EXECUTIVE SUMMARY:
Staff presents a review of the City’s film permit regulations and procedures in response
to a request from Mayor Brooksin October 2017.The review includes recommenda-
tions regarding future requests for filming on Rancho Palos Verdes Beach. Staff also
recommends conducting a public hearing to consider and adopt a cancellation fee to
film permit applications.

BACKGROUND AND DISCUSSION:
“Slim’s Revenge,” October 2-5, 2017
On October 3, 2017, Mayor Brooks asked for the review of the City’s film permit
regulations and procedures to be agendized for City Council discussion. This request
was triggered by concerns and comments expressed by residents (Attachment B)
regarding a permit issued for filming on the City’s Rancho Palos Verdes Beach and the
adjacent private beach at the Portuguese Bend Club (PBC) onOctober 2-5, 2017
(Attachment A).
OnMay 30, 2017, Staff was initially contacted by the production company for the HBO
show “Westworld” about filming scenes on Rancho Palos Verdes Beach(RPV Beach),
which is the City-owned beach located directly below Founders Park that the City
acquired as a part of the Ocean Trails (now Trump National Golf Club) project. Staff
discouraged the producers from using RPVBeach, largely because of the lack of
vehicular access to the beach. HBO eventually submitted its film permit application
(code-named “Slim’s Revenge”) on September 11, 2017, proposing to film on RPV
Beach by taking access from the adjacent private beach at the Portuguese Bend Club
(PBC). The application proposed two (2) prep days on Monday, October 2, 2017, and
Tuesday, October 3, 2017; a filming day on Wednesday, October 4, 2017; and a
strike/clean-up day on Thursday, October 5, 2017. The scenes being shot involved
simulated military maneuvers on the beach. There were members of the City’s
Recreation and Parks Department assigned to monitor the filming activity on each day
that RPV was used by the production.
On the secondday of the shoot, Staff received a complaint about the use of the City’s
beach. Reports from the City Staff monitoring the shoot confirmed that filming was
being conducted in accordance with the approved permit. The public was only
prevented from accessto the beach on the filming day (October 4, 2017), but was
otherwise allowed to pass by the location when no actual filming was occurring. On
October 5, 2017, City Staff monitoring the shoot confirmed that RPV Beach was being
cleaned up, which is confirmed by the photos below.

A number of additional complaints were received after filming completed, expressing
concern about the physical impact of the production upon both RPV Beach and PBC’s
beach.However, Staff believes that the production did a thorough job cleaning up the
location, and any remaining tire tracks or other visible evidence was quickly erased by
the wind and tides.
As mentioned above, Staff tried to dissuade HBO from filming on the RPV Beach due to
its lack of vehicular access.With the cooperation of PBC, however, the production was
able to get its vehicles, equipment and sets toand from the area of RPV Beach where
they wanted to film. There has only been one other film shoot permitted on RPV Beach
since the City took title to the property, and it also presented logistical challenges with
respect to accessfor the cast/crew and equipment.Staff believes that the access
challenges for RPV Beach make it fundamentally unsuitable for filming. Therefore, with
the City Council’s concurrence, Staffintends to prohibit future filming activity at RPV
Beach.
Other Film Permit Issues
The City Council last reviewed the City’s film permit regulations and procedures in 2015
(Attachment C).At that time, the City Council adopted increased daily use fees for
filming on City property. Since 2015, the amount of filming at City parks and beaches
(primarily Abalone Cove Shoreline Park) has dropped dramatically.
In 2015, Staff indicated that the administrative instructions for film permits were out of
date and needed to be revised. Since then, the City’s new permitting software, Trakit,
has been implemented, allowing film permits to be issued electronically and providing
an opportunity for Staff to re-assess the business processes associated with film permit
issuance. Staff intends to finish updating the administrative instructions for film permits
by the end of the current fiscal year.
Film Permit Cancellation Fee
Every year, there are film permit applications submitted to the City that are canceled by
their applicants at some point before they were ready to issue. In 2017, for example,

sixteen (16) of the fifty-six (56) film permit applications filed with the City were canceled
before they were issued. In many instances, applicants expected to be charged a
cancellation fee, but there is no such fee in the City’s current fee schedule. In addition,
with the implementation of Trakit, Staff is now required to manually enter a great deal of
information into the permit system for each application submitted. Therefore, in order to
at least partially recoup the City’s costs for work done by Staff on film permit
applicationsthat are ultimately canceled, Staff recommends the adoption of a Film
Permit Cancellation Fee (Fee).
Staff recommends that the Fee would be the greater of one hundred dollars ($100.00)
or one-half of the Film Permit Application Fee, which varies by the type of production
and its location on public or private property. Currently, the City charges one-half of the
Film Permit Application Fee as a Revision Fee for change to a film permit after it’s
issued. However, the entire fee is currently refunded to the applicant if the permit is
cancelled, even though Staff time has been expended to process the permit.
Furthermore, the fully-burdened rate for the Senior Administrative Analyst in the City
Manager’s Office—who serves as the City’s Film Permit Coordinator—is over
$150.00/hour. Staff believesthat the proposed Fee reflects the cost for an hour of Staff
time for the initial review and entry of film permit applications into Trakit. Staff further
recommends that the Fee would be charged only when a film permit application is
canceled more than one (1) business day after it is submitted to the City.
The draft resolution reflects the proposed Fee (Attachment D). If adopted, it would
become effective after sixty (60) days.
CONCLUSION:
In conclusion, Staff recommendsthatthe City Council:
Concur with Staff’s suggested prohibition against the future issuance of film
permits for Rancho Palos Verdes Beach;
Direct Staff to complete revisionsto the administrative instructions for film
permits; and;
Adopt the draft resolution to establish a FilmPermit Cancellation Fee.
ALTERNATIVES:
In addition to the Staff recommendations, the following alternative action is available for
the City Council’s consideration:

First item: Palos Verdes Artificial ReefProject
Background
In year 2000, Montrose Chemical and other defendants settled a lawsuit for their part in
dumping DDT,PCBs, and other chemicalsfrom the 1940’s thru the early 1970s.
$140M settlement
About half the money when to the California Department of Toxic Substances Control
The other halfwent into a fund, managed by 6 trustees, including National Oceanic and
Atmospheric Administrationand California State Lands Commission, known as the
Montrose Settlement Restoration Program.
These funds were earmarked to be used for projects to restore habitat and species
endangered by the dumping of the DDT and other chemicals.
A number of projects already completed, some very successful
For example, bald eagle and peregrinefalcon habitat on offshore islands has been
successfully restored
Another example is the removal and relocation of sea urchins that were wiping out kelp
forests off of Palos Verdes. This started in 2013 and has also been very successful.
Remind council and public about this specific project
One of the last projects is a proposal to construct a series of reefs justoff the coast of RPV,
in front of Trump National Golf Course.
This is not intended to reduce beach erosion or slow the Portuguese Bend landslide.
NOAA claims this is to “restore rocky reef habitat that was buriedby sedimentationfrom
nearby landslides, thereby providing essential fish habitat and substrate for kelp, other
marine algae, and marine invertebrates.”
Note in this statement the reefs were not damaged necessarily by DDT and other chemicals,
but by landslides.

NOAAheld a public meeting in 2012 with a very general overview of the project

RPV City Council at that time wrote a letter supportingthe urchin removal project, and
supporting the general concept of the reef project subject to further details and scientific
evidence supporting its success.
Interestingly, Heal the Bay opposed the projectback in 2012, siting a variety of
environmental concerns.
There was little, if any,public discussion about the project from 2012 untilearlier this year.

In February 2017, NOAA published a191 page Environmental Assessmentreport for this
project, where some more specific details of the project were revealed.

Many letters of opposition to this project were written by local residents, surfers, and ocean
enthusiasts, siting a variety of significant concerns.
Trump National wrote a letter opposing the project.
Environmental groups, such as Heal the Bay, wrote letters opposing the project.
After reviewing more details of the actual project, this City Council also wrotea letter
opposing this project, and I want to thank and commend thisCouncil for doing that.
When the agenda for the CSLC’s April meeting came out, this item was mysteriously
missing.
I called the CSLC and was told that indeed the item had been pulled from the agenda, and
they could not give me any information as to when this would be placed on a future agenda.
No updates have been provided since March.
Latest News
Out of the blue, last week NOAA announced that there will be a public meeting on October
11 at 6:00 p.m. at Malaga Cove Library.
Quoting directly from their flyer, this meeting is for the public to “receive an update on the
project and an overview of the Trustees responses to the public comments received.”
They go on to note that the public comment period closed on March 22, 2017. This implies
that they will no longer receivecomments, only provide response to previous comments.
I am not sure about the council, but I wrote two letters and never received any response
from the trustees.

I am interested to know what the net income the city expects to receive for this three days of
filming. Be sure to consider the costs of on site city staff, administrative costs, paperwork, etc. If
you don’t have an exact number, an approximate number would be fine for now. I am just curious
how much the city receives in net income in return for the renting out of a public beach for
essentially the private use by a film crew and their staff.

Thanks Kit.
Yesterday afternoon, a resident of PBC posted some disturbing pictures of large ruts and disturbance
to the beach between PBC and Halfway Point. I went down to the public portion that was
supposedly open and took some pictures (standing completely outside the area shown as being
closed in the City Managers report). One such picture is attached, I have many more. Film crews
asked me to move, as I was in the “background” of their scenes. I complied (even though I feel the
film crew had no right to make me move). I spoke to on site city staff (“Devon”), who was very

The point is that there has been some activity on Next-door on this topic and somehow I doubt the
questions about the film permitting process will go away anytime soon. Again, I realize you are

Extended hours fees are charged for filming activity outside of the City’s regular days and hours (i.e.,
7:00 AM to 7:00 PM, Mondays through Saturdays). The City collects $25.00/hour/City Staff member
for Recreation & Parks Dept. Staff who are assigned to monitor filming on City property. The
production company is required to obtain a City business license.
This production was also required to obtain permits from the Los Angeles County Fire Department’s
Public Safety & Film Unit (due to the size of the production, use of special effects, etc.), and to have
a County lifeguard on set on the City’s beach. The City does not process or collect the fees for these

you don’t have an exact number, an approximate number would be fine for now. I am just curious

5th at RPV Beach. The City issued a permit allowing the film crew to close *all* public access to the public portion of the
beach for three days, and allowing heavy equipment and 4 wheel drive vehicles to run around, ocean vessels to land on

the shore, etc. Many of you might be wondering how much money the city gets for this kind of activity. I checked with the
city and have found out the gross income to the city for this particular three day event is a mere $11,835. If you subtract
the direct costs the city incurs for administrative functions, on-site staff presence, etc., the net income to the city is
$9,802, or about $200/hour for the 49 hours of use on the permit. Personally, I value this beach much more than this,
and am appalled that our City would allow this this type of destructive activity on public property, no matter what the
income.

I understand you have been receiving questions regarding the filming at the beach that took place this week. The details of the filming
were in the weekly administrative report dated Sept. 27, 2017 (http://www.rpvca.gov/ArchiveCenter/ViewFile/Item/2291). In addition,
this information was posted on Next Door and Facebook the same week. Aside from Gary Randall and a few people asking what was
being filmed, there was no response to these postings.
We completely understand the residents’ concerns about protecting the environment and generally discourage filming activity from that
beach to reduce impacts to the beach and trails, by requiring access to the beach through the Portuguese Bend Club. Most film
companies opt to move to a different site, but this production was large enough that they wanted to proceed with this location and were
willing to pay for the additional requirements. As part of the conditions, the company was also not allowed in the tidepool area. Staff was
monitoring the filming and frequently reported back, as well as Kit examining the area himself yesterday, to make sure the company was
abiding by the conditions and everything was picked up. We anticipate the normal wave and tidal action will eliminate the tire tracks and
any ruts. It is extremely rare that we have a film shoot of this magnitude and of a more violent nature, and the unfortunate timing with it
occurring immediately after the tragic shooting in Las Vegas; however, this film shoot was planned several months in advance.
Attached is a copy of the film permit related to this filming for your reference – please do not share the confidential financial info like the
copies of checks, etc. Staff will provide more information about filming activities in general in a future staff report. Please let us know if
there is any more information you need.

I am a 48 year resident of palos verdes. I work in the film industry. I am actually stuck in georgia for a few months
because hollywood is chasing the tax rebates. I would like to stay home and see the work stay come back home.
BUT if filming occurs they must leave the location as they found it. I am shocked that such a mess was left behind
by the film crew. They need to repair the landscape, not pollute the location. I am hoping this mess is an exception
to the crews that film in our city.
Doesnt the city inspect the grounds pre wrap? we must guard our city, perhaps the permitting dept should have such
a person inspect before and after locations.

In this instance, the filming on the City's beach was monitored by City Staff during prep, shoot and strike activities
over 3 days. The reports that I received from our Staff monitors indicated that the filming was conducted in
accordance with the approved film permit. I also visited the location late in the morning on the strike day, by which
time most of the props, sets and equipment had been packed up or already removed from the beach. My
observation at that time was that, aside from some tire tracks in the dry sand, the beach looked as it had prior to the
filming.

RANCHO PALOS VERDESAMENDING RESOLUTION
NO.2010-77TO ADD A CANCELLATION FEE FOR FILM
PERMIT APPLICATIONS TO THEMASTER SCHEDULE OF
FEES AND CHARGES FOR CITY SERVICES
WHEREAS,the City of Rancho Palos Verdes (“City”) is a general law city and a
political subdivision of the State of California; and,
WHEREAS,the City conducted an extensive analysis of its services,the costs
reasonably borne by the City in providing those services, the beneficiaries of those
services, and the revenues produced by those paying fees and charges for special
services for fiscal year 2008-2009; and,
WHEREAS,after conducting a public hearing, the City adopted Resolution
No.2010-77, therebyadopting a Master Schedule of Fees and Charges for City services
(the “Master Fee Schedule”); and,
WHEREAS, when a film permit is cancelled by an applicant, the entire application
fee is returned to them; and,
WHEREAS, the City Council desires to add a cancellation fee for film permit
applications as follows:

Resources Code Sections 21080 et seq.), pursuant to Public Resources Code Section
21080(b)(8)(A); and,
WHEREAS, all requirements of California Government Code Section 6062a are
hereby found to have been satisfied.
WHEREAS,pursuant to Section 66018 of the Government Code,the City prepared
a notice of public hearingto be held on April 3,2018, whichincluded the time and place
of the hearing anda general explanation of the matters to be considered at the public

hearing, specifically the proposed addition of the Film Permit Cancellation Feeto the
Master Fee Schedule(the “Notice of Hearing”); and,
WHEREAS,the Notice of Hearing was published in thePalos Verdes
Peninsula
onMarch 22, 2018, and March 29, 2018; and,

addtheFilm Permit Cancellation Fee.
NOW, THEREFORE,the City Council of the City of Rancho Palos Verdes does
resolve as follows:
Section 1:
The facts set forth in the recitals of this Resolution are true and
correct and are incorporated herein by reference as though set forth in full.
Section 2:
The City Council hereby makes the following findings:
A. Adoption of this Resolution amending Resolution No. 2010-77 establishes a fee
relating to the issuance offilm permitapplicationsand is, therefore, exempt from
the California Environmental Quality Act (Public Resources Code Sections 21080
.) pursuant to Public Resources Code Section 21080(b)(8)(A).

B.The City estimates that the initial review and entry of film permit applications into
its permit-tracking system pursuant to Chapter 9.16of the Rancho Palos Verdes
Municipal Code(“RPVMC”)will consume, on average, approximately one hour of

$100.00per hour. Therefore, a fee of $100.00or one-half of the film permit
application fee does not exceed the costto the City of processing the initial review
and entry of film permit applicationspursuant to Chapter 9.16of the RPVMC.
Section 3:
The City Council hereby approves and adopts aFilm Permit
Cancellation Fee equal to the greater of $100.00or one-half of the Film Permit Application
Fee, pursuant to Section 9.16.050of the RPVMC, to be assessed upon film permit
applications that are canceled more than one (1) business day after the application is
submitted to the City.
Section 4:
The City Council hereby approves and adoptsthe amendedMaster
Fee Scheduleattached hereto as Exhibit “A”,andhereby amends the relevant provisions
of Resolution No. 2010-77to adopt and incorporate the fees set by this Resolutioninto
the Master Fee Schedule.

MISCELLANEOUS:
ADDITIONAL FEES MAY APPLY FOR PUBLIC PROPERTY USE BY A PRIVATE ENTITY. PUBLIC PROPERTY INCLUDES FACILITIES, PARKS, PRESERVES, RESERVES, PARKING LOTS, ETC.
APPLICATION CHANGES:
ANY APPLICANT INITIATED APPLICATION CHANGE MAY RESULT IN A FEE OF ONE-HALF THE ORIGINAL APPLICATION FEE.
