RPVCCA_CC_SS_2015_05_19_SS2_Revisiting_Skateboard_OrdinanceCITY OF MEMORANDUM L 11 RANCHO PALOS VERDES TO: CITY COUNCIL MEMBERS FROM: � SUSAN BROOKS, MAYOR PRO TEM DATE: MAY 19, 2015 SUBJECT: CITY WIDE RESTRICTION ON SKATEBOARDING IN THE PUBLIC RIGHT OF WAY RECOMMENDATION Direct staff to proceed with initiating a citywide ban on skateboarding in the public rights of way. DISCUSSION On July 3, 2012, City Council adopted Resolution No. 2012-47 which establishes prohibition of skateboards and similar non -motorized wheeled devices on certain streets throughout the City, pursuant to the Municipal Code. Since adoption and despite the erected signs prohibiting the activity, the presence of skateboarders continues on Crest Road, Palos Verdes Drive East and other similar streets, particularly at dusk. In order for the Sheriffs Department to enforce the municipal code, signs must be erected on the street where the prohibition exists. Over time, the signs are defaced, damaged and/or stolen from the location, making it difficult for the Sheriff's Department to conduct proper enforcement. According to staff, the following streets currently have skateboarding restrictions: Via Colinita Palos Verdes Drive East Miraleste Drive Ganado Drive Crest Road (East & West) Silver Arrow Drive Hawthorne Blvd Crenshaw Blvd Browndeer Lane Verde Ridge Road Locklenna Lane r i Since the adoption of Resolution No. 2012-47, the following streets have reported skateboarding issues and have requested to be added to the restriction list: Casilina Drive Lucania Drive Crownview Drive Knoll view Drive Highpoint Road Grandpoint Lane As restrictions are imposed, the skateboarders relocate their activities to streets that do not have restrictions. According to the Lomita Sheriff's station, 3-4 complaints a week are received regarding skateboarding activity, particularly "bombing" on Crest Road and Palos Verdes Drive East and mostly during the evenings. As we increase the number of streets that restrict skateboarding, we in turn, push the issue into neighborhoods that do not have the restrictions. Further, the number of signs will increase, resulting in sign blight. In 2012, the City of LA adopted an ordinance to prohibit "bombing" resulting in skateboarders having to follow the rules of the road. The Cities of Palos Verdes Estates and Rolling Hills Estates both prohibit the use of skateboards on roadways. As a potential solution, I request the City Council to direct staff to return with a recommendation to modify the City's Municipal Code to prohibit skateboarding citywide. Attachments Ordinance 371 (page 3) Resolution No. 2012-47 (page 8) Resident Request Letters and Correspondence (page 10) K ORDINANCE NO. 371 AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES ESTABLISHING REGULATIONS APPLICABLE TO SKATEBOARDS, ROLLER SKATES AND INLINE SKATES UPON PUBLIC AND PRIVATE PROPERTY AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE WHEREAS, California Vehicle Code Section 21967 authorizes cities to adopt rules and regulations prohibiting or restricting persons from riding or propelling skateboards on highways, sidewalks, or roadways subject to the provisions of Vehicle Code Section 21968; and WHEREAS, California Vehicle Code Section 21968 prohibits the use of motorized skateboards on any sidewalk, roadway, or any other part of a highway or on any bikeway, bicycle path or trail, equestrian trail, or hiking or recreational trail; and WHEREAS, California Vehicle Code Section 21969 further authorizes cities to adopt rules and regulations prohibiting or restricting persons engaged in roller skating on highways, sidewalks, or roadways subject to the provisions of Vehicle Code Section 21968; and WHEREAS, the City wishes to regulate the use of skateboards, roller skates, inline skates, scooters and other similar motorized or unmotorized wheeled devices to the maximum extent permitted by law. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY ORDAINAS FOLLOWS: Section 1. Title 9 of the Rancho Palos Verdes Municipal Code hereby is amended by adding new Chapter 9.30 to read as follows: "Chapter 9.30 REGULATION OF SKATEBOARDS, ROLLER SKATES, INLINE SKATES, SCOOTERS AND SIMILAR DEVICES ON POSTED PROPERTY. Sections: 9.30.010 Skateboards, roller skates, inline skates, scooters and similar wheeled devices prohibited on posted property. 9.30.020 Posting required. 9.30.030 Penalties. Ordinance No. 371 Page 1 of 4 3 9.30.010 Skateboards, roller skates, inline skates, scooters and similar wheeled devices prohibited on posted property. No person shall, and it shall constitute a public nuisance for any person to, operate, ride, propel, or coast any skateboard, or utilize roller skates, inline skates, scooters or any similar motorized or unmotorized wheeled device having wheels less than six (6) inches in diameter, upon any private property within any zone in the city, where notice of such prohibition has been posted and is clearly visible at a minimum of two entrances to the prohibited area or in the immediate vicinity of the area where such activity is prohibited. This section shall not apply to persons participating in any program, event or class which is sponsored by the property owner in which use of the self -powered wheeled devices described herein are specifically authorized, permitted or required. 9.30.020 Posting required. The prohibition set forth in Section 9.30. 010 of this Chapter shall not apply unless a property owner posts at least two notices in substantially the following form: 'PURSUANT TO THE PROVISIONS OF SECTION 9.30.010 OF THE RANCHO PALOS VERDES MUNICIPAL CODE, NO SKATEBOARDS, ROLLER SKATES, INLINE SKATES, OR SCOOTERS ARE PERMITTED.' 9.30.030 Penalty for violation. It shall be unlawful for any person to violate any provision, or fail to comply with any of the requirements, of this chapter. Any person violating any provision of this chapter or failing to comply with any of its requirements shall be deemed guilty of an infraction and upon conviction thereof shall be punishable by: (1) a fine not exceeding one hundred dollars for a first violation; (2) a fine not exceeding two hundred dollars for a second violation within one year; (3) a fine not exceeding five hundred dollars for each additional violation within one year." Section 2. Title 12 of the Rancho Palos Verdes Municipal Code is hereby amended by adding new Section 12.16.120 to Chapter 12.16 to read as follows: "12.16.120 Skateboards, roller skates, inline skates, scooters and similar wheeled devices prohibited on public property. A. No person shall, and it shall constitute a public nuisance for any person to, operate, ride, propel, or coast any skateboard or scooter, or utilize roller skates, inline skates or any similar unmotorized wheeled device having wheels less than six (6) inches in diameter, upon any public street, sidewalk, alley, or roadway within the city, where such public street, sidewalk, alley, or way is designated by resolution of the City Council as closed to such activities and where notice of such prohibition has been posted and is clearly visible in the immediate vicinity where such activity is prohibited. No person shall, and it shall constitute a public nuisance for any person to, operate, ride, propel, or coast any skateboard or scooter, or utilize roller skates, inline skates or any similar motorized or unmotorized wheeled device having wheels less than six (6) inches in diameter, upon any public park or other public property within any zone in the city, where such public property is designated by resolution of the City Council as closed to such activities and where notice of such prohibition has been posted and is clearly visible at a minimum of two entrances to the prohibited area or in the immediate vicinity of the area where such activity is prohibited. C. The notices required by paragraphs A and B of this section shall be in substantially the following form: 'PURSUANT TO THE PROVISIONS OF SECTION 12.16.120 OF THE RANCHO PALOS VERDES MUNICIPAL CODE, NO SKATEBOARDS, ROLLER SKATES, INLINE SKATES, OR SCOOTERS ARE PERMITTED.' D. This section shall not apply to persons participating in any city -sponsored program, event or class in which use of the self -powered wheeled devices described herein are specifically authorized, permitted or required." Section 3. The City Council declares that, should any provision, section, paragraph, sentence, or word of this ordinance be rendered or declared invalid by any final action in a court of competent jurisdiction, or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences and words of this ordinance shall remain in full force and effect. Section 4. The City Clerk shall cause this Ordinance to be posted in three (3) public places in the City within fifteen (15) days after its passage, in accordance with the provisions of Section 36933 of the Government Code. The City Clerk shall further certify to the adoption and posting of this Ordinance, and shall cause this Ordinance and its certification, together with proof of posting, to be entered in the Book of Ordinances of the Council of this City. Section S. This Ordinance shall go into effect and be in full force and effect at 12:01 a.m. on the thirty-first (31 st) day after its passage. This prohibition is necessary to reduce traffic hazards created by skateboarders and other users of non -motorized vehicles on steep streets within the City and, accordingly, is necessary to protect the health, safety and welfare of pedestrians, motorists and persons operating skateboards and other non - motorized devices on these streets. For these reasons, the City Council finds pursuant to Section 12.16.120 of the Rancho Palos Verdes Municipal Code, that the prohibition of skateboards and other similar non -motorized wheeled devices on the streets listed in Section 2 of this Resolution is necessary to avoid the adverse impacts upon public safety caused by the use of these activities at these locations. Section 2. Designation of Prohibited Streets. Based upon the findings in Section 1, the use of skateboards, roller skates, inline skates, non -motorized scooters and other similar non -motorized devices with wheels of six inches or less in diameter is hereby prohibited on the following streets: Via Colinita Palos Verdes Drive East Silver Arrow Drive Hawthorne Blvd Ganado Drive Crest Road East Crest Road West Crenshaw Blvd Browndeer Lane Verde Ridge Road Locklenna Lane Miraleste Drive Section 3. We know have an increase in skateboarders, traveling at greater speeds, with and without helmets, generally in groups of two to six young boys, and occasionally followed by an automobile. Our concerns are simply one of safety for our residents, our children and the skateboarders themselves. When traveling at the high speed skateboarders cannot have control of their skateboards and ultimately could have an accident causing bodily harm to one of our residents or to themselves. It is not safe to allow skateboarding on the streets of Rancho Palos Verdes. We would respectfully suggest that all skateboarding be prohibited on the streets of RPV. These kids are coming from San Pedro and are moving very quickly down the streets and risking their lives and those of residents who dare to drive or even walk the streets with or without their dogs. Residents on Ganado have complained constantly about the danger involved and the fact that the kids are still skateboarding anyway. I really think that between sign blight and expense, our best answer is to outlaw skateboarding altogether, place Signage at each entrance to the city ( as in PVE) and get the Sheriff to enforce the law. Perhaps heavier fines will do). I'll work something up for discussion at the next Study Session. This has gotten out of hand for residents of the Eastside, in particular. Among them are the Skateboarding Ordinance which will be celebrating it's first birthday as a Future Agenda Item. Either we go forward with this or not. I am requesting a list of areas where "No Skateboarding" signs have been requested, and how many people are represented by each area. For example: Mira Catalina has 130 homes. I know that John Maniatakis, our HOA PResident made at least one request and several neighbors have, as well. Since we in RPV are all about the 2% grade allotment, I'm trying to ask Council if its their wish to plaster the city with street -by -street signage or simply post "No Skateboarding" signs at each entry, as they do in PV Estates. Anything you can do to help with this request is much appreciated. They have been seem by me and others reaching speeds between 25-30 MPH Yesterday my other inspector observed the group of 11-14 year old kids race northbound in the La Vista Verde area. Today I observed them myself racing past Sunnyside ridge. I observed an SUV dropping off the boys at Via Colonita today. 1 was on a job caravan and did not have my vehicle so could not turn around. My guess is that the SUV picks them up at the bottom of the hill before PV north? Do you think you can spread the word to the other officers to keep an eye on this? We moved to 6536 Abbottswood Drive one month before the birth of our now 'about to be'16 year old Peninsula High student, Patty. From the time she was walking until today, we've been very concerned about the speed and general recklessness of the traffic along Abbottswood. Even though the posted limited has always been 25 mph, people habitually exceed this speed limit by 15-20 mph going in both the uphill & downhill directions. We were so afraid of these speeders, that we were especially vigilant about 'child -proofing' front facing doors and windows when our daughter was a toddler: we wanted to ensure that these drivers didn't have a chance to bring tragedy into our lives. In addition to speeding cars, we also have a concern about speeding 'non -automotive' traffic. I have personally seen and cautioned roller-bladers, skateboarders and bicycle riders about the dangers of speeding along this street. During the summer, skateboarders will actually don helmets and 'lay -down' on their boards AT NIGHT. The speeds they attain blurs the vision, and thus dizzies the mind. All it would take is one resident of the street to back out of their driveway — with what would otherwise be considered adequate caution — to end a life. I applaud Mr. Ebrahimi's efforts to have the Sheriff Office patrol more vigilantly and to have RPV install speed bumps along Abbottswood. I hope you will give him and any of our other neighbors who attend this evening your undivided attention and support. Numerous residents on Crownview and the surrounding streets (Knollview Highpoint and Grandpoint) have voiced concern about the dangerous activity for both the boarders and drivers. I've called the Sheriff dept with little luck due to the factor it's legal on our street and the boarders are wearing safety attire. Other residents have called and have been instructed to call back when the boarders are present. Is there a special form for the 60% of the residents to sign or signing the letter is sufficient?? In order for Crownview to be added to the list, City Council needs to pass a resolution to add other streets. That process could take a couple of months.
