Public comments since November 16, 2017, meeting (page C-1) BACKGROUND AND DISCUSSION: On November 16, 2017, the Department of Toxic Substances Control (DTSC) held a public meeting at the Point Vicente Interpretive Center (PVIC) to discuss the findings of the draft Preliminary Endangerment Assessment (PEA) prepare for the school district's Ladera Linda Fields site. DTSC released a Community Update (Attachment B) and the draft PEA on November 7, 2017, noting that public comments on the PEA were due by Friday, December 8, 2017. DTSC presented an overview of the PEA findings (Attachment C) at the PVIC meeting, and provided an opportunity for attendees to ask questions and make comments. The complete PEA is available for review on-line by clicking The results presented by DTSC at the November 16, 2017, meeting included: • The site poses no threat to human health or the environment; 1 No asbestos fibers were found in the soil, and no friable asbestos -containing materials were found; Screening for other chemicals in the soil indicated that they were not present or below human health or hazardous waste levels; and, DTSC expects to determine that no further action is required, pending the conclusion of the 30 -day comment period. It was clear from some of the public comments at the PVIC meeting that many residents remain concerned about the safety of the site and its possible effects upon their neighborhoods. There were also meeting attendees who welcomed the PEA results and suggested that this matter should now be deemed closed. A few attendees also suggested that the 30 -day comment period should be extended. DTSC Staff noted that the comment period was not a typical component of the preparation of a PEA, and encouraged attendees to submit their comments by December 8, 2017. Subsequent to the PVIC meeting, several residents have contacted Staff and the City Council suggesting that the 30 -day public comment period should be extended due to timing of the public comment period that would end during the busy holiday season. Conversely, many residents have stated that the 30 -day public comment period is sufficient given that DTSC determined there was no health threat. Staff is seeking direction from the City Council given these differing viewpoints. 2 Department of Toxic Substances Control - Fact Sheet November 2017 The mission of DTSC is to protect California's people and environment from harmful effects of toxic substances by restoring contaminated resources, enforcing hazardous waste laws, reducing hazardous waste generation, and encouraging the manufacture of chemically safer products. The Site is part of Ladera Linda Fields, which is owned by Palos Verdes Peninsula Unified School District (PVPUSD), and licensed and operated by Palos Verdes American Youth Soccer Organization (PVAYSO) for its youth soccer program. What Is Going On? DTSC instructed the Palos Verdes Unified School District and PVAYSO to assess the stockpiled soil for the presence of hazardous substances. A PEA Workplan was approved by DTSC that provided a scope of work to determine if there were hazardous substances (asbestos containing materials) present, and if so, if they pose a risk to human health or the environment. Ten trenches were dug, visually inspected, and soil samples were taken from trench walls and/or floors. Additionally, items suspected of containing or resembling construction materials were collected for asbestos testing. PEA Findings As required under the DTSC Consent Agreement, the PEA Workplan, and in concurrence with the South Coast Air Quality Management District, the PEA sampling was conducted under the direction of a qualified environmental professional and a Certified Asbestos Consultant. No soil samples detected asbestos. All potential asbestos -containing debris (6 total pieces) encountered during the investigation were shipped to the laboratory for analysis. None of the potential asbestos -containing debris contained friable asbestos. DTSC only considers bulk asbestos containing debris to be a hazardous waste and a hazardous substance if it is friable. The Report concluded that no further investigation is needed for the Site due to the absence of hazardous substances. Environmental sample results and findings were reported in the PEA Report concluding no threat to human health and the environment exists. Where Can You Find Information? The public deserves the right and time to digest the assumptions by current Avocet report in comparison to two other licensed and reputable companies Alta and Leymaster Environmental who had very different test data. We are asking your help in obtaining this simple extension. I have been following comments from some residents and the attorney representing AYSO who believe that leaving known carcinogenic pesticides outlawed about 40-50 years ago in the United States are okay to leave on the Ladera Linda children's field. Unlike most DTSC school scenario projects where they are trying to clean out Brownfields for school use, we have a pristine field that became dumped with carcinogenic soils in April 2015. These are known soil pollutants/carcinogens in the dumped soils such as DDT, DDD, DDE, Chlorane, Chlordane Gamma, Chlordane Alpha, Heptachlor, etc. As well as Cobalt, Vanadium, Hexavalent chromium, barium, etc. as noted by Alta Environmental in 2015. They haven't gone away. It is not okay. Children are on these fields 4-5 times a week. What are the children's human health risks as children are exposed to these? Residents walk the fields, jog the fields and picnic on the site. Aren't they entitled to the original safe field? There were 3 reports done for this field. #1- 11-2015 Atla Report paid for by PVPUSD stating very serious concerns sent to the Superintendent in emails and correspondence, and test data results that include C-1 DDT, Chlordane, etc. and Asbestos debris #2- 12- 2015 Leymaster Report released by the PVPUSD that did not test for Asbestos but found even higher levels of Organochlorine Pesticides #3- 10-2-17 Avocet report paid for by AYSO only tested for Asbestos. Why? In January 2016 Don Austin posted that PVPUSD had met all of the LAUSD strict Criteria for Soils. It did not. AYSO signed off on the same page with Austin. This is the LAUSD POLICY below stating soils must be tested and approved - There is a reason for that. Alta's email below also states that LAUSD would not accept soils with any detectable organochlorine pesticides. Ladera Linda is now dumped with soils well above the reporting limits and 'deleterious materials' that will not be accepted by LAUSD - Alta found cut sewer lines, pipes, vinyl tiles, drywall etc in the soils and everyone is now conveniently ignoring that fact: LAUSD POLICY.- 2.01 OLICY. 2.01 MATERIALS A. Imported 1. Soils. Soils proposed for import shall be tested pursuant to the requirements of this Section (01440), unless a variance has been requested by CONTRACTOR and approved by LAUSD-OEHS prier to the import of the subject materials. 2. Gravels. Clean gravel, consisting of native rack from a commercial source, may be granted a variance from the testing requirements of this Section provided a request for variance is submitted by CONTRACTOR for review and approval at least two weeks prior to import. CONTRAC'T'OR shall provide written documentation, which identifies the source, volume and proposed transport date of the material for review and a letter signed and stamped from either a California Professional Engineer or Geologist stating the quarry does not mine ultra mafic (ie. natural asbestos containing) materials. The request for variance requires approval by LAUSD-OEHS prior to CONTRACTOR imparting the materials.. No miscellaneous material containing crushed concrete, asphalt, construction debris, or other potential deleterious materials may be utilized or imported to a LAUSD project site for use as fill or grading material of any sort without prior testing by COR'TRAC"TOR pursuant to the subject Section (01440) and approval by LAUSD-OEHS. At no time did the PVPUSD ever give written permission to AYSO to dump 24,000 cubic ft of soils onto Ladera Linda. At no time did the PVPUSD ever test the soils before importation. If they had tested the soils perhaps we wouldn't be in this mess today. At no time did RPV issue a permit to any of the trucking companies or provide a C-2 hauling route. If they had we'd know where the soils came from. Why does it appear that some folks are desperate to shut down public comments? Why is the attorney in such a rush? What is the rush if you have knowledge that carcinogenic pesticides are laced into the soils on a children's soccer field? The DTSC meeting of July 19th was cancelled without any explanation to the community and therefore left community members to expect input and participation by the DTSC as is in their mission statement. "DTSC's Public Participation Philosophy" "DTSC managers and staff members believe the best decisions are made with a fully informed and involved public. Our approach is unique in that we involve the affected or interested communities on the community's terms." Instead the community was shut down and presented with a report by Avocet, paid for by AYSO without any participation. Realistically if AYSO had simply trucked off the original truck loads of dirt dumped in April 2015 that occurred w/o permission and w/o any RPV permits it would have cost them a lot less money and hassle than they are going through now and that the city and residents are going through right now. The Ladera Linda fields were pristine until the dumping of unwanted dirt and soils of unknown sources (DTSC admitted that they do not know the source of the soils at the Nov. meeting) But both current Avocet and Alta reports confirm that there are at least 2 sources of the soils dumped at Ladera Linda. When winter rains come and if the plastic cap is removed the known carcinogenic pesticides will leach out onto the fields and slide down hill towards the Ladera Linda Community Center. The fields will become wet with known pesticides and children's soccer balls will roll through the water. The children will pick up the ball, and put their hands in their mouths. Now the dermal exposure and internal exposure of carcinogenic pesticides has happened. Then the dry season will create a dust of contaminated soils with Santa Ana winds. Who's going to be responsible for that? Why didn't PVPUSD and AYSO take care of this in December 2015? Case in point; One of the AYSO officials was positive that the soil came from some "Trump Homes" construction. When that theory was debunked by the Trump C-22 manager, the AYSO official quickly recanted his theory and said that the soil was from a home remodel and the construction of two swimming pools in Torrance. "Not so" said the Torrance building department which said "at most, 300 cu. yds. was exported. The Bills of Lading suggest that 85 truckloads were brought to Portuguese Bend; that equates to about 1100 cu.yds...... so where did the other 900 cu.yds. come from? DTSC is mum on that enigma Someone is LYING. The bills of Lading appear to be made up after -the -fact and suggest that soil came from 5433 Sharynne St. in Torrance "Minor errors" like this are fully incorporated into DTSC's analysis, and there are lots of them to chase down. I think it prudent for RPV to ask DTSC for more time to allow for more public scrutiny of their report. I'm suggesting that their date be moved to the end of January 2018 and solicit your support to make that happen in the interest of real public participation by a solid RPV community.
