RECOMMENDATION
Adopt Resolution No. 2015-_, thereby adopting the City's 2015 Local Development
Report (LDR) and self -certifying the City's conformance with the Congestion Management
Program (CMP) for Los Angeles County.
BACKGROUND
A Congestion Management Program (CMP) was enacted by the State Legislature in 1990
to improve traffic congestion in California's urban areas. In accordance with the State
statute, the Los Angeles County Metropolitan Transportation Authority (MTA) [then known
as the L.A. County Transportation Commission (LACTC)] adopted the first CMP for Los
Angeles County on November 18, 1992.
The MTA has updated and adopted several Congestion Management Programs since
1992. The City and other L.A. County local jurisdictions were originally required to
demonstrate compliance with the MTA's Congestion Management Program (CMP) using a
debit/credit system. The debit/credit system was abolished in 2003 because the MTA
began studying the concept of instituting a traffic mitigation fee to address regional
congestion. Until adoption and implementation of a possible congestion mitigation fee,
cities are required to continue the current practice of adopting an annual self -certified
conformance resolution and self -certifying the City's conformance with the CMP
requirements. As such, the City's 2015 Local Development Report (LDR), which reports

information on new net development in our City within the 2014-2015 fiscal year, is being
presented to the City Council for approval along with a resolution certifying the City's
compliance with the County's Congestion Management Program. Upon adoption, the
resolution and 2015 LDR will be transmitted to the MTA for its review and approval.
DISCUSSION
In adopting the attached self -certification resolution, the City resolves that it is in
conformance with all the applicable requirements of the CMP and has taken, or will take,
each of the following four specific actions (the requisite action appears in bold type and the
City's response in normal type):
1. By June 15, of odd numbered years, the City will conduct and transmit to the MTA
traffic counts and calculated levels of service for selected arterial intersections,
consistent with the requirements identified in the CMP Highway and Roadway
System Chapter.
The current year of 2015 is an odd numbered year and therefore the requisite action is
applicable. This year the MTA gave the City an extension to July 7, 2015 to submit the
required information to them. On June 30, 2015, the Public Works Department transmitted
the results of the biennial highway monitoring performed at the intersection of Western
Avenue and Toscanini Drive to MTA, in accordance with the requirements of the CMP (see
attached).
2. The City has locally adopted and continues to implement a Transportation
Demand Management (TDM) Ordinance, consistent with the minimum
requirements identified in the CMP Transportation Demand Management Chapter.
On February 2, 1993, the City Council adopted the required TDM Ordinance (Municipal
Code Chapter 10.28) and Staff continues to implement the TDM Ordinance, where
applicable. In 1997, the TDM Ordinance was incorporated into the Development Code by
reference.
3. The City has locally adopted and continues to implement a land use analysis
program, consistent with the minimum requirements identified in the CMP Land
Use Analysis Program Chapter.
On September 17, 2002, the City Council adopted an amended set of Local CEQA
Guidelines, which incorporated the County's CMP Land Use Analysis program into the
City's environmental review procedures. City staff continues to implement the land use
analysis program where applicable.
4. The City has adopted a 2015 Local Development Report consistent with the
requirements identified in the CMP. The LDR tracks new development, exempted
development, and development adjustments as a result of building permits
issued between June 1, 2014 and May 31, 2015.

During the period between June 1, 2014 and May 31, 2015, there were building permits
issued for ten (10) new single family units and five (5) demolition permits, resulting in a net
increase of five (5) single-family residential units in the City. Additionally, there were
building permits issued for eighty-three (83) multi -family residential units and five (5)
low/very low income housing units at 28220 Highridge (Highridge Condos) and 5601
Crestridge (Crestridge Senior Condos).
CONCLUSION
The City Council, through a noticed public hearing, must adopt a self -certification
conformance resolution, whereby the City agrees to conform to the local responsibilities
required by the CMP, including preparation of the 2015 LDR. As documented in this Staff
Report, the City is in conformance with all applicable requirements of the CMP and has
taken all of the required actions of the Deficiency Plan. Therefore, Staff recommends that
the City Council adopt attached Resolution No. 2015 - _

RESOLUTION NO. 2015-
A RESOLUTION OF THE CITY COUNCIL FINDING THE CITY OF
RANCHO PALOS VERDES [LOS ANGELES COUNTY] TO BE IN
CONFORMANCE WITH THE CONGESTION MANAGEMENT
PROGRAM (CMP) AND ADOPTING THE CMP LOCAL DEVELOPMENT
REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT
CODE SECTION 65089.
WHEREAS, CMP statute requires the Los Angeles County Metropolitan
Transportation Authority (LACMTA), acting as the Congestion Management Agency for
Los Angeles County, to annually determine that the County and cities within the County
are conforming to all CMP requirements; and,
WHEREAS, LACMTA requires submittal of the CMP Local Development Report
by September 1 of each year; and,
WHEREAS, on July 7, 2015, after notice published pursuant to the provisions of
the Development Code, the City Council held a public hearing, at which time all
interested parties were given an opportunity to be heard and present evidence; and,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That the City of Rancho Palos Verdes [Los Angeles County] has
taken all of the following actions and is in conformance with all applicable requirements
of the 2010 CMP adopted by the LACMTA Board on October 28, 2010.
By June 15, of odd -numbered years, the City of Rancho Palos Verdes [Los

requirements identified in the 2010 CMP. This report balances traffic congestion
impacts due to growth within the City of Rancho Palos Verdes [Los Angeles County]
with transportation improvements, and demonstrates that the City of Rancho Palos
Verdes [Los Angeles County] is meeting its responsibilities under the Countywide
Deficiency Plan consistent with the LACMTA Board adopted 2003 Short Range

Transportation Plan.
Section 2: That the City Clerk of the City of Rancho Palos Verdes [Los
Angeles County] shall certify to the adoption of this Resolution and shall forward a copy
of this Resolution to the Los Angeles County Metropolitan Transportation Authority.

Exempted Development Definitions:
1. Low/Very Low Income Housing: As defined by the California Department of Housing and Community
Development as follows:
Low -Income: equal to or less than 80% of the County median income, with adjustments for family size,
Very Low -Income: equal to or less than 50% of the County median income, with adjustments for family size.
2. High Density Residential Near Rail Stations: Development located within 1/4 mile of a fixed rail passenger
station and that is equal to or greater than 120 percent of the maximum residential density allowed under
the local general plan and zoning ordinance. A project providing a minimum of 75 dwelling units per acre
is automatically considered high density.
3. Mixed Uses Near Rail Stations: Mixed-use development located within 1/4 mile of a fixed rail passenger
station, if more than half of the land area, or floor area, of the mixed use development is used for high
density residential housing.
4. Development Agreements: Projects that entered into a development agreement (as specified under Section
65864 of the California Government Code) with a local jurisdiction prior to July 10, 1989.
5. Reconstruction or replacement of any residential or non-residential structure which is damaged or destroyed,
to the extent of > or = to 50% of its reasonable value, by fire, flood, earthquake or other similar calamity.
6. Any project of a federal, state or county agency that is exempt from local jurisdiction zoning regulations and
where the local jurisdiction is precluded from exercising any approval/disapproval authority. These locally
precluded projects do not have to be reported in the LDR.
