ROBINSON, HUMAN RESOURCES MANAGER�90V r� DATE: APRIL 7, 2015 SUBJECT: DESIGNATION OF MANAGEMENT REPRESENTATIVES REVIEWED: DOUG WILLMORE, CITY MANAGER RECOMMENDATION Adopt Resolution No. 2015- ; a resolution of the City Council of the City of Rancho Palos Verdes amending Resolution No. 2012-84 to change the designation of the City's principal management representative to City Manager Doug Willmore and Human Resources Manager Sean M. Robinson. BACKGROUND On November 12, 2012, the City Council adopted Resolution No. 2012-84. That resolution designated Peter Brown, the City's Labor Relations Counsel, as the City's principal management representative in consultation with Steve Larson, who at that time was serving as the City's Interim Resources Manager, to conduct negotiations with the City's employee organization and to serve and the City's principal management representative in all matters of employer-employee relations. This approval was initiated by the City Council Compensation Subcommittee, comprised of Councilwoman Brooks and Councilman Duhovic after the Subcommittee's meeting of October 18, 2012. The impetus of that meeting was the Subcommittee's review and selection of an outside representative for the purposes of engaging with the Rancho Palos Verdes Employee Association (Association) during the negotiation process. In 2014, the City Council adopted the City's "Open Ordinance," which pertains to negotiations with the City's employee organizations. In that Ordinance, Section 2.48.030 discusses who should be the City's representatives in such negotiations: "A. Unless reported as provided below, the lead negotiator on behalf of the city during the negotiation of a memorandum of understanding or amendment to a memorandum of understanding shall not be an employee of the city and shall have 1 Designation of Management Representatives April 7, 2015 Page 2 of 2 demonstrated expertise in negotiating labor and employment agreements on behalf of municipalities. The city council shall designate one or more city management employees or other individuals to be present during negotiations to assist the lead negotiator as the city council and lead negotiator deem appropriate. "B. If the lead negotiator of the city does not meet the requirements of this section, then this fact must be reported in writing at the meetings of the city council at which the memorandum of understanding or amendment is considered." DISCUSSION Given that in-house Staff, namely the City Manager and the Human Resources Manager, have extensive expertise in managing meet and confer (negotiation) proceedings with a variety of public agencies, it is in the City's best interests that current Staff fulfill the duties previously designated to the outside human resources consultant. At the City Council meeting of March 17, 2015, the City Council requested Staff be involved in fulfilling the roles of the City's designated representative along with Mr. Brown by preparing and presenting this Resolution and Staff Report. FISCAL IMPACT The prior agreement with Mr. Larson represented an annual expenditure of approximately $20,000. Adoption of the attached resolution will eliminate that expenditure from the General Fund. WHEREAS, on October 18, 2011, the City Council adopted Resolution No. 2011-85 to recognize the Rancho Palos Verdes Employees Association (Association) as an employee organization for purposes of employer-employee relations under the MMBA; and WHEREAS, Resolution No. 2011-85 designated the Human Resources Manager in cooperation and consultation with the City's labor counsel to implement the resolution in conformance with the MMBA and to serve as the City's principal management representative to meet and confer with the Association, as required by the MMBA; and WHEREAS, Resolution No. 2012-84 amended Resolution No. 2011-85 and designated Peter Brown, the City's Labor Relations Counsel, in cooperation and consultation with Steve Larson, the Interim Human Resources Manager, to implement the resolution in conformance with the MMBA and to serve as the City's principal management representative in all matters of employer-employee relations, and to serve as the City's representatives to meet and confer with the Association, as required by the MMBA." WHEREAS, the City Council wishes to change the designation of the individuals who will assist Mr. Brown in connection with representing the City in the labor negotiations; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: Section 4 of Resolution No. 2011-85 is hereby amended to read as follows: "Section 4: Peter Brown, the City's Labor Relations Counsel, in cooperation and consultation with Douglas Willmore, City Manager, and Sean M. Robinson, Human Resources Manager, is authorized and directed to implement this resolution in conformance with the MMBA and to serve as the City's principal management representative in all matters of employer-employee relations, and they all shall serve as the City's representatives to meet and confer with the Association, as required by the MMBA." Section 2: Resolution No. 2012-84 is hereby repealed. 9 Section 3: This Resolution shall take effect immediately. PASSED, APPROVED and ADOPTED this 7t" of April 2015.
