CC SR 20150915 B - 20150901 CC MINS DRAFTDRAFT MINUTES RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING SEPTEMBER 1, 2015 The meeting was called to order at 6:00 P.M. by Mayor Knight at Fred Hesse Community Park, 29301 Hawthorne Boulevard, and was immediately recessed into Closed Session. The meeting reconvened at 7:03 P.M. City Council roll call was answered as follows: PRESENT: Brooks, Campbell, Duhovic, Misetich, and Mayor Knight ABSENT: None Also present were Doug Willmore, City Manager; Carol Lynch, City Attorney; Joel Rojas, Community Development Director; Cory Linder, Director of Recreation and Parks; Deborah Cullen, Director of Finance; Ron Dragoo, Principal Engineer; Daniel Trautner, Recreation Services Manager; Allan Kaufman, Senior Administrative Analyst; Sean Robinson, Human Resources Manager; and, Carla Morreale, City Clerk. Also present was Planning Commission Chair Bob Nelson. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by City Attorney Lynch. MAYOR'S ANNOUNCEMENTS: Mayor Knight announced a Composting Workshop for beginners scheduled to be held on September 12, 2015 from 9:30 A.M. to 11:00 A.M. at Hesse Park; upcoming brush clearance and document shredding events. Mayor Knight recognized and thanked City Attorney Lynch for her 25 years of service to the City and presented her with a City Tile. City Council Members provided complimentary remarks and thanked City Attorney Lynch for her professionalism and many years of service to the City. RECYCLE AND EMERGENCY PERSONAL PREPAREDNESS KIT DRAWING: Mayor Knight announced Recyclers of the Month from the August 18, 2015 City Council meeting: Elworth Seltzer and Sylvia Chia. He indicated that all winners receive a check for $250 representing a year of free refuse service and urged everyone to participate in the City's Recycling Program. CITY MANAGER REPORT: City Manager Willmore provided introductory remarks regarding the City's new financial software application, OpenGov, which is available on the City's website and illustrates the City's financial status and commitment to transparency. Senior Administrative Analyst Kaufman provided an overview of OpenGov, the location on the City's website, and demonstrated the dynamics of this cloud -based financial reporting solution. CONSENT CALENDAR: City Clerk Morreale reported that late correspondence was distributed prior to the meeting regarding Item D through Item N. Councilman Duhovic requested that Item J (Open Space Acquisitions - Recordation of a Deed Restriction Pursuant to the Los Angeles County Regional Park and Open Space District Requirements) be removed from the Consent Calendar for separate consideration. Councilman Misetich moved, seconded by Mayor Pro Tem Brooks, to suspend the rules of procedure to consider Item G (Adoption of Ordinance No. 574 Amending Section 15.04.070 of the Rancho Palos Verdes Municipal Code Relating to Expedited Permitting Procedures for Small Residential Rooftop Solar Energy Systems and Amending Section 17.83.050 of the Rancho Palos Verdes Municipal Code Relating to Application Procedures for Renewable Energy Systems) and Item J (Open Space Acquisitions - Recordation of a Deed Restriction Pursuant to the Los Angeles County Regional Park and Open Space District Requirements) immediately after Consent Calendar, since it was anticipated the comments were to be brief. Discussion ensued among the Council Members. Councilman Misetich withdrew his motion. PUBLIC HEARINGS: Green Hills Memorial Park Appeal of Planning Commission Decision Regarding Annual Compliance Review (Case No. ZON-20030086); Location: 27501 Western Draft City Council Minutes September 1, 2015 Page 5 of 15 Avenue City Clerk Morreale reported that notice of the public hearing was duly published, written protests included with the staff report and late correspondence distributed prior to the meeting, and there were 18 requests to speak regarding this item. Mayor Knight declared the public hearing open. City Attorney Lynch provided a detailed staff report regarding the Green Hills Memorial Park Appeal; and read into the record proposed amendments to the conditions of approval which were included in the late correspondence packets distributed prior to the meeting. RECESS AND RECONVENE: Mayor Knight called a recess from 7:53 P.M. to 8:03 P.M. Ellen Berkowitz, Los Angeles, Attorney for Green Hills, stated that she submitted a letter regarding the staff report which was included in the late correspondence. She provided comments regarding the following two areas of discussion: 1) the proposed requirement that Green Hills apply for a variance for the Pacific Terrace Mausoleum; and, 2) the proposed amendments to the Conditions of Approval. She provided her reasons why she opined a variance was not required and listed her objections to several of the proposed amendments to the Conditions of Approval. Noel Weiss, Attorney for several homeowners in the Vista Verde Owners Association (VVOA), stated that the homeowners are affected by an unlawful use as a result of no variance for the project; commented on the investigation which noted that City employees failed in their responsibilities to process this project appropriately, which resulted in an ongoing public nuisance, due to the construction of the mausoleum at 30 feet in height instead of 16 feet in height per the Zoning Code; and, concluded that the recommendation for the variance and moratorium should be upheld and are necessary to abate the public nuisance and unlawful use. Michael Friedman, Calabasas, Attorney for the entire VVOA, stated that there will be a formal request for a revocation proceeding. He stated that the findings in the proposed resolution were devoid of information from the Lilley Planning Group and independent investigators reports. He opined that the reports show that the mistake that was made was that City officials took Green Hills at face value, noting the Lilley Planning Group identified several instances where incorrect information was knowingly submitted to the City and never corrected by Green Hills. He stated that if a resolution is adopted that does not place any blame on Green Hills, it will be challenged in court, opining there should be findings that there was not good faith reliance on a validly issued permit. He urged the City to impose a moratorium on Green Hills. Draft City Council Minutes September 1, 2015 Page 6 of 15 G. Scott Sobel, Los Angeles, Attorney for Julie and Paul Keye, stated that his clients have lost their view and home they wished to live in and they want to move, as do many of the others in the condominiums. He commented on the settlements authorized by the City Council and noted the comparables used for the appraisals were not appropriate. He added that he submitted his file and a complaint to the Office of Public Integrity of the District Attorney's Office, and noted he supports the moratorium and an official revocation of the Conditional Use Permit. Nevada Prewitt, Vista Verde Condominiums, Lomita, stated that she bought her home for her view from her living room and dining room, and that view has been taken away. She noted she is subjected daily to activity on top of the mausoleum from her home and added this matter has affected her health. She stated that Green Hills knowingly misled and misconstrued the situation and she spoke in favor of the moratorium. Elmer Scheel, Lomita, stated that this matter has gone on for too long and requested that Council's assistance in resolving this matter. Carl Eichert, Lomita, provided comments regarding the evidence in the application submitted by Green Hills. He opined that misleading and blatantly fraudulent statements were made in the application, noting that the height of the building and location were not adhered to as originally proposed in the Master Plan. Julie Keye, Lomita, provided comments regarding information that was revealed, potential litigation noting that there were possible charges of fraud, collusion, risk of jail time, punitive damages, and Green Hills possibly losing their State permit. She commented on the investigation report, noted that the appraisal was inaccurate; and that Green Hills wants to pay practically nothing and get away with as much as possible. She concluded that the Lomita residents were never notified regarding the mausoleum project. Matt Geier, Lomita, stated that the mausoleum is too high, violating the height and setback rules of the Municipal Code, which has destroyed the views, the pool's open air field and views. He added that the noise from the normal operation of the illegal building is a stressor for all of those nearby. He urged the City Council to deny the Appeal, mandate that Green Hills apply for a variance, and ban rooftop burials immediately. Charmayne Geier, Lomita, stated that she cannot enjoy her home because of the large cement mausoleum in front of her home. She noted they no longer can enjoy the serenity and peaceful nature of the cemetery; and added that the homeowners feel disrespectful using the pool at the condominiums while people are grieving on the mausoleum. She concluded that there are reasons for rules and that the building needs a variance. Draft City Council Minutes September 1, 2015 Page 7 of 15 Joanna Jones -Reed, VVOA, Lomita, stated that she was displeased the Green Hills mausoleum was built with the approval of the Planning Commission, and noted the Lilley Planning Group study provided details regarding the irregularities and indicated that Green Hills misled and deceived everyone. She stated that the residents in the condominium feel discriminated against since they live in the City of Lomita. Debbie Landes, VVOA, Lomita, stated she has a full view of the rooftop burials from her living room and dining room as a result of the illegally built mausoleum, noting that her family continues to suffer through the burials. She stated they have lost the privacy and sanctity of their home and suffered a reduction in monetary value of their property. She urged the Council to pass the Planning Commission's resolutions in their entirety. Matthew Martin, provided comments and a PowerPoint presentation, including video clips, of Green Hills' representatives, Planning Commissioners, a former Planning Commissioner and City staff members. Paul Funk, VVOA, Lomita, provided comments regarding the lack of oversight and due diligence of the Planning Department in reviewing the applications submitted by Green Hills regarding this mausoleum project. He noted that statements made on the applications by Green Hills' representatives were patently false, as revealed by the Lilley Planning Group and RCS Investigators, and that City staff failed to adequately review the materials submitted by Green Hills. He urged the Council to revoke the Green Hills Conditional Use Permit (CUP) and that they be required to reapply for a CUP and a variance. Dr. Lisa Pierson, VVOA, Lomita, provided comments regarding burials in the northwest corner of the cemetery; opining that Green Hills needs to be penalized for their deception; staff was negligent in their duties; and that Green Hills, City staff, and Planning Commission committed egregious actions and serious omissions that have impacted the lives of the adjacent neighbors. She spoke in support of a prohibition of further rooftop burials, and the requirement for Green Hills to apply for a variance with accurate information to be evaluated by an independent party to see if the application falls within California Environmental Quality Act guidelines. Nadia Georgieva, VVOA, Lomita, stated that she has lost her view, privacy, and clean air which was replaced by a cement wall, mourning, heavy bulldozers, loud noise and fumes from the machines, parties and use of alcohol on the mausoleum. She added there are rules for no ground cover on the mausoleum, but noted there are bushes along the south side and benches at the site; and cameras which often point towards her home. She requested the City Council resolve the problem. Lori Brown, Vista Verde Condominiums, Lomita, stated that she bought her condominium 29 years ago, and has lost her view and privacy with the construction of the mausoleum. She stated that the barbecue and pool area is just eight feet from the mausoleum area and urged the Council to do the right thing. Draft City Council Minutes September 1, 2015 Page 8 of 15 Diane Smith, Rancho Palos Verdes, expressed her thanks and sympathy to the Council Members for having to deal with this issue, and noted that the residents of Rancho Palos Verdes feel empathy for the residents of the condominiums in Lomita. Ellen Berkowitz, stated that there was no bad faith, no fraud, and no collusion on the part of Green Hills; and commented on the difficulty of this situation and the threat of lawsuits. She stated that the goal for Green Hills is to balance the needs of the families that it serves with the surrounding community, noting that she hoped the conditions imposed would help to accomplish that goal to some extent. RECESS AND RECONVENE: Mayor Knight called a brief recess from 9:07 P.M. to 9:17 P.M. Councilman Duhovic moved, seconded by Mayor Knight, to recess to Closed Session to ask questions of Legal Counsel. Without objection, Mayor Knight so ordered. RECESS TO CLOSED SESSION: At 9:19 P.M., the City Council recessed to Closed Session. RECONVENE TO REGULAR SESSION: At 9:46 P.M., the City Council reconvened to Regular Session. CLOSED SESSION REPORT: Legal Counsel Scott Noya reported that discussion occurred during Closed Session, and there was no report and no action taken. Councilman Campbell left the dais at 9:47 P. M. and returned to the dais at 9:48 P.M. Discussion ensued among Council Members and Ms. Berkowitz regarding the number of rooftop mausoleum plots and burial statistics of those plots. Mayor Knight declared the public hearing closed. Councilman Duhovic moved, seconded by Mayor Pro Tem Brooks, to adopt a resolution upholding the Planning Commission's decision requiring the submission of a variance application by Green Hills to seek approval of the existing Pacific Terrace Mausoleum. Draft City Council Minutes September 1, 2015 Page 9 of 15 Discussion ensued among Council Members and Legal Counsel, with Councilman Campbell requesting Councilman Duhovic to provide his proposed motions. Council Duhovic stated his second proposed motion as the following: Uphold the Planning Commission's decision to require the submission of a variance application to seek the ability to allow 13 existing below ground interments and 6 additional below ground companion interments in the northwest corner. Council Duhovic stated his third proposed motion as the following: Partially grant the Green Hills appeal by revising certain conditions as laid out by the Planning Commission and as amended and presented tonight by the City Attorney and amending the Green Hills Cemetery Master Plan. Council Duhovic stated his fourth proposed motion as the following: With respect to the Planning Commission's decision as to the moratorium on burials on the rooftop of the mausoleum, to modify the moratorium to allow burials for companion spots if the plot is currently interred. He explained it would prohibit additional burials on plots that have not been occupied by one individual, but if there is someone buried in the plot, this would allow a companion burial in the plot. Discussion ensued among Council Members and Legal Counsel. Councilman Duhovic moved, seconded by Mayor Pro Tem Brooks, to adopt a resolution upholding the Planning Commission's decision requiring the submission of a variance application to seek approval of the existing Pacific Terrace Mausoleum. Mayor Knight declared the public hearing open. Bob Nelson, Chair, Planning Commission, stated he was present to answer any Council questions. Discussion ensued among Council Members and Planning Commission Chair Nelson regarding the vote of the Planning Commission pertaining to the requirement for a variance for approval of the Pacific Terrace Mausoleum. Planning Commission Chair Nelson read an excerpt from the November 11, 2014 Planning Commission Minutes regarding the Green Hills Memorial Park item. Mayor Knight declared the public hearing closed. City Clerk Morreale reiterated the motion on the floor as the following: Councilman Duhovic moved, seconded by Mayor Pro Tem Brooks, to adopt a resolution upholding the Planning Commission's decision requiring the submission of a variance application by Green Hills to seek approval of the existing Pacific Terrace Mausoleum. In response to a Council Member's question, City Attorney Lynch clarified that one of the multiple Conditions of Approval presented to the Council was to keep the last row of plots on the rooftop of the mausoleum not to be utilized or sold. The motion passed on the following roll call vote: AYES: Brooks, Campbell, Duhovic, Misetich, and Mayor Knight NOES: None ABSENT: None Councilman Duhovic moved, seconded by Mayor Pro Tem Brooks, to adopt a resolution revising the Conditions of Approval to include a moratorium on new burials on the Pacific Terrace Mausoleum rooftop, thereby allowing explicitly companion burials where there is currently an individual interred. Discussion ensued among Council Members and City Attorney Lynch. Councilman Duhovic modified his motion, seconded by Councilman Campbell, to adopt a resolution incorporating an additional condition of approval instilling a moratorium on future sales of the rooftop plots on the Pacific Terrace Mausoleum; allowing burials in Draft City Council Minutes September 1, 2015 Page 11 of 15 companion plots already occupied; and, not allowing burials in currently unoccupied plots. Discussion ensued among Council Members and Legal Counsel. Councilman Campbell moved, seconded by Mayor Knight to call the question. Mayor Pro Tem Brooks moved, seconded by Councilman Duhovic, to approve the staff recommendation to: ADOPT ORDINANCE NO. 574, AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES, THEREBY AMENDING SECTION 15.04.070 OF CHAPTER 15.04 OF TITLE 15 OF THE RANCHO PALOS VERDES MUNICIPAL CODE TO PROVIDE AN EXPEDITED, STREAMLINED PERMITTING PROCESS FOR SMALL RESIDENTIAL ROOFTOP SOLAR ENERGY SYSTEMS AND AMENDING SECTION 17.83.050 OF CHAPTER 17.83 OF ARTICLE VII OF TITLE 17 OF THE RANCHO PALOS VERDES MUNICIPAL CODE RELATING TO APPLICATION PROCEDURES FOR RENEWABLE ENERGY SYSTEMS.
