RECOMMENDATION
Approve the cap on permissible rates that EDCO Disposal Corporation can charge
single-family and multi-family residential customers in FY 14-15.
BACKGROUND
The City has exclusive residential solid waste and recycling agreements with EDCO
Disposal Corporation (EDCO) and Universal Waste Systems, Inc. (UWS). Both
agreements commenced on July 1, 2010 and will terminate on June 30, 2017.
Additionally, both agreements have an extension option of up to 36-months, at the
City's sole discretion.
The City establishes an annual cap on the permissible rates EDCO and UWS can charge
their residential customers. Per their residential agreements, EDCO and UWS are eligible
for annual adjustments. The only permissible rate increases are those outlined in their
agreements. The rate adjustments are based on changes to nationally published price
indices and solid waste disposal facilities' gate rates.
The rate adjustment requests are due to the City by March 30 of every year. EDCO and
UWS both submitted their requests for rate adjustments for FY 14-15 prior to that
deadline. UWS' request is addressed in a separate staff report.
Staff placed notices of the public hearing' in the Palos Verdes Peninsula News on May 22,

DISCUSSION
In accordance with Section 6.3 of EDCO's agreement with the City: "Adjustments to the
maximum rates is subject to the approval of the City Council at a public hearing, although
the Council's discretion shall be limited to determining, based on substantial evidence,
whether the requested maximum rate adjustment meets the requirements as set forth
herein." See attached.
The City has a specific rate adjustment methodology (RAM), which was prepared by the
City's procurement consultant and was subsequently approved by the City Council when
the EDCO agreement was approved in November 2009. The RAM outlines the
acceptable cost variables and nationally approved indices, and provides detailed
guidelines on how future rate adjustments are calculated. This helps calculation accuracy,
while it also protects the City from sudden rate spikes. Similar methodologies are used by
various cities in their recent solid waste franchise agreements.
The RAM is based on the average percentage changes, both increases and decreases,
for a 12-month period. The rate adjustment evaluation period effective FY 14-15 begins
with the calendar year 2013 (January 2013 to December 2013). If Council approves the
request, the City's new authorized cap for EDCO's rates become effective on July 1, 2014,
which is six months after the rate adjustment evaluation period. The RAM has two cost
components: a Service/Collection Cost Component, and a Disposal Cost Component.
They are explained in detail below:
1) Service/Collection Cost Component: EDCO's service/collection cost increases are
based on calendar year 2013 and reflect the percentage. of increases/decreases in several
national indices from the U.S. Department of Labor, Bureau of Labor Statistics. These
seleeted indices were specifically chosen because they are tailored to solid waste
collection operations. A weighted average of the various service/collection changes was
2.8%, and is calculated and used in the RAM formula. The national indices include:

2) Disposal Cost Component: EDCO's disposal cost increases are based on the
percentage changes at county owned disposal facilities for calendar year 2013. To
increase accuracy, a weighted average of the various disposal facilities' rate changes is
calculated and used in the RAM formula. To derive the weighted average, the

percentages of where each commodity (trash and green waste) was delivered to, and the
quantity taken to each facility are considered. A straight average is not used because
different facilities are used for disposal of trash and processing of green waste. The total
weighted average disposal cost component increased 5.8% from $25.52 to $26.99.

DISPOSAL INCREASE CAP OF 10%: Puente Hills Landfill closed on October 31, 2013
and was replaced by the Puente Hills Materials Recovery Facility (MRF), which resulted in
a 19.1 % increase on trash and 56.6% for green waste gate fees respectively. However, in
anticipation of this closure the agreement had placed certain safeguards including a
disposal increase cap of 10% to help avoid sudden spikes in rates. Furthermore, EDCO
has been utilizing its recently opened EDCO Recycling & Transfer facility in Signal Hill.
The facility accepts and transfers all EDCO collected trash in the City to alternative
disposal sites. Finally, EDCO has an importation agreement with the County of Orange
until 2016, which additionally helps stabilize landfill rates for the City with Puente Hills'
closure.
Approximately 72% of EDCO's overall costs are related to service/collection costs, which
increased 2% in 2013. Approximately 28% of EDCO's overall costs are related to disposal
costs which increased 1.6% in 2013. Therefore, EDCO's total weighted residential rate
cap adjustment, reflecting both service and disposal cost components is 3.6%. (See
attached Table labeled Exhibit 5A, Row 24G)
In accordance with the national indices, the disposal facilities' gate rates, and per the
provisions of the City agreement with EDCO, EDCO is requesting a 3.6% increase in the
cap on permissible rates for FY 14-15. This requested increase allows EDCO to adjust
their rates to reflect the cost increases they incurred in 2013. There are no additional
costs or surcharges added to their requested rate increase.

The average single-family customer, with a 64-gallon trash cart, would receive a
$0.87/month-increase in their trash bill. Some of the proposed authorized caps on
EDCO's rates for FY 14-15 are listed below:

Multi-family accounts would have a similar proposed increase cap of 3.6%. For example,
the cap on the permissible rate for a 3-yard bin picked up once a week would increase by
$4.19/month from $116.38/month to $120.57/month.
Staff and SGS Engineers, the City's AB 939 consultant, have reviewed the data and
calculations provided by EDCO and found them to be accurate. (See attached
spreadsheets for proposed authorized cap on monthly rates for all EDCO single and multi-
family service levels). The FY 14-15 rate adjustment request reflects two major increases:
the increase in landfill prices and the increase in the natural gas costs compared to the
decade low prices in 2012. Previous rate adjustments were 3.7% in FY 11-12 and 2.3% in
FY 12-13, and 1.2% in FY 13-14.
Recycling Rebate to Customers: Until January 2013, EDCO provided the City an annual
Recycling Rebate of $280,000, which was deposited in the Beautification-Recycling Fund.
Since then, Council approved issuing a rebate to residential ratepayers which results in an
ongoing credit of $1.58 per month per customer/unit. The Recycling Rebate is based on
the California Redemption Value (CRV) of beverage containers. Since there were no
changes in the CRVs, there will be no change in the customer rebate/credit amount. This
monthly credit is equivalent to approximately 6% of an average monthly rate, which more
than offsets the 3.6% proposed increase.
Fee Distribution/Allocation: EDCO currently pays the City two fees: a Collector Fee and
an Environmental Fee. EDCO includes these fees in the rates. They are not segregated
or "line-itemed" separately. The purpose of these fees is to help compensate the City for
expenses the City incurs due to on-going hauler collection operations and programs. The
allocation of the fees among the various City Funds is at the discretion of the City Council.
The Collector Fee is deposited into two funds: 1) General Fund, and 2) Waste Reduction
Fund. The residential and arterial streets' wear and tear due to heavy truck traffic is
addressed through the General Fund programmed projects such as the annual residential
overlay and slurry seal, arterial rehabilitation, and ongoing pothole, curb and gutter repairs.

The administration of EDCO's contract, assisting in customer service issues, implementing
ongoing Citywide recycling and waste reduction activities, special events, and complying
with State mandates and reports is paid through the restricted Waste Reduction Fund.
The current annual Collector Fee is $488,480. Per the City's Council approved
agreement, any adjustment in the rates automatically leads to an adjustment of the same
percentage to the City fees. Therefore, approval of staff's recommendation would result in
the City's Collector Fee automatically increasing by 3.6%, from approximately $488,480 to
$506,065 (or by $17,585) in FY 14-15. Staff proposes repeating the same FY 13-14
percentage allocation (see below) of the Collector Fee between the General Fund and
Waste Reduction Fund to be used for FY 14-15.

Furthermore, the current Environmental Fee is $123,465, which is deposited in the Storm
Water Quality Fund. This supports: regular sweeping of residential and arterial streets,
servicing trashcans at bus shelters, and assisting in NPDES/storm water quality program
implementation and compliance. The FY 14-15 fee would also automatically increase
3.6% from approximately $123,465 to $127,910, an increase of $4,445/year.
CONCLUSION
EDCO submitted a residential rate adjustment request for an increase of 3.6% for FY 14-
15. The supporting calculations and documentations are per the City's agreement, and
have been verified by staff and consultant.
FISCAL IMPACT
Approving the staff recommendation would permit EDCO to increase customers' FY 14-15
rates by up to 3.6%. An increase by EDCO of the full 3.6% would also result in an
increase in the Collector Fee of $17,585 and the Environmental Fee of $4,445 in
FY 14-15.

CONTRACTOR COMPENSATION AND RATES
6.1 General
The maximum rates set forth in Exhibit 4, and as more fully defined as Contractor
Compensation in this Article, shall be the maximum amount Contractor may charge
Customers as full, entire and complete compensation due pursuant to this Agreement
for all labor, equipment, materials and supplies, taxes, insurance, bonds, letters of
credit, overhead, Disposal, transfer, profit and all other things necessary to perform all
the services required by this Agreement in the manner and at the times prescribed.
Contractor shall impose no other charges for services provided to Customers unless
approved in advance in writing by the Oty Manager.
Contractor shall not charge for Collection at Premises owned and/ or operated by the
aty now and in the future.
6.3 Schedule of Future Adjustments
Beginning with the Rate Year starting July 1, 2011 and ending on June 30, 2012 and for
all subsequent Rate Years, Contractor may request an annual adjusbnent to the
maximum rates shown in Exhibit 4. The Contractor shall submit its request in writing,
to be received by Oty in Person or via certified mail or by other means approved by the
aty, by the preceding March 30, and shall be based on the method of adjustment
described in Section 6.4. Failure to submit a written request by March 30 shall result in
Contractor waiving the right to request such an increase for the subsequent Rate Year.
