RPVCCA_CC_SR_2014_06_17_02_Final_EIR_Zone_2CITY OF MEMORANDUM TO: FROM: JOEL ROJAS, DIRECTOR DATE: JUNE 17, 2014 RANCHO PALOS VERDES R & CITY COUNCIL MEMBERS COMMUNITY DEVELOPMENT SUBJECT: FINAL ENVIRONMENTAL IMPACT REPORT (FINAL EIR) AND CODE AMENDMENT FOR THE ZONE 2 LANDSLIDE MORA TOR/UM ORDINANCE REVISIONS (Case No. ZON2009-00409); Location: "Zone 2" of the City's Landslide Moratorium Area REVIEWED: CAROLYNN PETRU, ACTING Cl~NAGER@) Project Manager: Eduardo Schonborn, AICP, Senior Plann~ RECOMMENDATION Continue the public hearing to the August 5, 2014 City Council meeting to allow additional time for the City's consultant to work on the responses to the additional comments received on the Final EIR for the proposed Zone 2 Landslide Moratorium Ordinance Revisions. BACKGROUND AND DISCUSSION On May 6, 2014, the City Council heard public testimony on the Final EIR, the Draft CEQA findings and the proposed Draft Ordinance revising the City's Landslide Moratorium Ordinance to establish an exception category to allow the development of the 31 undeveloped (non-Monks plaintiffs' lots) lots in Zone 2. The City Council agreed to continue the public hearing to June 17, 2014 to allow staff and its consultants to address the additional comments made by the public on the Final EIR. As reported in the May 5th Staff Report, the City's funds currently allocated for the preparation of the EIR document have either been spent, or are encumbered. As such, on May 8, 2014, the consultant provided Staff with a request to amend the contract to increase the budget allocated for this project, and on May 20, 2014 the City Council approved a contract amendment. 2-1 MEMORANDUM: Final EIR Zone 2 Code Amendment (Case No. ZON2009-00409) June 17, 2014 Page 2 As a result of the City Council's approval of the contract amendment, Staff authorized the City's consultant to commence work on responses to comments received on the Final EIR. The City's consultant is diligently working on these responses, and Staff expects the responses to be completed by the consultant in time for review at the August 5th City Council meeting. CONCLUSION As previously indicated, CEQA does not mandate a formal comment period for a Final EIR nor mandate that comments received on a Final EIR be responded to, since the public previously had the opportunity to comment on the Draft EIR. Notwithstanding, due to the sensitive nature of the· proposed Ordinance Revisions, the City realizes that it is prudent to address or respond to these most recent 9omments received on the Final EIR. Thus, to accommodate the time and resources needed to review and address to the comments, Staff recommends that the public hearing for this project be continued to August 5, 2014. 2-2
