A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES THEREBY FINDING THAT THE
VACATION OF A PORTION OF THE PUBLIC RIGHT-OF-WAY
ABUTTING PRIVATE PROPERTIES LOCATED AT 3807 AND 3825
CREST ROAD EAST IS CONSISTENT WITH THE CITY'S
GENERAL PLAN.
WHEREAS, on January 21, 2012, the property owners ("Applicants") of 3807 and
3825 Crest Road East submitted a written request for the City to consider vacating
portions of the public right-of-way immediately south of their properties;
WHEREAS, on August 16, 2016, the City Council, after considering evidence
introduced in the record, including information from the Applicants and City Staff,
unanimously initiated the process to vacate a portion of the public right-of-way immediately
adjacent to 3807 and 3825 Crest Road East as requested by the Applicants ;
WHEREAS, on January 22, 2018, the Traffic Safety Committee ("TSC") reviewed
the proposed request and unanimously agreed to recommend to the City Council that a
portion of the public right-of-way adjacent to 3807 and 3825 Crest Road East be vacated;
WHEREAS, pursuant to the provisions of the California Environmental Quality Act,
Public Resources Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines,
California Code of Regulations, Title 14, Section 15000 et seq., the City's Local CEQA
Guidelines, determined that the proposed project has been found to be statutory exempt
under Section 15268(a) (Ministerial Projects). Specifically, the project involves vacating a
portion of the City's public right-of-way to accommodate a future lot line adjustment;
WHEREAS, the Planning Commission held a public hearing on March 27, 2018, at
which time all interested parties were given an opportunity to be heard and present
evidence.
NOW, THEREFORE, THE PLANNING COMMISSION DOES HEREBY FIND,
DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: The Planning Commission hereby finds as follows that the location,
purpose, and extent of the public right-of-way vacation request is consistent with the Goals
and Policies of the City's General Plan:
A. The Applicants request to vacate a portion of the public right-of-way, adjacent to
their respective front property lines, measures 26' in width and approximately 358.7'
in length. The vacation request will reduce the width of Crest Road from 100' to 74'
in front of these two properties.

B. The area to be vacated and transferred, as part of a lot line adjustment, will be
designated Residential 1-2 du/ac, which is consistent with the Land Use
designations for the properties located at 3807 and 3825 Crest Road East.
C. The vacation request will eliminate existing non-conformities on the Applicants'
properties by increasing the front yards, and will increase the lot size of both
properties, resulting in an additional 3,231ft2 for a total lot size of 23,435ft2 for 3807
Crest Road, and an additional 6,058ft2 for a total lot size of 28,930ft2 for 3825 Crest
Road. The Applicants' lot size will remain in compliance with the Development
Code and compatible with the immediate neighborhood, thereby preserving and
enhancing the visual character and physical quality of the neighborhood.
D. The request will not affect the existing design or utilization of Crest Road East
because the existing public right-of-way is approximately 100' wide, of which
approximately 28' serves as a paved road, which remains adequate in size to allow
for safe and efficient passage of vehicular traffic.
E. The request will result in an additional 26' of on-site driveway area, which would
provide adequate off-street driveway parking.
Section 2: Any interested person aggrieved by this decision or by any portion of
this decision may appeal to the City Council. The appeal shall set forth in writing, the
grounds for appeal and any specific action being requested by the appellant. Any appeal
letter must be filed within 15 calendar days of the date of this decision, or by 5:30 PM on
Wednesday, April 11, 2018. A $2,275.00 appeal fee must accompany any appeal letter. If
no appeal is filed timely, the Planning Commission's decision will be final at 5:30 PM on
Wednesday, April 11, 2018.
Section 3: For the foregoing reasons and based on the information and findings
included in the Staff Report, Minutes and other records of proceedings, the Planning
Commission of the City of Rancho Palos Verdes hereby adopts P.C. Resolution No. 2018-
11, finding the vacation of a portion of the public right-of-way adjacent to 3807 and 3825
Crest Road East is consistent with the City's General Plan.
