSE\2013\EDCO rate adjustment fy 13-14 rwg.docx 1-5 EDCO Rate Adjustment Request June 4, 2013 Pages The current annual Collector Fee is $482,685. Per the City's Council approved agreement, any adjustment in the rates automatically leads to an adjustment of the same percentage to the City fees. Therefore, approval of staff's recommendation would result in the City's Collector Fee automatically increasing by 1.2%, from approximately $482,685 to $488,480 (or by $5,795) in FY 13-14. Staff proposes repeating the same FY 12-13 percentage allocation (see below) of the Collector Fee between the General Fund and Waste Reduction Fund to be used for FY 13-14. Collector Fee Fund Current Proposed Proposed Current Allocation Amount Increase Amount Percentage (rounded) (rounded) (rounded) (rounded) FY 12-13 FY 13-14 FY 13-14 FY 13-14 General Fund-Various $318,255 $3,845 $322,100 65% Waste Reduction Fund $164,430 $1,950 $166,380 35% Total ($rounded) $482,685 $5,795 $488,480 100o/o Furthermore, the current Environmental Fee is $122,000, which is deposited in the Storm Water Quality Fund. This supports: regular sweeping of residential and arterial streets, servicing trashcans at bus shelters, and assisting in NPDES/storm water quality program implementation and compliance. The FY 13-14 fee would also automatically increase 1.2%, from approximately $122,000 to $123,465 (or $1,465/year). ALTERNATIVE At the Subcommittee meeting, one Subcommittee member suggested the City consider issuing an additional credit to customers which would be for the FY 13-14 fee increases totaling $7,260 ($5,795+$1,465). EDCO has 14,800 customers/units in the City. That credit would equate to residential customers receiving a credit of $0.04/mo or $0.49/year. However, staff does not recommend the issuance of this credit, since the funding loss will impact the level of critical services. (e.g. reducing trash pickup at bus shelters by 25%). CONCLUSION EDCO submitted a residential rate adjustment request for an increase of 1.2% for FY 13- 14. The supporting calculations and documentations are per the City's agreement, and have been verified by staff and consultant, and reviewed by the Subcommittee. FISCAL IMPACT Approving the staff recommendation would permit EDCO to increase customers' FY 13-14 rates by up to 1.2%. This would also result in an increase in the Collector Fee of $5, 795 and the Environmental Fee of $1,465.
