BACKGROUND On April 21, 2015, Mayor Pro Tem Brooks presented an item in Study Session, recommending that Staff initiate updates to the City's film permit fees. The City Council unanimously agreed with this recommendation. On May 19, 2015, while discussing future agendas in Study Session, the City Council gave direction to broaden the scope of the film permit fee review to include a larger discussion of the impacts of filming in the community. Staff now presents this discussion for the City Council's review at tonight's meeting, prior to scheduling a duly -noticed public hearing for any proposed changes to the City's film permit fee schedule. DISCUSSION Film Permit Regulations, Procedures and Fees The City permits commercial filming in all zones with the issuance of a film permit by the City Manager's Office. This is codified in Chapter 9.16 of the Rancho Palos Verdes Municipal Code (RPVMC), and is supplemented by Administrative Instruction No. 1-13 "Film Permits," both of which are attached to tonight's report. RPVMC Chapter 9.16 was 1 MEMORANDUM: Film Permit Policy, Procedure and Fee Review June 2, 2015 Page 2 last updated in May 2012 when Sections 9.16.030.0 and D were added to provide a limited exemption for group photography and videography on City property. Administrative Instruction No. 1-13 has not been updated since it was added to the City's Administrative Instruction Manual on June 1994. Staff believes that it would be useful and appropriate to update these instructions, incorporating any direction given by the City Council. The City's current film permit fees were established by Resolution No. 2010-77 in September 2010. An excerpt of this resolution including the film permit fees is attached to tonight's report. These fees have not increased since they became effective in November 2010. Staffs recommendations for changes to these fees are discussed separately below. For the City Council's reference, a complete film permit application generally requires permittees to submit the following: • Completed and signed film permit application form • Completed and signed "hold harmless" agreement • Current City business license application (or proof of current business license) • Insurance certificate listing the City as an additional insured for a minimum of $1 million • Copy of approved permit from the Los Angeles County Fire Department • Copy of approved encroachment permit by the City's Public Works Department (for driving shots or other use of public right-of-way, if proposed) • Copy of quote/invoice from Los Angeles County Sheriff's Department (for driving shots and intermittent traffic control, if proposed) • Payment of film permit and business license fees Film Permit Trends Attached to tonight's report is a summary of film permit activity from the third quarter of 2007 to date. This data indicates that film permit activity has fluctuated widely from year to year, and is largely unpredictable. However, Staff has observed a few seasonal trends in film permit activity in the City over the years: • Location television production often increases in the 1St and 3rd quarters of the year with the production of pilots and mid-season "cliffhanger" and season finale episodes; • Student film productions often increase in the spring and fall as thesis projects come due; 051 MEMORANDUM: Film Permit Policy, Procedure and Fee Review June 2, 2015 Page 3 • Television commercial production often increases in the 3rd and 4t" quarters of the year in the run-up to the holiday shopping season and the Super Bowl; and, • Motion picture production remains fairly unpredictable. Staff finds that the majority of film permit applications are fairly routine, do not adversely affect the City's residents and do not require an inordinate amount of Staff time and resources to process. This is at least in part because there are only a relative handful of popular filming locations in the City, including (but not limited to): • Trump National Golf Club • Portuguese Bend Club • Terranea Resort • Wayfarers Chapel • Abalone Cove Shoreline Park • Point View/Catalina View Gardens • Private residence at 3300 Palos Verdes Dr. W. • Private residence at 3 Yacht Harbor Dr. Similarly, these "routine" types of film shoots do not usually generate complaints from the community. This seems to be because several of these locations are not in residential neighborhoods, and those that are often require the notification of nearby neighbors as a condition of permit issuance. Productions that have created impacts upon surrounding communities and/or a greater demand on Staff resources tend to be those that propose driving shots and/or other activity within the City's public rights-of-way, and those that have multiple locations and/or are more than a few of days in duration. Recent Film Permit Activity and Issues In March 2014, the City Council agreed to support Assembly Bill No. 1839 to increase the State's film tax credit program and keep more location filming in California. A support letter was sent to Governor Brown in August 2014 (see attachments), and the bill was signed into law in September 2014. The newly funded round of tax credits will not become available for in-state location productions until on or after July 1, 2015. The first quarter of 2015 was exceptionally busy for film permits. Within the space of three (3) months, Staff issued twenty-six (26) film permits (plus another four (4) applications that were canceled prior to issuance) and collected over $71,000 in film permit -related revenue. This compares to a total of forty-two (42) permits issued and just over $57,000 in film permit -related revenue collected for all of 2014. However, as soon as the second quarter of the year began, film permit activity dropped off steeply to "normal" levels, with two (2) permits issued in April and three (3) permits issued in May. 3 MEMORANDUM: Film Permit Policy, Procedure and Fee Review June 2, 2015 Page 4 Staff has received a few inquiries about filming in June and July, but at this point we expect to issue only a few permits per month through the summer. Over the past few years, Staff has noted a few recurrent issues with film permits that have been raised by residents. To address these, Staff has adjusted its permit review procedures, and has added or modified standards conditions of approval as applicable. However, to some extent these issues remain not fully resolved. Base Camp and Cast/Crew Parking at Trump National Golf Club: Trump National Golf Club has become very popular for location productions, both as a filming backdrop and a location for other productions to set up their production "base camp" and cast/crew parking areas. Filming activity at the clubhouse and/or on the golf course seems to generate little public concern since it is usually located relatively far from nearby residences. However, the use of the vacant lots near the driving range and/or the maintenance yard for base camp and parking continue to draw complaints about early morning and late night light and noise. Staff has begun to require productions to obtain neighborhood signatures for the use of the maintenance yard before 7:00 AM or after 7:00 PM. Staff also routinely requires productions not to direct lights or amplified sound toward nearby homes. However, nearby neighbors continue to complain about this activity. Staff believes that prohibiting the use of the maintenance yard and vacant lots nearest to the Seaview and Portuguese Bend Club communities for extended -hours base camp and parking activities may be needed to address this issue. Driving Shots on Palos Verdes Drive East and Palos Verdes Drive South: Palos Verdes Drive South and Palos Verdes Drive East are consistently popular for driving shots for feature films, television shows and car commercials. Most driving shots require intermittent traffic control by Sheriff's deputies (paid for directly by the production companies) and result in relatively minor delays for motorists and bicyclist. However, one major motion picture production this past February required a 24-hour closure of the seaward lanes of Palos Verdes Drive West/Palos Verdes Drive South between Hawthorne Boulevard and Terranea Way. Although a traffic control plan was prepared and reviewed by the Public Works Department, and advance notice was provided via reader boards and social media, there was still a great deal of traffic congestion during morning, midday and evening peak hours. Since the City normally limits driving shoots on major arterials to off-peak hours from 9:00 AM to 3:00 PM, this production paid nearly $3,200 in extended hour fees for the 24-hour lane closure (the total City fees paid for this shoot exceeded $13,100). Nevertheless, complaints about potential or actual traffic delays from driving shots remain among the most common that Staff receives about film permits. Staff believes that prohibiting driving shots outside of non -peak hours; prohibiting weekend driving shots on Palos Verdes Drive East/South/West; and prohibiting roadway closures may be need to address these issues. al MEMORANDUM: Film Permit Policy, Procedure and Fee Review June 2, 2015 Page 5 Extended Hours Filminq Activity at 3 Yacht Harbor Drive: The City Council may recall that the development of the large single-family residence at 3 Yacht Harbor Drive in the Portuguese Bend Club community was very controversial for residents in the nearby Seaview community when it was being completed in the mid -2000s. Since its completion, the home has been used for several film shoots. Problems have arisen, however, when filming has been proposed outside of the City's standard 7:00 AM -to -7:00 PM, Monday - through -Saturday filming hours. In these instances, the City has required neighbor signatures from more than a dozen neighbors abutting or across Palos Verdes Drive South from the property. Although production companies have been able to obtain the needed signatures, it has not stopped complaints from the neighbors. However, when filming activity has occurred during regular hours without neighborhood notification at this location, Staff has not received complaints. The house at 3 Yacht Harbor Drive is among a handful of unique single-family homes that have become popular for location filming. Other similarly -popular homes have occasionally drawn complaints about extended - hours filming, but not as many as this location has. If the City Council were to consider prohibiting extended -hours filming this location, Staff would recommend extending this prohibition Citywide. However, Staff also believes that prohibiting extended -hour filming will reduce the City's attractiveness for location filming in general (see discussion below). Aside from the issues listed above, Staff has not noted major, recurring complaints about filming activity in the City. Many times, cast and crew members are arriving and departing from the City during non -peak hours and, with the exception of driving shots, are not interfering with the flow of traffic on the City's major arterial roadways. Staff does not publicize details about filming in the City unless it is likely to affect public access to a park or roadway. Staff does share information about major productions with the Los Angeles Times (which reports weekly on location filming in Los Angeles in the Wednesday Business section), but this information is frequently published after -the -fact and does not contain details about specific filming locations. As a result, Staff is not aware of impacts upon the City as a whole as a result of movie fans trying to find or watch filming activity as it occurs. Film Permit Policy and Procedure Recommendations Based upon the foregoing discussion, Staff suggests considering possible changes to the City's film permit policies and procedures: Extended Hours Filming: The City currently permits filming on Sundays and before 7:00 AM and after 7:00 PM on other days with the payment of an extended -hours fee of $177.00 per hour. Aside from whether or not this fee is adequate compensation for the impacts of extended hours filming, the City Council may wish to consider whether or not to permit extended hours filming at all. Currently, Staff requires production companies to 5 MEMORANDUM: Film Permit Policy, Procedure and Fee Review June 2, 2015 Page 6 obtain neighbor signatures as a condition of permit issuance when extended -hours activity is proposed. The total number of signatures varies depending upon location and circumstances, but 100% compliance is required. Prohibiting extended hours filming is likely to reduce impacts upon neighbors and complaints to the City. However, it is also likely to substantially reduce the attractiveness of the City for location filming since permitted hours in many other jurisdictions are frequently longer (e.g., 5:00 AM to 10:00 PM), especially Mondays through Saturdays. As the City receives very few requests for filming on Sundays, however, it may make sense to simply prohibit Sunday filming activity. Drivinq Shots on Major Arterials: The City currently permits driving shots on major arterials (i.e., Palos Verdes Drive East/South/West, Hawthorne Boulevard, Crest Road, Crenshaw Boulevard, Miraleste Drive, Highridge Road, Crestridge Road, Silver Spur Road, Montemalaga Drive and Western Avenue) during off-peak hours from 9:00 AM to 3:00 PM. If filming outside of these hours is proposed, the extended -hours fee ($177.00/hour) is also charged. Similar to the issue above, the City Council may wish to consider whether or not to permit during shoots outside of off-peak hours at all. Doing so would prevent the type of long-term lane closure that occurred earlier this year and the resultant impact upon residents. Since most production companies are used to filming driving shots during off-peak hours, Staff does not believe that this will diminish interest in filming on the City's streets. Staff believes that prohibiting weekend driving shots on Palos Verdes Drive East/South/West and prohibiting complete road closures for driving shots are worth considering. Limits on Duration and/or Number of Permits: The City does not currently limit the duration and/or number of film permits that may be issued for a particular location within a given period of time. Staff does try to ensure that no more than one (1) production is on-site at a given location or in a particular neighborhood or area at any time. The table below summarizes activity at the most frequent filming locations during 2014. However, the City can always revisit this issue in the future of film permit activity trends change dramatically. no MEMORANDUM: Film Permit Policy, Procedure and Fee Review June 2, 2015 Page 7 Film Permit Monitoring: Currently, the City requires production companies to pay for Recreation & Parks Staff to monitor filming activity on City property at a cost of $25.00/Staff member/hour. Due to the limited available of the City's part-time Staff, it is sometimes difficult to arrange for this monitoring for permits issued on City property. Staff does not believe that the City has the current capacity to extend such monitoring to filming on private property. Instead, Staff relies upon permittees and property owners to abide by and enforce the conditions imposed on film permits on the "honor system." Although Staff finds that this generally works, there are occasional instances where Staff needs to contact permittees during production to remind them of permit conditions. This can be problematic when filming activity is occurring outside of regular City Hall office hours. The City Council may wish to consider creating a new, part-time classification for "film production monitor" who could be trained to monitor filming on both City and private property. Staff is also aware of at least one private firm that provides such services to cities, so it could be possible to enter into a professional service agreement to provide monitoring on an "on call" basis without adding to the City's payroll. Administrative Instruction No. 1-13 "Film Permits". Staff recommends that this instruction be updated, including any revisions to film permit policies or procedures as directed by the City Council. Film Permit Fee Recommendations Preliminarily, it should be noted that there is a significant distinction between fees that the City may charge for use of City properties, including City streets and parks, and fees that relate to filming that will occur solely on private property. Fees that the City imposes for use of its properties are not subject to the constraints that are imposed by State law upon fees charged by the City for services that it provides, which must be based upon the cost to the City of providing the particular service. In this case, Staff will need to analyze and bring back to the City Council proposed fees for issuing and/or monitoring a City film permit for filming that occurs on private properties. As noted in the April 21St Study Session report, the major fee disparities compared to other jurisdictions were the City's low daily use fees for City property and the lack of daily use fees for private property. Based upon past experience, Staff believes that City properties located seaward of Palos Verdes Drive South and West are the most in demand for filming. Therefore, Staff recommends charging a premium for the use of these City properties as compared to those in inland locations. This premium would also be applied for the use of the public rights-of-way of Palos Verdes Drive South and West, and also to Palos Verdes Drive East due to the popularity of the "switchbacks" as a filming location. 7 MEMORANDUM: June 2, 2015 Page 8 Film Permit Policy, Procedure and Fee Review With respect to private property, Staff recommends imposing fees that are based on the cost of processing the permit and any monitoring by Staff that is required. These City costs will have to be analyzed and will be provided to the City Council at the public hearing that will be conducted when the new fees are established. Also, since Staff has found that still and video productions are typically much less impactful than movie and television production, their daily use fees on City properties should be lower. Currently, these revenues accrue in the City's General Fund and may be expended for any purpose that is approved by the City Council. The City Council may wish to consider designating film permit revenues for particular purposes that benefit the City's residents as part of the budget process, such as offsetting the cost of Whale of a Day, the annual July 4t" celebration or other City programs. CONCLUSION Receive the Staff report regarding recent film permit activity and issues, and provide direction to Staff regarding any desired film permit policy, procedure and/or fee changes. MEMORANDUM: Film Permit Policy, Procedure and Fee Review June 2, 2015 Page 9 ALTERNATIVES Alternative actions for the City Council's consideration are discussed in the body of the report above. The City Council may identify additional alternatives as a result of discussion and/or public comment at tonight's meeting. FISCAL IMPACT There is no fiscal impact associated with reviewing the City's film permit policies, procedures and fees. However, subsequent changes to these policies, procedures and fees may make the City less attractive for future location filming, which is likely to affect future film permit revenues. For FY 2014-15, the City was projected to take in $45,000 in film permit -related revenue. The draft FY 2015-16 budget currently projects $60,000 in film permit -related revenue. DISCUSSION We have been advised by Staff on several occasions this year about the surge in location filming activity in the City. During the first quarter of 2015 alone, the City collected more than $71,000 in film permit and business license fees for location filming in the City, exceeding the total film permit revenue collect for the entire 2014 calendar year by twenty- three percent (23%). However, with this increased filming activity have come increased complaints from residents about the effect of this activity upon their quality of life. My question—and that of many constituents—is whether or not the film permit fees collected by the City justify the inconvenience caused to residents and cover the City's costs to process these permits. Preliminary figures on the film permit fees collected by other South Bay and coastal communities are summarized in the attached matrix. A review of this matrix suggests to me a few issues that call for additional research: • The maximum daily use fee for City property (i.e., parks and public right-of-way) in Rancho Palos Verdes is $822. Many other jurisdictions appear to be collecting much higher daily use fees for City property, particularly beach communities such as Hermosa Beach, Malibu, Manhattan Beach and Santa Monica. The City does not collect daily use fees for filming on non -City property. Many other jurisdictions appear to collect such fees. 10 STUDY SESSION: Film Permit Fees April 21, 2015 Page 2 • The City charges lower film permit application fees for filming on non -City property than it does for filming on City property. Many other jurisdictions appear to collect the same fee for all film permit applications on both public and private property. Aside from the City's stunning natural beauty and unique locations, I believe that the City's comparatively low film permit fees may also be luring an inordinate amount of location filming to the City. This City Council has supported location filming as an important regional economic driver in the past. However, the desire to support the film industry must be balanced with the obligation that we owe to our constituents to protect the unique quality of life in the City. Therefore, I ask my City Council colleagues to join me in directing Staff to prepare a comprehensive survey of film permit fees, and to return to the City Council with recommendations for any revisions to the City's film permit fee schedule at a future date to be determined. Commercial still photography and videography on city -owned property for groups of individuals, where no props are being used in the photographs and/or videos, and where the photographs and/or videos are for the private and non-commercial use of the person(s) being photographed and/or recorded; provided that all city regulations and policies for the use of the city property are observed at all times; and provided that no group may utilize the property for photographic and/or videographic purposes for more than forty-five minutes within a twenty -four-hour period. D. Commercial still photography and videography on city -owned property for groups and/or individuals when occurring in conjunction with the authorized use or rental of the city -owned property for an event, pursuant to an approved rental agreement with the city, provided that all city regulations and policies for the use of the property are observed at all times. Any person desiring a permit under the provisions of this chapter shall make application on the appropriate form provided by the city manager or his designee. Such application shall be submitted at least three working days prior to the date on which such person desires to conduct an activity for which a permit is required. If such activity interferes with traffic, application should be made two weeks in advance. The city manager may waive the requirement that applications be filed three days in advance when in his/her opinion neither the city nor general public will be inconvenienced or harmed by his/her doing so. (Ord. 147 § 1 (part), 1982) 9.16.050 - Permit fees. Each application shall be accompanied by a fee as established by resolution of the city council. (Ord. 147 § 1 (part), 1982) 9.16.060 - Permit issuance—Conditions. The city manager shall issue a permit as provided for in this chapter when, from a consideration of the application and from such other information as may be otherwise obtained, he/she finds that: A. The conduct of such activity will not unduly interfere with traffic or pedestrian movement or endanger public safety. That no residential streets will be completely closed to traffic and that prior to any filming, etc., the concerned residents will be notified in writing two weeks beforehand. B. The conduct of such activity will not unduly interfere with normal governmental or city operations, threaten to result in damage or detriment to private or public property, or result in the city incurring costs or expenditures in either money or personnel not reimbursed in advance by the applicant. C. The conduct of such activity will not constitute a fire hazard and all proper safety precautions will be taken. The decision of the city manager to issue, conditionally issue, or not issue a permit shall be final Rancho Palos Verdes, California, Code of Ordinances Page 2 of 4 14 Title 9 - PUBLIC PEACE, MORALS AND WELFARE Chapter 9.16 - STILL PHOTOGRAPHY, MOTION PICTURE AND TELEVISION PRODUCTIONS unless appealed in writing within five working days of the decision by requesting a hearing of the city council at the next available meeting. (Ord. 147 § 1 (part), 1982) 9.16.070 - Cost of additional services. If deemed necessary by the city manager, additional sheriff, fire, lifeguards, and other city services shall be provided for the purpose of protecting, assisting and regulating the proposed activity. The cost of providing such additional services shall be paid to the city by the applicant. Any additional city services will be provided/coordinated through the city manager or his/her designee. (Ord. 147 § 1 (part), 1982) 9.16.080 - Bond insurance. The city shall require, as a condition of issuing such a permit, that the applicant furnish a bond, insurance or both in an amount of one million dollars to protect the city against claims of third persons for personal injury, wrongful death and property damage and to indemnify the city for damage to city property arising out of the permittees' activities. A copy of the bond or policy will remain on file with the application. The amount of bond or insurance may be reduced by the city manager if he/ she determines that the proposed activity has little or no liability or property damage risk, or increased if in his/her opinion the type of activity being conducted warrants a higher amount. (Ord. 147 § 1 (part), 1982) 9.16.090 - Hold harmless agreement. The applicant shall execute a hold harmless agreement as provided by the city prior to the issuance of any permit. (Ord. 147 § 1 (part), 1982) 9.16.100 - Conditions—Restrictions. The applicant shall comply with any conditions or restrictions the city may impose as a condition to issuing a permit pursuant to the provisions of this chapter when such conditions or restrictions relate to the provisions of Section 9.16.060 (Permit Issuance—Conditions). No changes shall be made without first obtaining the city's approval. (Ord. 147 § 1 (part), 1982) 9.16.110 - Cleanup/restoration. The applicant shall conduct operations in an orderly fashion with continuous attention to the storage of equipment not in use and the cleanup of trash and debris. The area used shall be cleaned of trash and debris within four hours of the completion of the activity and meet approval. Applicant shall be responsible for restoring any area damaged or disrupted before leaving the site. If the site is not repaired or restored to city's satisfaction, the city manager shall have the necessary restoration and/or repairs performed and shall pay for said work from the bond posted with the city for faithful performance. Violation of the provisions of this chapter is determined to be a misdemeanor and may be punishable by a fine of five hundred dollars, six months in the county jail, or by both fine and punishment. (Ord. 147 § 1 (part), 1982) Rancho Palos Verdes, California, Code of Ordinances Page 4 of 4 16 CITY OF RANCHO PALOS VERDES ADMINISTRATIVE INSTRUCTION Subject: FILM PERMITS 1. Background/Purpose A City of Rancho Palos Verdes film permit is required for any filming, video taping or professional photography on private and public property. The filming requirements of the City are dictated by the Rancho Palos Verdes Municipal Code Section 9.16.010. All film permit and location fees are listed in the film permit application packet (Attachment "A"). Film permits are processed through the City Manager's Office. II. Procedure A. When the City receives an inquiry regarding filming regulations, a complete film permit application and business license application is to be sent to the applicant. It is important to advise the applicant of the following: 1. The film permit application must be completed and returned to the City prior to the City reviewing the filming request; 2. As all businesses that operate in the City are required to possess a City of Rancho Palos Verdes business license, a business license application must be included with the film permit application; 3. All permit, location and business license fees must be paid at the time the permit application is first submitted to the City, unless an alternative arrangement is made; 4. The completed film permit application must be received by the City at least three working days prior to desired filming. However, depending on the nature and location of the filming, a longer review period may be required; 5. Any requested changes to the film permit application after it has been submitted to the City must be reported to the City immediately; 6. If the desired filming is to be conducted on private property, it is the responsibility of the applicant to obtain the approval, via signature(s), from the property owners/managers. Depending on the time, nature and location of the filming, approval, via signature(s), from the neighboring property owners may also be required -of the applicant. In addition, approval of the Homeowners Association of which the desired private property is located 17 may also be required; and 7. A certificate of insurance naming the City of Rancho Palos Verdes as additional insured is required. B.. After receiving a completed film permit application, the application is to be reviewed so that the applicant is to be advised of the following: l . Sheriff Services - A cast and crew of 20 or more will require a Los Angeles County Sheriff's Department deputy on duty at the filming site during all hours of filming activity. This may include during the set-up and tear - down of the set. In addition, any unusual productions, such as driving shoots on City streets or late evening filming, may also require Sheriff services. It is the responsibility. of the applicant to obtain Sheriff services. The film coordinator for the Sheriff's Department is Sgt. Robinson, who may be reached at (213) 526-5541. 2. Fire Services - Any interior filming, filming utilizing pyrotechnics or similar special effects, filming in high brush areas, or late evening filming will require a Los Angeles County Fire Department representative on duty at the filming site during all hours of the filming. This may include during the set-up and tear -down of the set. In addition, all proposed pyrotechnics will require a fire permit issued by the L.A. County Fire Department. It is the responsibility of the applicant to obtain the fire permits and necessary fire inspector services. The fire film permits and staffing are processed through the Fire Department's Film Desk coordinator who may be reached at (213) 881-2416. 3. Lifeguard - Any filming activity in, on or adjacent to the ocean will require a Los Angeles County Lifeguard representative on duty at the filming site during all hours of the filming involving the water location. It is the responsibility of the applicant to obtain the L. A. County Lifeguard services. Lifeguard services for film permits may be obtained at (310) 827- 3832. 4. Traffic Plan - Any filming on or adjacent to any City street which may require the closure of a traffic lane(s), require the flow of traffic to be altered, or require parking to be restricted must be approved by the City's Public Works Department. The applicant is responsible for drawing up a traffic plan which is to be reviewed by the Public Works Department. 5. Other Services Required A CalTrans film permit is required if filming is conducted on any state highway, such as Western Avenue. For CalTrans permits, applicant should call (213) 897-3631. A Los Angeles County Beaches Department film permit may be required for any filming at any L. A. County Beaches location, such as the fishing access area south of Palos • Verdes Drive South near Long Point. The L. A. County Beaches Film Permit Office may be reached at (310) 305-9549. C. If the proposed filming site is a City location, then the staff coordinator for the desired site must be contacted to check on availability, staffing, and restrictions for the site. In addition, the Public Works Department should be contacted to check for any conflicting maintenance activity at the desired site. D. On larger or complex filming applications, a site visit with the applicant may be necessary. Involved agencies, such as the Public Works Department, Recreation Department, L.A. County Fire may be invited to the site visit. E. If the application is acceptable and the applicant has met all the necessary requirements, the permit application may be approved. The applicant must come to City Hall to pick up the film permit (Attachment "B") and pay any unpaid or additional fees that may be required. ADVANCE NOTICE FOR .APPROVAL An applicant is required to submit a completed film permit application at least three (3) working days prior to the date on which such person desires to conduct an activity for which a permit is required. Fourteen (14) days are required for a partial road closure. Please note, the City of Rancho Palos Verdes does not allow full road closures for filming activities. Additionally, applicant may be required to provide advance notice W 6a of approval to all appropriate residents of the filming activities as determined by the Film Permit Coordinator. 3. FEES AND DEPOSITS Film permit applications must be accompanied with the proper application and business license fees to be processed by the City. The fees are as follows: A. USE CHARGES Filming, videotaping, still photography and other productions on public (City) property requires payment of a use charge. LIABILITY & INSURANCE PROVISIONS The applicant is required to provide the following: A. LIABILITY INSURANCE: A certificate of insurance is required in the amount of one million dollars ($1,000,000) naming the City of Rancho Palos Verdes, its officers and employees as co --insured for protection against claims of third persons for personal injuries, wrongful deaths and property damage unless greater or lesser coverage is requested and approved by the Film Permit Coordinator. The certificate shall not be subject to cancellation until after thirty (30) days written notice to the City of Rancho Palos Verdes. If the applicant is conducting pyrotechnics or other special effects, the amount specified in the certificate of insurance, upon request of the City Manager or designee, may be increased. 4 B. WORKERS' COMPENSATION INSURANCE: In 1991, The State of California amended the Labor Code relating to Workers' Compensation. The amended law requires that every employer who applies for any license or renewal of any license for a business must provide proof of valid workers' compensation insurance or proof of compliance with self --insurance provisions. If the company seeking a business license and permit to film in the City, employs more than one person, a copy of the company's workers' compensation certificate must be attached to the business license application (green form) in order for the film permit to be processed. If you are self- employed, be sure to sign the business license application (green form) which states you do not employ any person(s) to become subject to the Workers' Compensation law in California. C. HOLD Hi►RMLESS AGREEKENT: An applicant will execute a Hold Harmless Agreement. Agreement is attached. 7. PUBLIC RIGHT OF WAY A City of Rancho Palos Verdes Parking and Traffic Safety Plan is required for the posting of temporary "No Parking" signs, parking of equipment and/or vehicles on public streets, stringing cable on sidewalks or from a generator to service point, sidewalk shots or driving scenes. A sample Parking and Traffic Safety Plan is available upon request. 8. TRAFFIC CONTROL For filming that would impair traffic flow, an applicant shall employ a Deputy from the Los Angeles County Sheriff's Department and comply will all traffic control requirements deemed necessary by the RPV Public Works Department. The applicant shall be responsible for the proper placement of all traffic safety materials according to the approved Parking and Traffic Safety Plan and as directed by the Sheriff's Department. The applicant shall be responsible for supplying all the required materials, as well as transportation and placement. Again, please note the City of Rancho Palos Verdes does not allow full road closures. Additionally, driving scenes on major arterial roads are generally not permitted between the hours of 7:00 a.m. - 9:30 a.m. and 2:00 p.m. - 6:00 p.m. 25 5 9. COORDINATION WITH OTHER AGENCIES Before obtaining a film permit, the following agencies shall be contacted in the following circumstances: A. THE FOLLOWING AGENCIES WILL ALWAYS BE CONTACTED: (1) LOS ANGELES COUNTY SHERIFF'S DEPARTMENT: The L.A. County Sheriff's Department must always be contacted regarding any filming activities in the City. The Sheriff's Department will determine if any public safety services are necessary, including whether or not a Deputy should be assigned to be on site during filming activities, as well as any fees to be charged. The Sheriff's Department fees are in addition to City fees and are paid directly by the applicant to the Sheriff's Department. (2) LOS ANGELES COUNTY FIRE DEPARTMENT: The L.A. County Fire Department must always be contacted regarding any filming activities in the City. The Fire Department will determine if the services of a Fire Safety Advisor or Officer are necessary. If a Fire Safety Advisor or Officer is assigned to the production, a fee will be charged. The Fire Department fees are in addition to city fees and are paid directly by the applicant to the Fire Department. B. THE FOLLOWING AGENCIES WILL BE CONTACTED IN THE FOLLOWING CIRCUMSTANCES: (l) RPV ENVIRONMENTAL SERVICES DEPARTMENT Environmental Services Department approval is required for any environmental issues, including temporary construction of sets, grading and after regular business hours filming (prior to 7:00 a.m. and after 7:00 p.m.), etc. (2) RPV PUBLIC WORKS DEPARTMENT: The Public Works Department shall review all film permits that involve the use of City streets. Brown, Jr. Governor of California State Capitol, Suite 1173 Sacramento, CA 95814 SUBJECT: AB 1839 (Gatto): Income Taxes: Qualified Motion Pictures Letter of Support Dear Governor Brown, I am writing on behalf of Mayor Jerry Duhovic and the Rancho Palos Verdes City Council in support of enhancing California's film and television production tax credit program. It is an action we must take to stop California from losing revenues and middle class jobs to other states and nations. With a prime coastal location in the "30 -Mile Zone," Rancho Palos Verdes hosts a moderate amount of location filming each year, and would suffer from the economic impact of these job losses. The Rancho Palos Verdes City Council previously expressed its support for AB 1839 on March 18, 2014. California has rapidly lost nearly all big budget feature film production and most television production to other states and nations that have ramped up their incentive programs. In 2012, only one big budget feature film was shot entirely in California, and in 2013, only 39 out of 137 one-hour television series were filmed here. The number of film and television productions that want to remain in California far exceeds the resources available within the state's current incentive program. According to the California Film Commission, less than one in every ten projects received California's incentive in 2013 and only 34 projects are set to receive credits. I was pleased to read about the new $400 million per year tax credit expansion passed by the Senate Committee on Appropriations. Their vote to also change the allocation system from a lottery system to one that is based on job creation and economic impact makes good financial sense.
