BACKGROUND In 2010, the City Council approved the Marymount College Campus Master Plan with Athletic Field Alternative No. D-2. The approval allowed construction of a new athletic field on the western portion of the campus adjacent to Palos Verdes Drive East since the existing athletic field on the eastern portion of the campus was to be replaced by an expanded parking lot. The approved athletic field was to be flanked by four tennis courts with two on the west side of the proposed athletic field to serve as an additional buffer between the athletic field and the Palos Verdes Drive East roadway. The Council also approved 30-foot high retractable netting on the southern, western and northern sides of the athletic field which would be lowered at the conclusion of recreational activities involving balls to reduce the visual impacts of the netting to surrounding residents. The original EIR and Alternative D, which analyzed different athletic field alternatives, was certified by the City Council in June 2010. On October 29, 2012, Marymount California University submitted Conditional Use Permit Revision 'F', a request to modify the configuration of the Council-approved athletic field and 1-1 MEMORANDUM: Revised Draft Mitigated Negative Declaration, Marymount Athletic Field Expansion Project January 21, 2014 Page 2 to amend certain conditions of the 2010 approved CUP not related to the athletic field. On January 25, 2013, the University submitted additional information, including a Variance Revision application to revise the Council-approved location of the proposed 30-foot tall athletic field netting. On April 16, 2013, the City Council approved a Professional Services Agreement with Rincon Consultants, Inc., to prepare the necessary documents for the City that would assess the environmental impacts of the University's request to reconfigure the 2010 Council-approved Athletic Field. The envir.onmental assessment was completed by the City's CEQA consultant, which concluded that the proposed project may result in some significant environmental impacts unless certain mitigation measures are implemented. Accordingly, a Mitigated Negative Declaration (MND) was prepared and released for public comment on October 31, 2013. On October 31, 2013, a Notice of Intent (NOi) to Adopt a Mitigated Negative Declaration was issued informing the public that a Draft Initial Study/Mitigated Negative Declaration (IS/MND) was prepared and released for public comment regarding Marymount's CUP- Revision request to modify the athletic field and other specific conditions of the CUP that were approved by the City Council in 2010. The text of the Draft IS/MND released to the public referred to visual simulations prepared for the project, identified as figures 8 through 11 b. In producing the electronic and paper versions of the Draft IS/MND, the City's environmental consultant inadvertently left out the figures themselves. In addition, two of the original mitigation measures were inadvertently left out of the document. In light of these omissions, the Draft IS/MND document was updated by inserting the missing View Simulations (Figures 8 through 11 b) and Mitigations Measures TR-8 and TR-9 (in the MMRP), and the original 43-day public comment period forthe Draft IS/MND that began on October 31, 2013 and was set to end on December 13, 2013 was extended for an additional 42 days to January 24, 2014. Furthermore, the opportunity for the public to provide verbal comments on the Draft IS/MND at a public meeting before the City Council was moved from Tuesday December 3, 2013, to Tuesday January 21, 2014. To alert the public of the date change and the revised Draft IS/MND document, Staff mailed updated Notices to all property owners within 500-feet, and sent a Listserve message to those signed up on the City's Listserve system for this project. PROJECT DESCRIPTION On October 29, 2012, Marymount California University submitted an application for Conditional Use Permit Revision 'F', a request to modify the configuration of the Council- 1-2 MEMORANDUM: Revised Draft Mitigated Negative Declaration, Marymount Athletic Field Expansion Project January 21, 2014 Pa e 3 approved athletic field and to amend specific conditions. The proposed changes include the following: • Eliminating the four approved, but not yet constructed, tennis courts on the western side of the campus in order to accommodate a larger athletic field; • Expanding the size of the athletic field in order to allow for multiple recreational uses and to allow for National Association of Intercollegiate Athletics (NAIA) sanctioned soccer matches; • Changing the finish grades of the athletic field by 1.4-feet and the approved grading quantities resulting in a total of approximately 19,225 cubic yards of export; • Using synthetic turf on the athletic field instead of natural grass; and, • Allowing up to three events with amplified sound, rather than one event with amplified sound. It is important to note that on September 30, 2013, Phase 1 of the Marymount Facilities Expansion project approved by the City Council in June 2010 expired. Phase 1 included, among other things, the construction of a new athletic field. The current application to reconfigure the 2010 approved athletic field was submitted to the City in October 2012, prior to the expiration of Phase 1. Thus, notwithstanding the expiration of Phase 1, the applicant has the ability to construct an athletic field if the currently requested CUP amendment is approved by the City Council. DISCUSSION ENVIRONMENTAL ASSESSMENT Although a previous Environmental Impact Report (EIR) was prepared for the proposed master plan approved by the City Council in 2010, CEQA limits preparation of a subsequent EIR to certain situations. According to the CEQA Guidelines, a subsequent negative declaration or mitigated negative declaration (MND) may be adopted in lieu of a subsequent EIR where none of the situations described in subsection (a) have occurred. Specifically, CEQA states: (a) When an EIR has been certified or a negative declaration adopted for a project, no subsequent EIR shall be prepared for that project unless the lead agency determines, on the basis of substantial evidence in the light of the whole record, one or more of the following: (1) Substantial changes are proposed in the project which will require major re:visions of the previous EIR or negative declaration due to the involvement 1-3 MEMORANDUM: Revised Draft Mitigated Negative Declaration, Marymount Athletic Field Expansion Project January 21, 2014 Page 4 of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; (2) Substantial changes occur with respect to the circumstances under which the project is undertaken which will require major revisions of the previous EIR or Negative Declaration due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; or (3) New information of substantial importance, which was not known and . could not have been known with the exercise of reasonable diligence at the time the previous EIR was certified as complete or the Negative Declaration was adopted, shows any of the following: (A) The project will have one or more significant effects not discussed in the previous EIR or negative declaration; (B) Significant effects previously examined will be substantially more severe than shown in the previous EIR; (C) Mitigation measures or alternatives previously found not to be feasible would in fact be feasible, and would substantially reduce one or more significant effects of the project, but the project proponents decline to adopt the mitigation measure or alternative; or (D) Mitigation measures or alternatives which are considerably different from those analyzed in the previous EIR would substantially reduce one or more significant effects on the environment, but the project proponents decline to adopt the mitigation measure or alternative. As demonstrated throughout the MND, no new significant environmental effects or substantial increases in the severity of significant effects previously identified in the prior EIR have been identified as a result of this proposed project. Therefore, the conditions in the aforementioned CEQA sections have not occurred. There is also no new information which was not known at the time the previous EIR was certified which shows that there are new significant effects or more severe significant effects. There were no infeasible mitigation measures or alternatives discussed in the previous EIR which would now be feasible that would reduce a significant effect of the proposed project and there are no mitigation measures or alternatives considerably different than those analyzed in the previous C~rtified Final EIR which would substantially reduce one or more significant effects on the environment which the project proponents decline to adopt. The conditions in Section 15162(a)(3) have not occurred. 1-4 MEMORANDUM: Revised Draft Mitigated Negative Declaration, Marymount Athletic Field Expansion Project January 21, 2014 Page 5 Therefore, since none of the above situations have occurred, a subsequent negative declaration may be prepared and adopted. DRAFT MND ANALYSIS AND CONCLUSIONS In accordance with the provisions of the California Environmental Quality Act (CEQA), an Initial Study was prepared to assess the project's environmental impacts (see attached Draft Initial Study/Mitigated Negative Declaration). As indicated in the Draft IS/MND document, the project will not cause or create any significant impacts, or will have less than significant impacts to Agriculture/Forest Resources; Cultural Resources; Greenhouse Gas Emissions; Hazards/Hazardous Materials; Land Use/Planning; Mineral Resources; Population and Housing; and Recreation. However, the Initial Study identified that the project may create potentially significant impacts to Aesthetics, Geology and Soils, Hazards and Hazardous Materials, Hydrology and Water Quality, Noise, and Transportation and Traffic, unless mitigated with appropriate measures. These potential impacts and the associated mitigation measures are discussed below. Incorporation of the mitigation measures will result in a less than significant impact. The impacts and mitigation measures related to these environmental factors are contained in the Draft MND document with attached Appendix G (Mitigation Monitoring and Reporting Program) serving as a summary of all mitigation measures to address each of the environmental factors found to be significant unless mitigated. The conclusions of the impact analyses for these factors are summarized as follows: • Aesthetics The Draft MND identifies visual impacts that may arise as a result of the revised athletic field expansion. These visual impacts are associated with the change from an undeveloped area of the campus and its associated appearance, to a developed appearance. The Draft MND concludes that mitigation measures can reduce the impacts to a level of less than significant. Mitigation measures are being considered that would reduce these visual impacts to less than a significant level (the analysis can be found on pages 19 through 34 in the Draft MND). • Air Quality The Draft MND identifies impacts relating to air quality primarily based on short-term impacts resulting from project construction. In terms of these short-term impacts, the Draft MND states that air quality impacts would be less than significant with incorporation of mitigation measures identified in the Certified EIR, which are being 1-5 MEMORANDUM: Revised Draft Mitigated Negative Declaration, Marymount Athletic Field Expansion Project January 21, 2014 Page 6 modified for the proposed athletic field project as appropriate. The air quality analysis can be found on pages 36 through 45 in the Draft MND. • Biological Resources The Draft MND identifies potential impacts to special status plants or wildlife species, wetlands or riparian habitat. However, with the implementation of mitigation measures identified in the Certified EIR, which are being modified for the proposed athletic field project as appropriate, impacts are expected to be less than significant. The biological resources analysis can be found on pages 46 through 58 in the Draft MND. • Geology and Soils The Draft MND evaluates geologic and soil conditions in terms of slope stability, erosion, soil contamination, faulting and seismicity, liquefaction, and bedrock subsidence. Based on historical reports and the previous Certified EIR, the Draft MND identifies that with the implementation of recommended mitigation measures, the impacts identified could be reduced to a less than significant level. The discussion can be found on pages 60 through 64 in the Draft MND. • Hydrology and Water Quality The Draft MND evaluates potential impacts on hydrology, water quality and water supply as it relates to existing conditions and changes resulting from the project. The Draft MND also evaluates the conditions relating to hydrology and water quality on a short-term (construction-related) and long-term (operational) basis. Mitigation measures are recommended that are intended to reduce the impacts to a level that is less than significant. Such mitigation measures deal with construction related impacts, measures to minimize discharge impacts and stormwater treatment. The hydrology and water quality discussion can be found on pages 68 through 76 in the Draft MND. •Noise The Draft MND evaluates potential impacts relating to noise on a short-term (construction impacts) and long-term operational basis. The analysis describes existing noise conditions within the project area and estimates future noise levels based on noise modeling. Based on the analysis conducted, the Draft MND concludes that both long-term and short-term noise impacts can be mitigated to less than significant, which includes limitations on construction and operational activities. The noise analysis can be found on pages 78 through 89 in the Draft MND. 1-6 MEMORANDUM: Revised Draft Mitigated Negative Declaration, Marymount Athletic Field Expansion Project January 21, 2014 Pa e 7 • Public Services The Draft MND identifies a potentially significant impact upon police protection; however, with the continued requirement of a private security program, this impact is reduced to less than significant. The public services discussion can be found on pages 90 through 91 in the Draft MND. • Traffic and Circulation The Draft MND evaluates the potential for the proposed project to result in significant impacts on traffic and circulation during construction and operation, including the local and regional roadway system, intersections, and ingress/egress to the project site entrance. The analysis contained in the Draft MND is based on a project traffic study prepared by Linscott, Law and Greenspan Engineers (See Appendix E in the Draft MND). It is important to note that the traffic study also included trip generation estimates that account for spectators at NAIA soccer activities. Mitigation measures continue to be included that would reduce traffic and circulation impacts to less than significant. The traffic and circulation discussion can be found on pages 92 through 104 in the Draft MND. • Utilities/Service Systems The Draft MND evaluates the potential forthe proposed project to result in significant impacts on utilities and service systems. For the previously approved athletic field, solid waste impacts were found to be significant but mitigatable. The current Draft MND also concludes that the project will result in a less than significant impact. The utilities and service systems discussion can be found on pages 104 through 109 in the Draft MND. DRAFT MND COMMENT PERIOD The Draft MND is currently being circulated for public review and comment for 85 days, which is substantially longer than the minimum 30-day review period required by CEQA. The Draft MND became available on October 31, 2013 for a 43-day period, but was extended an additional 42 days due to missing visual simulations and mitigation measures that were inadvertently left out. Thus, the comment period will conclude on Friday, January 24, 2014. u.ntil then, all interested agencies and parties, and the general public have the opportunity to provide written comments on the content of the Draft MND. In addition, the public has an opportunity this evening to provide oral comments on the Draft MND in a 1-7 MEMORANDUM: Revised Draft Mitigated Negative Declaration, Marymount Athletic Field Expansion Project January 21, 2014 Page 8 public forum. All written comments received by the City will be given equal consideration as any oral comments received this evening. All written comments and oral testimony received during the comment period will be provided to the City's environmental consultant for response in the Final MND, and separate notice will be provided for a future City Council meeting where the City Council will review the Final MND and consider the proposed project. Staff anticipates bringing the Final MND and consideration of the associated CUP Revision request before the City Council in March 2014. Lastly, as indicated above, the Draft IS/MND has been circulating for comments since October 31, 2013, and has also been available on the City's website. Notice and document were distributed to all Responsible Agencies, as well as other agencies; the Notice was mailed to the 162 property owners within a 500-foot radius; the 687 emails registered on the listserve for this project; and posted the Notice on the City's website. Seven written comment letters have been received thus far from persons, agencies, or organizations in response to the noticed Draft IS/MND. The following agencies and organizations have provided comments: • County of Los Angeles Fire Department • Native American Heritage Commission • California Department of Fish and Wildlife • Los Angeles County Public Works The remaining three comments were received from individuals who reside in the City of Rancho Palos Verdes. CONCLUSION The role of the City Council at the comment session is to provide a forum for the public to provide verbal comments on the Draft MND. No decision or recommendation on the project applications will be made at the meeting. Therefore, comments on the merits of the project should be held until the public hearing(s) on the project are conducted. Such hearings will be held afterthe completion of the Final MND, most likely in March 2014. All interested parties will be notified of those hearings in the same manner by which this comment meeting was advertised. ATTACHMENTS • Appendix G, Mitigation Monitoring and Reporting Program • Marymount Athletic Field Expansion Project Revised Draft MND (provided under separate cover in November 2013) 1-8 Marymount Athletic Field Expansion Project IS-MND Mitigation Monitoring and Reporting Program MITIGATION MONITORING AND REPORTING PROGRAM INTRODUCTION The California Environment Quality Act (CEQA) was amended in 1989 to add Section 21081.6, which requires a public agency to adopt a monitoring and reporting program for assessing and ensuring compliance with any required mitigation measures applied to proposed development. As stated in Section 21081.6 of the Public Resources Code: ". . . the public agency shall adopt a reporting or monitoring program for the changes to the project which it has adopted, or made a condition of project approval, in order to mitigate or avoid significant effects on the em1ironment." Section 21.081.6 provides general guidelines for implementing mitigation monitoring programs and indicates that specific reporting and/ or monitoring requirements, to be enforced during project implementation, shall be defined prior to final certification of the EIR. The mitigation monitoring table below lists those mitigation measures that may be included as Conditions of Approval for the Project. To ensure that the mitigation measures are properly implemented, a monitoring program has been devised, which identifies the milestone and responsibility for monitoring each measure. The Applicant will have the responsibility for implementing the measures, and the various City of Rancho Palos Verdes departments will have the primary responsibility for monitoring and reporting the implementation of the mitigation measures. The Mitigation Monitoring and Reporting Program (MMRP) was revised to reflect the analysis provided for the Athletic Field Expansion Project. City of Rancho Palos Verdes 1-9 Marymount Athletic Field Expansion Project 15-MND Mitigation Monitoring and Reporting Program MARYMOUNT ATHLETIC FIELD EXPANSION PROJECT MITIGATION MONITORING AND REPORTING PROGRAM Please note that many of these mitigation measures are unique to the Athletic Field Expansion Project, as they were modified or added specifically to address potential impacts of the proposed revisions to the configuration of the athletic field. Others have been carried over from the Certified Final EIR with no changes. The suffix "AF" (for Athletic Field) has been added to all measures that apply to the Athletic Field Expansion Project. The measures that would apply to the proposed athletic field only do not supersede or replace previous mitigation measures identified for the Master Plan project as a whole. LAND USE AND RELEVANT PLANNING City of Rancho Palos Verdes Development Code LU-1 An Athletic Associations I Yes Membership Report shall be prepared and submitted by the Applicant for review and approval by the Community Development Director, by July 1st of every year. Recreational activities requiring the use of said net shall be prohibited on Sundays and the Federal holidays listed in the RPVMC, unless a Special Use Permit is obtained. The use of the retractable net shall be prohibited during hours of non-play. Liaht and Glare AES-6 Lighting shall be designed as an integral part of the Project. Lighting levels shall respond to the type, intensity and location of use.
