CC SR 20151104 D - Construction Contract for Sunnyside Ridge Trail Segment ProjectCITY OF MEMORANDUM TO: HONORABLE MAYOR & CITY COUNCIL MEMBERS FROM: MICHAEL THRONE, DIRECTOR OF PUBLIC WORKS t{O DATE: NOVEMBER 4, 2015 SUBJECT: AWARD CONSTRUCTION CONTRACT FOR CONSTRUCTION THE SUNNYSIDE RIDGE TRAIL SEGMENT PROJECT-REVISED SCOPE (SUPPORTS 2014 CITY COUNCIL GOAL #2, INFRASTRUCTURE) REVIEWED: DOUG WILLMORE, CITY MANAGER ~ Project Manager: Andy Winje, Senior Engineer~ RECOMMENDATION 1. Adopt the revised project plans and specifications on file in the Public Works Department for the Sunnyside Ridge Trail Segment Project-Revised Scope. 2. Award a construction contract to Concept Consultant, Inc. in the amount of $290,864 for the base bid items, and authorize Staff to utilize an additional $30,000 (about 10%) for project contingency. 3. Authorize the Mayor and City Clerk to execute the agreement. FISCAL IMPACT Budgeted Amount: Encumbered to Date: Construction Contract Contingency Fund Balance $ 465,000 $ 140,450 $ 290,864 $ 30,000 $ 3,686 Account Number(s): 330-3033-461-73-00 EXECUTIVE SUMMARY The awarding of this contract will permit construction of the Sunnyside Ridge Trail Segment to begin in its redesigned format. The scope was revised after bids received 1 Award Contract for Sunnyside Ridge Trail Segment -Revised Scope November 4, 2015 Page 2 of 3 earlier all exceeded available funding and were rejected by the City Council. The project was re-scoped to include only the portions of the project at each end of the trail easement (trail entrances, trail and walls between homes, drainage) in the base bid. Construction of the alternate items (improved trail segment through the canyon and the bridge) is not included in the recommendation due to cost exceeding the approved appropriation. BACKGROUND On July 7, 2015 the City Council approved the design of and authorized Staff to advertise bid documents for the Sunnyside Ridge Trail Segment Project. The first round of bids was determined to significantly exceed the available budget and City Council rejected all bids and directed staff to re-scope the project with only essential elements (trail entrances, trail and walls between homes, drainage) in a base bid. The latest bid advertisement included a base bid to construct the trail entrance and short length of trail in the north side of the project (off Palos Verdes Drive East) and the trail entrance, trail and retaining walls between the homes, drainage under the trail and some landscaping on the south end (Sunnyside Ridge Road) of the project. Alternate bid items to complete the additional length of trail and walls in the canyon section and a bridge over the streambed were included in the event the bids came in low enough to make this work affordable. DISCUSSION Bid Analysis The project was re-scoped and advertised as directed by the City Council. After the required advertising period was completed, bids were received and opened on October 22, 2015. Concept Consultant, Inc. submitted the lowest responsive bid out of the three bids received. The following table summarizes the bids received (for the base bid items only): BASE BID SUMMARY Construction Companies Bid Amount Concept Consultant, Inc. $290.864.00 GRFCO, Inc. $323,940.00 Minco Construction $366,230.00 Enqineer's Estimate $304, 300. 00 Staff has verified Concept Consultant, lnc.'s references and found their past performance on jobs of similar size and scope to be satisfactory and their contractor's license is current. Alternate Bid Items As part of the bid package, the City asked each contractor to provide proposals for alternate bid items, including development of an improved trail in the steeper canyon portion of the parcel and the installation of a foot bridge across the canyon bottom. The low bidder, Concept Consultant, Inc., proposed a cost of $575,860 for these items, which 2 Award Contract for Sunnyside Ridge Trail Segment -Revised Scope November 4, 2015 Page 3of3 would increase the contract value to $866, 724. Staff recommends against these alternate items because they are not affordable. The City Council would need to appropriate additional funds to pay for these additions to the scope. Work on and Protection of Private Property As designed, a portion of the project will be built on private property located at 2443 Sunnyside Ridge Road. A retaining wall will be built to replace an existing wall built by the owner of that property. A formal agreement with the owner of the property is required to allow the City's contractor to access and build on private property. A License Agreement is being negotiated with the owner for temporary access to construct the retaining wall. Because the wall is being built on private property and because it is replacing his existing wall, the property owner has asked for ownership of the new wall after it is completed. Staff recommends this and is working to secure terms of maintenance in the License Agreement that will run with the property, in order to ensure the wall is adequately maintained in perpetuity. The City Council has also indicated its intent to protect the privacy of the property owner by installing a chain-link fence along portion of the parcel's western property line. Construction of this fence is not included in the bid from Concept Consultant, Inc. and will be performed under a separate agreement with a fencing contractor. Bid Protest We received a bid protest from GRFCO, Inc. on October 26, 2015. The assertion is that the low bidder had failed to identify a substantial subcontractor (performing more than % of 1 % of the work) on their bid, which is a violation of the California law. After investigating the basis for the protest, Staff found the claims therein to be unsubstantiated because the work in question (surveying) will be performed by the subcontractor to a subcontractor who was listed. These so called second-tier subcontractors are not required to be identified on the bid. Therefore, Staff has determined it can reject the bid protest and proceed with the recommendation to award to the lowest bidder, Concept Consultants Inc. Staff has notified all bidders of our determination. CONCLUSION Adopting Staff's recommendations will award a construction contract to Concept Consultant, Inc. in the amount of $290,864 and authorize staff to utilize about 10% of the contract amount ($30,000) as contingency for unforeseen circumstances. Construction is expected to begin in November 2015 and be completed in 2016 as weather permits. The City Attorney has reviewed and approved in form the construction (public works) agreement. The recommended action will result in a total project authorized expenditure of $320,864. Funding for the project is included in the Capital Improvements Program of the FY14-15 budget, and was carried forward in the continuing appropriations approved by City Council earlier this year. At the expense of Contractor, Contractor may direct the investment of the payments into securities, and Contractor shall receive the interest earned on the investments upon the same terms provided for securities deposited by Contractor. Upon satisfactory completion of the Agreement, Contractor shall receive from the escrow agent all securities, interest, and payments received by the escrow agent from the City, pursuant to the terms of this Section. Additionally, Contractor shall be subject to State Auditor examination and audit at the request of the City or as part of any audit of the City, for a period of three (3) years after final payment under this Agreement. 11. Unresolved Disputes. In the event that a dispute arises between the City and Contractor regarding whether the conditions materially differ, involve hazardous waste, or cause a decrease or increase in Contractor's cost of or time required for performance of any part of the work, Contractor shall not be excused from any scheduled completion date provided for by the Agreement, but shall proceed with all work to be performed under the Agreement. Contractor shall retain any and all rights provided that pertain to the resolution of disputes and protests between the parties. In the event of any dispute or controversy with the City over any matter whatsoever, Contractor shall not cause any delay or cessation in or of work, but shall proceed with the performance of the work in dispute. This includes disputed time extension requests and prices for changes. The disputed work will be categorized as an "unresolved dispute" and payment, if any, shall be as later determined by mutual agreement or a court of law. Contractor shall keep accurate, detailed records of all disputed work, claims and other disputed matters. Contractor shall reimburse lndemnitees for any and all legal expenses and costs incurred by each of them in connection therewith or in enforcing the indemnity herein provided.
