FISCAL IMPACT There is no fiscal impact associated with authorizing the Mayor to sign this letter. BACKGROUND In the late 1990s and early 2000s, Rancho Palos Verdes resident Don Norton obtained Planning entitlements and Building permits to construct 1- and 2 -story additions to his home. Fire Department review of the project was required during Building & Safety plan check because more than one thousand (1,000) square feet was added to the existing home. The Fire Department determined that the project required residential fire sprinklers and, in order to provide adequate flow for the fire sprinkler system, the water service for the home was increased to a 1 Y2" -diameter connection. In Summer 2010, Mr. Norton contacted Councilman Misetich expressing concern about the additional monthly fees that California Water Service Company (CalWater) was charging for the I Y2 -inch connection. 1 MEMORANDUM: Support Letter for Complaint to CPUC regarding CalWater Rates September 1, 2015 Page 2 In the intervening years, Mr. Norton has discussed this issue several times with Councilman Misetich and members of City Staff. It was all parties' understanding that CalWater was pursuing an amendment to its tariffs to address this issue, and that this amended tariff was pending before the CPUC. By July 2014, Mr. Norton reported that he was paying $48.44/month for the 1Y2 -inch connection, a rate that then increased to $91.49/month in September 2014. However, as described above, the only reason for having the larger connection is to provide sufficient flow for the fire sprinkler system, not for day-to-day domestic use. Recently, Mr. Norton contacted Councilman Misetich again to advise him that he had filed a complaint with the California Public Utilities Commission (CPUC) regarding this matter in July 2015. Councilman Misetich has, in turn, asked the Mayor and City Council to authorize sending a letter in support of Mr. Norton's complaint to the CPUC. Staff has drafted such a letter for the City Council's review and approval this evening. DISCUSSION The narrative from the complaint that Mr. Norton filed on-line with the CPUC in July is attached to tonight's report. Mr. Norton points out what appear to be inconsistencies in the various rates and tariffs for residential metered service, private fire hydrants and privately -owned fire protection systems (i.e. fire sprinklers) in CalWater's Palos Verdes service area. For example, the monthly service charge for a 1 %2 -inch connection to a "stand alone" fire sprinkler system only is $14.65 and the monthly charge for a 6 -inch private fire hydrant is only $13.55. The metered residential service tariff for a 1 -inch connection that includes a fire sprinkler system is $19.22/month. However, Mr. Norton is paying $91.49/month for a 1 Y2 -inch connection, nearly five (5) times the rate for a 1 -inch connection. CalWater responded to Mr. Norton by letter on August 12, 2015 (see attachments). CalWater notes that it offers a discount for a 1 -inch connection for homes equipped with fire sprinklers. They suggest that Mr. Norton can investigate downsizing his existing connection to take advantage of the discounted rate under the existing rate and tariff structure. Staff understands that Mr. Norton is exploring the feasibility of downsizing the connection. This will require the approval of the Fire Department and the issuance of a plumbing permit by the City's Building & Safety Division. In the event that it is not feasible to downsize the existing connection (due to fire flow requirements, etc.), another option may be to install a separate connection that only serves the fire sprinkler system, and to downsize the existing connection to serve only the domestic water needs of the home. Regardless of whether or not Mr. Norton is able to modify his existing water service connection in order to reduce his monthly service fee, Staff believes that there is merit in 2 MEMORANDUM: Support Letter for Complaint to CPUC regarding CalWater Rates September 1, 2015 Page 3 asking the CPUC to look into CalWater's rates and tariffs as they relate to fire sprinkler connections. Staff is not aware of any other residents who are experiencing the same fee issue that Mr. Norton is. However, as the City's building codes are periodically updated to address fire safety, it seems likely that more and more City residents will be required to install fire sprinklers in their homes when they propose major additions or remodels. Furthermore, Staff believes that it would not be unreasonable for CalWater to extend the discount that it already provides to customers with combination service on a 1 -inch connection to those with slightly larger connections such as Mr. Norton under the same circumstances. Clarifying and updating CalWater's rates and tariffs related to fire sprinklers now will benefit customers and avoid the inequitable application of monthly connection fees in the future. The attached draft letter to the CPUC supports these positions. CONCLUSION In conclusion, Staff recommends that the City Council authorize the Mayor to sign the draft letter in support of Mr. Norton's complaint to the CPUC. ALTERNATIVES In addition to the Staff recommendation, the following alternative action is available for the City Council's consideration: 1. Do not authorize the Mayor to sign the letter to the CPUC. I have a single 11/2 inch residential connection supplying domestic and home fire sprinklers. In the last year the connection charge has gone from high to outrageous. In Jul 2014 it was $48.44 per month. By Sep 2014 it had risen to $91.49 per month. This charge has nothing to do with how much water I use. I am being punished for doing the right thing and installing fire sprinklers when I remodeled in 2003 and the permit process required me to up the connection to 11/2 in. My connection charge is now half of my monthly bill. The utility may say it's for "readiness for service" but if so why do they only charge $39.04 for a 4 -inch private fire service connection? Who have you contacted? I repeatedly contacted both the City of RPV and the utility when the connection charge was "only" $48.44 (as compared to about $12 for the typical home without fire sprinklers) and they repeatedly failed to act, saying that some big pending rate case would fix the problem. Instead, recent rate decisions have apparently made the connection charge into something truly ridiculous. When I called the utility's customer service number today, they said they could not explain why my connection charge had doubled other than it was an approved rate change and that I needed to contact the CPUC. What do you want the PUC to do? Fix this rate disparity. Homes that have a single connection for domestic and fire sprinklers, as opposed to businesses that have daily usage requiring larger connections, shouldn't be penalized for having a larger connection that will probably never be used at capacity (because the fire sprinklers will hopefully never be activated). The fact that I could have 4 -inch private fire service for less than half of the cost of my 11/2 inch residential connection is highly inconsistent. I have heard that some time ago certain cities (Redondo Beach and others) secured fire sprinkler exceptions for residents. This letter is in response to the complaint filed on July 16, 2015 with the CPUC. The CPUC is responsible for setting our rates. The CPUC has designed the rate structure to include both a service charge and a quantity charge, which together are intended to enable the utility to recover the costs of providing water service and earn a reasonable return of the capital it has invested in water system infrastructure. Before the CPUC grants a water rate increase, it conducts a thorough review of our finances, operations, and costs to determine whether an increase is justified. The rate increase reflects the costs of necessary water system improvements and increases in costs of providing water service. The service charge increased by a much larger percentage in 2014. The reason behind this is that there is a conversion guideline that recommends we recover 30% from the service charge and 70% from the quantity rates. To move towards collecting 30% of the revenue from the service charge piece, we needed to shift more revenue to the service charge component. In the Palos Verdes area, the quantity rates decreased while the service charge increased. The service charge reflects fixed costs of providing service. Fixed costs are those that the utility incurs even if the customer uses no water, such as system maintenance costs, transmission and distribution expenses, and water quality testing. We recognize that rate increases are never welcome, and we work hard to provide a reliable supply of high-quality water at the lowest possible cost. Enclosed is a copy of our tariffs. Quality.
