RECOMMENDATION
Approve the cap on permissible rates that Universal Waste Systems, Inc. (UWS) can
charge single-family and multi-family residential customers in FY 14-15.
BACKGROUND
The City has exclusive single-family and multi-family residential solid waste and recycling
agreements with EDCO Disposal Corporation (EDCO) for 95% of the City and Universal
Waste Systems, Inc. (UWS) for the remaining 5% of the City, concentrated in the coastal
and landslide areas. Both agreements commenced on July 1, 2010 and will terminate on
June 30, 2017. Additionally, both agreements have an extension option of up to 36-
months, at the City's sole discretion.
The City establishes an annual cap on the permissible rates EDCO and UWS can charge
their residential customers. Per their residential agreements, EDCO and UWS are eligible
for annual adjustments. The only permissible rate adjustments are those outlined in the
Agreement. The rate adjustments are based on changes to nationally published price
indices and solid waste disposal facilities' gate rates. The rate adjustment requests are due
to the City by March 30 of every year. EDCO and UWS both submitted their requests for
rate adjustments for FY 14-15 prior to that deadline.
During the 2009 residential contracts procurement process, one of the City's goals was to
provide identical Citywide caps on rates for automated curbside collection. Therefore,
when City Council approved UWS' residential agreement in 2009, that approval was
contingent on the cap for UWS' automated curbside rates matching the cap for EDCO's
automated curbside rates.

The proposed cap on authorized FY 14-15 automated curbside rates are discussed in
EDCO's staff report. Therefore, per the agreement, UWS would match EDCO's current
and future capped rates. EDCO's request is addressed in a separate staff report.
Staff placed notices of the public hearing in the Palos Verdes Peninsula News on May 22
and May 29, 2014.
DISCUSSION
This report will focus specifically on UWS' other residential collection services, which are
non-automated and include: manual backyard unlimited, residential manure, and multi-
family bin collection and service.
Similar to EDCO, UWS' City approved rate adjustment methodology (RAM) has two cost
components: 1) Disposal Cost Component and 2) Service/Collection Cost Component. The
RAM is based on the average percentage changes, both increases and decreases, for 12
months. For rate adjustments effective FY 14-15, the calendar year 2013 (January 2013 to
December 2013) is considered. Once approved, the authorized cap on rates is effective
July 1, 2014, which is 6 months later.
1) Disposal Cost Component: UWS' disposal cost increases are based on the percentage
increase at the Puente Hills County owned landfill for the calendar year 2013. Puente Hills
Landfill closed on October 31, 2013, and was replaced by the Puente Hills MRF which
resulted in a 19.1 % increase in the disposal costs for trash.

2) Service/Collection Cost Component: UWS' service/collection cost increases are based
on the percentage increases/decreases in several national indices from the U.S.
Department of Labor, Bureau of Labor Statistics, for calendar year 2013. These indices are
identical to the ones used by EDCO, which are specifically tailored to solid waste collection
operations. Therefore, UWS' collection cost component change is the matching 2.8%.
UWS' total weighted residential rate adjustment, which reflects both disposal and service
cost components, is 5.3%. Therefore, in accordance with these indices, the change in the
landfill gate rate, and per the provisions in their agreement, UWS is requesting an increase
of 5.3 % in the cap on permissible rates for manual backyard unlimited, manure, and multi-
family bin services in FY 14-15.
This 5.3% is not in addition to EDCO's 3.6% requested rate increase. The 5.3% is for
separate and different (non-automated) collection services provided by UWS.
Comparatively, in FY 11-12 UWS' rate increase was 2.5%, in FY 12-13was 1.7%, and in
FY 13-14 was 0.4%.

The large jump in the proposed FY 14-15 rates as compared to the FY 13-14 rates is
because of these main factors: 1) a 19.1 % increase in the landfill gate rate, and 2) the
price of Natural Gas (in FY 2012, the price of natural gas decreased by 31%, which was a
10-year low, while in 2013, natural gas prices went up 29.1%), and lastly, 3) UWS does not
have the same disposal component cap as EDCO.
This requested increase allows UWS to adjust their rates to reflect the cost increases they
incurred in 2013. There are no additional costs or surcharges added to their requested rate
increase. Examples of UWS' proposed rates for FY 14-15 are listed below:

The multi-family accounts would have a similar proposed increase cap of 5.3%. For
example, the cap on the permissible rate for a 3-yard bin picked up once a week would
increase by $5.33/month, from $100.50/month to $105.83 /month.
In conclusion, if approved, UWS' automated curbside services would increase 3.6% (similar
to EDCO's) while their other non-automated services would increase 5.3%. Staff and SCS
Engineers, the City's AB 939 consultant, have reviewed the data and calculations provided
by UWS, and found them to be accurate. (See attached spreadsheets for proposed
authorized cap on rates for all single and multi-family service levels).
Recycling Rebate to Customers: Until January 2013, UWS provided the City an annual
Recycling Rebate of $16,000, which was deposited in the Beautification-Recycling Fund.
Since then, Council approved issuing a rebate to residential ratepayers resulting in an
ongoing credit of $1.31 per month per customer/unit. The Recycling Rebate is based on
the California Redemption Value (CRV) of beverage containers. Since there were no
changes in the CRVs in the past year, there will be no change in the customer rebate/credit
amount. This monthly credit offsets all or a large portion of the proposed automated service
increase of 3.6% or manual service increase of 5.3%. Finally, the minor difference
($0.27/month) in UWS' monthly credit amount compared to EDCO is due to the difference
in the ratio of the number of UWS customers to its contractual annual recycling revenue
due to the City, as compared to EDCO's.
Fee Distribution/Allocation: UWS currently pays the City 12% of its gross receipts for
Collector Fee (estimated at $35,000/year) and 3% for Environmental Fee (estimated at
$9,000/year). The allocation of the fees among City funds will be similar to EDCO's.

FISCAL IMPACT
Approving the staff recommendation would permit UWS to increase customers' FY 14-15
rates by up to 3.6% for automated and by up to 5.3% for manual backyard unlimited,
residential manure, and multi-family bin services. An increase by UWS of the full 3.6%
for automated and 5.2% for non-automated services would result in an increase in the
Collector Fee of approximately $1,500 and the Environmental Fee of approximately $400
in FY 14-15.

CONTRACTOR COMPENSATION AND RATES
6.1 General
The maximum rates set forth in Exhibit 4, and as more fully defined as Contractor
Compensation in this Article, shall be the maximum amount Contractor may charge
Customers as full, entire and complete compensation due pursuant to this Agreement
for all labor, equipment, materials and supplies, taxes, insurance, bonds, letters of
credit, .overhead, Disposal, transfer, profit and all other things necessary to perform all
the services required by this Agreement in the manner and at the times prescribed.
Contractor shall impose no other charges for services provided to Customers unless
approved in advance in writing by the City Manager.
Contractor shall not charge for Collection at Premises owned and/ or operated by the
City now and in the future.
6.3 Schedule of Future Adjustments

Beginning with the Rate Year starting July 1, 2011 and ending on June 30, 2012 and for
all subsequent Rate Years, Contractor may request an annual adjustment to the
maximum rates shown in Exhibit 4. The Contractor shaIJ submit its request in writing,
to be received by City in Person or via certified mail, by the preceding March 30, and
shall be based on the method of adjustment described in Section 6.4. Failure to submit a
written request by March 30 shall result in Contractor waiving the right to request such
an increase for the subsequent Rate Year. Missed rate adjustments may not be added to
