REVIEWED: CAROLYNN PETRU, ACTING CITY MANAGE~ Project Manager: So Kim, Associate Planner l6fv RECOMMENDATION At the applicant's request, continue the public hearing to an unspecified date, to provide the applicant additional time to investigate the feasibility of an alternative antenna roof location and prepare revised plans and construct the silhouette of said alternate location. BACKGROUND On February 25, 2014, the Planning Commission adopted P.C. Resolution No. 2014-10 (5- 1 vote, with Commissioner Tomblin dissenting and Chairman Emenhiser recused), conditionally approving a Conditional Use Permit Revision, allowing Sprint PCS to replace 6 existing roof mounted antennas with 3 new antennas within a new decorative encasement at the east end of the roof of an existing commercial building located at 28041 Hawthorne Blvd (7-11 building). On March 11, 2014, prior to the expiration of the appeal period, the Acting City Manager was notified in writing by Councilman Campbell requesting that an item be placed on the March 1 sth City Council agenda to consider whether the Planning Commission's February 25th decision should be appealed by the City Council. On April 10, 2014, a public notice was published in the Peninsula News, emailed to interested parties and mailed to all persons owning property within the 500' radius of the subject site, alerting them that the City Council would conduct said appeal hearing on May 20, 2014. On May 20, 2014, the City Council continued the public hearing to June 17th, based on the applicant's request for additional time to look into the feasibility of relocating the proposed replacement antennas and enclosure to an alternate roof location. DISCUSSION On May 2,7, 2014, the applicant emailed (attached) Staff requesting thatthe public hearing be continued to an indefinite date so that they have sufficient time to prepare revised plans and construct a silhouette of an alternate roof location for their proposed replacement antennas. As such, at the applicant's request, Staff is recommending that the City Council continue the public hearing to an unspecified date. By doing so, a new public hearing notice will be issued after the applicant submits revised plans and constructs a revised silhouette. All previous Planning Commission and City Council Minutes, Staff Reports, and related public correspondence will be included as attachments to the future Staff Report, with exception to the two emails directly related to the proposed continuance request. Details of these emails are discussed in the 'Additional Information' section below and are also included as an attachment to this report. ADDITIONAL INFORMATION Staff received the following two emails directly related to the proposed continuance request: 1) Mr. and Mrs. Kerkhof -They indicated that they have no problem with Sprint's request for additional time. 2) Mr. Freeman -He is requesting that the existing temporary silhouette be removed immediately, given the uncertainty of when this item will be brought back to the City Council. In speaking with the applicant, while they are investigating an alternate roof location, they have not completely abandoned the idea of pursuing the antenna enclosure in its current location. Therefore, Staff believes that it would be unreasonable to require Sprint to remove the temporary silhouette at this time. Since the city is now requesting these items before the hearing, Sprint will need additional time to get these items submitted. As such, they can keep the current silhouette in place while they look into the feasibility of relocating it elsewhere on the roof. Also, per practice, if an application is inactive for approximately 6 months, the application can be administratively withdrawn. If this happens, the applicant will be required to remove the temporary silhouette within a set time frame. hope this helps. Meanwhile, do we really need to see that existing silhouette mockup for the next 6 months? Everyone knows what it looks like now. It's already been up there for 4 months (see attached picture from February) and we don't need to "evaluate" it anymore! What's Sprint's incentive to resubmit their application in a timely manner? Please direct Sprint to remove the silhouette asap.
