CC SR 20150804 04 - Joint Transfer Reso Annexation of Public ROWCITY OF tiRANCHO PALOS VFRDES MEMORANDUM TO: HONORABLE MAYOR & CITY COUNCIL MEMBERS FROM: CAROLYNN PETRO, AICP, DEPUTY CITY MANAGE DATE: AUGUST 4, 2015 SUBJECT: JOINT TAX TRANSFER RESOLUTION RELATED TO "CITY OF ROLLING HILLS REORGANIZATION NO. 2013-04" FOR THE DETACHMENT OF A 0.18 - ACRE PORTION OF THE PUBLIC RIGHT-OF-WAY OF CRENSHAW BOULEVARD FROM THE CITY OF ROLLING HILLS, AND THE ANNEXATION OF SAID PUBLIC RIGHT-OF-WAY TO THE CITY OF RANCHO PALOS VERDES REVIEWED BY: DOUG WILLMORE, CITY MANAGER OA^o Project Manager: Kit Fox, AICP, Senior Administrative Analys RECOMMENDATION Adopt the Joint Resolution of the Board of Supervisors of the County of Los Angeles; the City Council of the City of Rolling Hills; the City Council of the City of Rolling Hills Estates; the Board of Directors of the Ridgecrest Ranchos Recreation and Park District; and the City Council of the City of Rancho Palos Verdes, approving and accepting the negotiated exchange of property tax revenue resulting from the reorganization of territory known as "City of Rolling Hills Reorganization No. 2013-04," consisting of detachment of territory from the City of Rolling Hills and annexation to the cities of Rolling Hills Estates and Rancho Palos Verdes. EXECUTIVE SUMMARY The Los Angeles County Local Agency Formation Commission (LAFCO) has been processing the 0.54 -acre detach ment/annexation of a sliver of Crenshaw Boulevard right- of-way since 2013. The County has indicated that the Joint Tax Transfer Resolution (JTTR) is ready for adoption by the affected taxing agencies, including the City of Rancho Palos Verdes. The city councils of the cities of Rolling Hills and Rolling Hills Estates were 1 MEMORANDUM: Joint Tax Transfer Resolution for Crenshaw Right -of -Way August 4, 2015 Page 2 scheduled to consider the JTTR on July 13, 2015, and July 14, 2015, respectively. Both city councils have approved the JTTR. Staff now presents the JTTR for the City Council's consideration. BACKGROUND In April 2013, the City of Rolling Hills filed a proposal with LAFCO to detach a 0.54 -acre portion of the public right-of-way of Crenshaw Boulevard from its jurisdiction, and annex it to the cities of Rolling Hills Estates and Rancho Palos Verdes. Under City of Rolling Hills Reorganization No. 2013-04, Rolling Hills Estates would annex a 0.36 -acre portion of the right-of-way and Rancho Palos Verdes would annex a 0.18 -acre portion of the right- of-way. Although this proposal was originally filed in 2013, its processing was apparently delayed due to a discrepancy between the boundary maps of the State Board of Equalization (SBE) and those of LAFCO. Although LAFCO purportedly sent a notice regarding this proposal to the City in June 2013, Staff only became aware of it as the result of a letter received from 4t" District Los Angeles County Supervisor Don Knabe in September 2014. On June 23, 2015, Staff was advised by the County that the JTTR was ready to be adopted by the affected taxing agencies. This joint resolution was considered and approved by the Rolling Hills City Council on July 13, 2015, and the Rolling Hills Estates City Council on July 14, 2015. The JTTR will also need to be approved by several other agencies or jurisdictions, including the: • Ridgecrest Ranchos Recreation & Park District • Palos Verdes Library District • Los Angeles County Board of Supervisors • Los Angeles County Consolidated Fire Protection District • Los Angeles County Flood Control District • Los Angeles County Sanitation District No. 5 • Los Angeles County West Vector Control District • Water Replenishment District of Southern California In the meantime, the JTTR is presented tonight for the City Council's consideration and adoption. DISCUSSION Along with the draft JTTR, the County has provided the attached spreadsheet evaluating the property tax allocation adjustments that would result from this reorganization of territory. The County's analysis concludes that accepting the 0.18 -acre portion of 2 MEMORANDUM: Joint Tax Transfer Resolution for Crenshaw Right -of -Way August 4, 2015 Page 3 unimproved Crenshaw Boulevard right-of-way from Rolling Hills would have no impact upon the property tax proceeds received by Rancho Palos Verdes.' This is presumably because, as public right-of-way, it is not taxable property. The aerial photo below depicts the portion of the right-of-way that Rancho Palos Verdes would annex under this proposal. While the County's analysis concludes that there would be no adverse impacts upon the City's property tax revenues in accepting this right-of-way fragment from Rolling Hills, there is also no financial benefit to the City in doing so. However, Staff believes that it would be the "neighborly" thing to do to accept this right-of-way fragment from Rolling Hills. Since Rolling Hills incorporated as a gated private community in 1957, the inclusion of this sliver of public right-of-way within Rolling Hills' boundaries may well have been an error or oversight, one that has only recently come to light. In 1977, Rolling Hills accepted from Rancho Palos Verdes a 0.28 -acre portion of the private street right-of-way of Crest Road West that included the Crenshaw gatehouse so that it would be located wholly The County's analysis for Rolling Hills Estates draws the same conclusion regarding the 0.54 - acre portion of the Crenshaw Boulevard right-of-way that it would annex as a part of this reorganization of territory. 3 MEMORANDUM: Joint Tax Transfer Resolution for Crenshaw Right -of -Way August 4, 2015 Page 4 within Rolling Hills' city boundary. Rancho Palos Verdes' acceptance of the sliver of Crenshaw Boulevard right-of-way from Rolling Hills now is roughly equivalent in area to this previous adjustment to our shared city boundary. Furthermore, the City Attorney and the Public Works Department have reviewed the incremental liability and maintenance costs, respectively, of accepting this right-of-way from Rolling Hills, and have determined them to be negligible. The parcel is generally flat, with a portion sloping down into an existing drainage structure. Therefore, Staff believes that is it appropriate and "neighborly" to agree to this proposed reorganization of territory with the City of Rolling Hills. CONCLUSION In conclusion, Staff recommends that the City Council adopt the JTTR for Rolling Hills Reorganization No. 2013-04. ALTERNATIVES In addition to the Staff recommendation, the following alternative action is available for the City Council's consideration: Do not adopt the JTTR. This alternative will halt the LAFCO process, at least with respect to the 0.18 -acre portion of the Crenshaw Boulevard right-of-way to be transferred to the City of Rancho Palos Verdes and the Ridgecrest Ranchos Recreation & Park District. FISCAL IMPACT The costs associated with the proposed detachment and annexation have been wholly borne by the City of Rolling Hills. As reflected in the JTTR presented for the City Council's adoption, the annexation of the additional 0.18 -acre territory is not expected to affect the property tax revenue received by the City of Rancho Palos Verdes. Furthermore, the City's Public Works Department concludes that the acceptance of the 0.18 -acre portion of unimproved Crenshaw Boulevard right-of-way will have a negligible incremental cost in terms of maintenance. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: The negotiated exchange of property tax revenues between the County of Los Angeles, the FCD, the CFPD, the City of Rolling Hills, the City of Rolling Hills Estates, the City of Rancho Palos Verdes, the County Sanitation District No. 5, the Los Angeles County West Vector Control District, the Palos Verdes Library District, the Ridgecrest Ranchos Recreation and Park District, 5 and the Water Replenishment District of Southern California, resulting from City of Rolling Hills Reorganization No. 2013-04, is approved and accepted. A. Detachment of Territory from the City of Rolling Hills: 1. The negotiated exchange of property tax revenues between the County of Los Angeles, the FCD, the CFPD, the City of Rolling Hills, the City of Rolling Hills Estates, the City of Rancho Palos Verdes, the County Sanitation District No. 5, the Los Angeles County West Vector Control District, the Palos Verdes Library District, the Ridgecrest Ranchos Recreation and Park District, and the Water Replenishment District of Southern California, resulting from the reorganization proposal identified as the City of Rolling Hills Reorganization No. 2013-04, is approved and accepted for the detachment area within Tax Rate Areas 07084 and 12908. 2. For the fiscal year commencing in the year after the filing of the statement of boundary change for City of Rolling Hills Reorganization No. 2013-04 with the Board of Equalization, pursuant to Government Code sections 54902 and 57204, a base of Zero Dollars ($0) in property tax revenue attributable to City of Rolling Hills Reorganization No. 2013-04, and .064948866 of the annual property tax increment attributable to Reorganization No. 2013-04 shall be transferred from the City of Rolling Hills to the County of Los Angeles, and the City of Rolling Hills' share in the area to be detached shall be reduced to zero. 3. BACKGROUND From a request by a cell phone provider asking the City of Rolling Hills for permission to install their equipment on a utility pole located on Crenshaw Boulevard in 2012, staff (0 32 learned that a small portion of the Crenshaw Boulevard right-of-way at/near Silver Spur Road appeared to be in the boundaries of the City of Rolling Hills. While the City has historically understood there was no public right-of-way within its jurisdiction, staff review of the subdivision map of Morgan Lane and County records confirmed this finding. DISCUSSION On the Peninsula near Rolling Hills, Crenshaw Boulevard traverses Rolling Hills Estates, Rancho Palos Verdes and the unincorporated area of Los Angeles County. Each municipality is responsible for the maintenance of their respective portion of the roadway including signals. The roadway is also designated as state route and as such, it is policed by the California Highway Patrol (CHP). It was found that a small portion of the Crenshaw Boulevard right-of-way is in Rolling Hills. It was not known at the time if this property was completely public right-of-way or any portion of the land is private property. Due to the potential liability associated with public right-of-way and the City's long-standing practice of not having public roadways within its jurisdiction, staff recommended that the City de -annex this small portion of property to Rolling Hills Estates and Rancho Palos Verdes who abut Rolling Hills at/near the Crenshaw Boulevard and Silver Spur Road intersection. Staff contacted both Rolling Hills Estates and Rancho Palos Verdes to discuss and facilitate the de -annexation. As a result of the reorganization initiated by Rolling Hills, it was found it impacted a small area of public right-of-way (.54 acres) that is currently maintained by the Cities of Rolling Hills Estates (.36 acres) and Rancho Palos Verdes (.18 acres) due to the proximity of their respective roadways. However, the County Assessor's map lists the areas within the boundary of the City of Rolling Hills, that does not contain any public right-of-ways. This Reorganization would result in the detachment of the two areas from Rolling Hills (Crenshaw Boulevard), and annex them to the Cities of Rolling Hills Estates and Rancho Palos Verdes respectively. In April 2013, the City Council adopted Resolution No. 1142 requesting the Los Angeles County Local Area Formation Commission (LAFCO) to initiate proceedings for the reorganization of territory and subsequently submitted an application to LAFCO requesting the reorganization. After the application was received by the County, it was discovered that the Assessor's map and the State Bureau map did not correlate and this has since been corrected. Additionally, a portion of the area will also be annexed into the Ridgecrest Ranchos Recreation and Park District (Rancho Palos Verdes), and LAFCO will be requesting their approval as well as the other taxing entities. Once the Resolution is adopted by all the cities and taxing entities, it will go before the Board of Supervisors for approval. AND SILVER SPUR ROAD FOR PUBLIC RIGHT-OF-WAY PURPOSES. OVERVIEW The following is a request initiated by the City of Rolling Hills to adopt a joint resolution (City Council Resolution No. 2352) between the Board of Supervisors of the County of Los Angeles, the City Councils of the Cities of Rolling Hills, Rolling Hills Estates, and Rancho Palos Verdes, and the governing bodies of the Los Angeles County Flood Control district, The Consolidated Fire Protection District, The County Sanitation District No. 5, The Los Angeles County West Vector Control District, The Palos Verdes Library District, The Ridgecrest Ranchos Recreation and Park District, and The Water Replenishment District of Southern California, and approving and accepting the negotiated exchange of property tax revenue resulting from the reorganization of territory known as City of Rolling Hills Reorganization No. 2013-04, as required by the Local Agency Formation Commission (LAFCO). BACKGROUND / DISCUSSION On April 25, 2013, the City of Rolling Hills filed an application with LAFCO to detach .54 acre of land located in their city to the cities of Rolling Hills Estates (.36 acre) and Rancho Palos Verdes (.18 acre), as such land is located in the right-of-way of Crenshaw Blvd. near the intersection of Silver Spur Road. The City of Rolling Hills presently does not have any streets that are in the public right of way; all are privately maintained by their Association. Staff believes that this was essentially a mapping error many years ago and it would make more sense if the half acre of land that runs along the east side of Crenshaw Blvd. were simply de -annexed from Rolling Hills and annexed into RHE and RPV as it straddles both cities' jurisdictions (refer to the map attached to the resolution for more information). The joint resolution will require all three cities to approve. Rolling Hills City Council will be approving on July 13th, and Rancho Palos Verdes Council on August 14th. Once all three cities have approved, then the Board of Supervisors will approve the LAFCO reorganization of territory. As summarized in Resolution No. 2352 (attached), all the various taxing agencies must agree to a shift in tax from one organization to another. Because this is vacant land and essentially only usable for public right-of-way purposes and only about a half acre in size, the tax increment adjustments are essentially negligible. RECOMMENDATION Staff recommends that the City Council adopt Resolution No. 2352, accepting a portion of land (.36 acre) from the City of Rolling Hills for public right-of-way purposes, and the negotiated exchange of property tax revenue also resulting from the reorganization of territory from the City of Rolling Hills to the City of Rolling Hills Estates.
