PLANNING COMMISSION MINUTES
REGULAR MEETING
JANUARY 9, 2018
CALL TO ORDER
The meeting was called to order by Vice Chairman James 7:05 p.m.at the Fred Hesse
Community Room, 29301 Hawthorne Boulevard.
PLEDGE OF ALLEGIANCE
Commissioner Nelson led the assembly in the Pledge of Allegiance.
ATTENDANCE
Present: Commissioners Bradley, Emenhiser, Leon, Nelson, Tomblin, and Vice
Chairman James.
Absent: None
Also present were Community Development Director Mihranian, Assistant City Attorney
Gerli, Senior Planner Seeraty, and Senior Planner Silva.
APPROVAL OF AGENDA
The agenda was unanimously approved as presented.
COMMUNICATIONS
City Council Items: Director Mihranian reported that at the December 19th meeting, the
City Council approved a contract to begin removing deteriorated fences and walls along
Hawthorne Blvd., and approved the City's Emission Reduction Action Plan.
Staff: Director Mihranian informed the Commission that late correspondence was
distributed.
Commission: Commissioner Nelson introduced his son and daughter-in-law.
Commissioner Emenhiser asked about the steps involved with the arterial fences and
walls that will be removed by the City.
COMMENTS FROM THE AUDIENCE (regarding non-agenda item): Jeff Calvagna
informed the Commission that he has requested to meet with City Staff on a weekly basis
and provided information on other cities relating to Wireless Telecommunication Facilities.

CONTINUED PUBLIC HEARINGS
1. CONDITIONAL USE PERMIT NO. 172 REVISION "C", GRADING PERMIT, AND
ENVIRONMENTAL ASSESSMENT/MITIGATED NEGATIVE DECLARATION: (CASE
NO. ZON2015-00230): Cal Water, 5837 Crest Road (AS)
Associate Planner Seeraty presented the Staff Report providing a background overview
of the proposed project and describing the changes made to the project and the draft
Conditions of Approval since the December 12th meeting. She stated that the Applicant
is requesting to revise Conditional Use Permit(CUP) No. 172 to memorialize the on-site
facilities and operations, and to allow the installation of a 1,000 gallon above-ground
diesel fuel tank and 20 cubic yards of grading.
Discussion ensued between the Commission and Staff regarding the proposed project
as it relates to hours of operations, changes to the operations of the spoils material,
relocating the spoils material to an off-site location within 6 months unless a time
extension is granted by the Commission, the landscape and fencing screening, noise,
short-term and long-term dust, and soil testing.
Vice Chairman James opened the public hearing.
Korey Bradbury as the Applicant answered Commission questions regarding the spoil
operations, relocating the spoil operations to an off-site location, and soil testing.
Randy Risner, Counsel for Applicant, spoke on the topic of spoil and the process of
disposal, as well as soil testing.
Joe DeVenuto spoke expressed concerns with the proposed Conditions of Approval as it
relates to soil testing and the spoil operations.
Vice Chairman James closed the public hearing.
Commissioner Nelson moved, seconded by Commissioner Bradley, to adopt P.C.
Resolution No. 2018-01; thereby certifying a Mitigated Negative Declaration; and to adopt
P.C. Resolution No. 2018-02; thereby approving Conditional Use Permit No. 172 Revision
"C" and Minor Grading Permit to memorialize the on-site facilities and operations, and to
allow for the installation of a 1,000 gallon above-ground diesel fuel tank and 20 cubic
yards of grading with modifications to Condition Nos. 26 and 40, on a vote of 6-0.
Director Mihranian reported that there is a 15-day appeal period.

NEW PUBLIC HEARINGS
2. SHORT-TERM RENTAL DEFINITION CODE AMENDMENT: (CASE NO.
ZON2017-00486): City-Wide (OS)
Senior Planner Silva presented the Staff Report and noted that the recommendation is
based on the Council-initiated code amendment proceedings, and that Staff is
recommending that the Commission amend Chapter 17.96 (Definitions) of Title 17
(Zoning) of the City's Municipal Code to expand the City's definition of a short-term rental
to include commercial operations.
A discussion ensued among the Commission and Staff regarding clarity and
reorganization of the definition and the code amendment, the reasons why this code
amendment was initiated, and the impacts such operations have on the community's
quality of life.
Vice Chairman James opened the public hearing.
Suzanne Willougby and Natalie Bennett spoke in favor of the proposed code amendment
describing the impacts their neighborhood is experiencing as a result of a short-term
rental that is operating on Larchbluff.
Alan Siegel spoke in favor of the code amendment, but asked if the Commission would
consider removing the word "premises" from the proposed short-term rental definition.
Vice Chairman James closed the public hearing.
The Commission continued its discussion of the proposed code amendment language
and asked questions of Staff. Commissioner Nelson stated the ordinance is not
enforceable.
Commissioner Leon expressed concern that the new language was too broad and could
result in making small events, like "Tupperware parties," illegal.
Director Mihranian responded that the ordinance would only apply to property owners
renting their home for a short-term basis and based on code enforcement procedures.
Commissioner Bradley moved, Seconded by Commissioner Tomblin to adopted P.C.
Resolution No. 2018-03, recommending to the City Council that an Ordinance be adopted
amending Chapter 17.96 (Definitions) of Title 17 (Zoning) of the Rancho Palos Verdes

Municipal Code to expand the definition of a short-term rental to include commercial
operations, on a vote of 5-1, with Commissioner Nelson dissenting.
