Consideration and possible action to approve a revised resolution authorizing the
Director of Public Works as signature authority for the Proposition 84 grant.
RECOMMENDED COUNCIL ACTION:
(1) Adopt Resolution No. 2017-, thereby authorizing the Director of Public Works
to sign and file, on behalf of the City of Rancho Palos Verdes, a Financial
Assistance Application for an assistance agreement from the State Water
Resources Control Board.

BACKGROUND AND DISCUSSION:
The City, with its partnering cities of Palos Verdes Estates (PVE) and Rolling Hills
Estates (RHE), applied for a Proposition 84 Grant from the State Water Resources
Control Board (State Board) for the Catch Basin Insert Project (Project) on January 14,
2016. The Project proposed to install 1,368 connector pipe screen (CPS) units in
existing catch basins draining into Santa Monica Bay, to implement the requirements for
the 2012 Municipal Separate Storm Sewer System (MS4) Permit. The CPS units
capture debris and trash and prevent both from ending up in the bay.
On December 19, 2016, the City received a notice of award from the State Board for the
Project. The total project cost is projected at $1,012,163. The grant award is $600,000
with a combined local match of $412,163.' Since 818 of the 1,368 catch basins (59.8°/x)
are located in the City, the City is responsible for $246,473 of the combined local match.
The grant request was for $708,514 with an anticipated combined local match of $303,649.

This amount is accounted for in the upcoming FY17-18 budget. The cities of PVE and
RHE are responsible for the remaining $165,690. This project will help the City meet
some of its National Pollutant Discharge Elimination System (NPDES) requirements by
addressing the Total Maximum Daily Loads (TMDLs) of marine debris under Section
303(d) of the Clean Water Act. Both PVE and RHE have written letters agreeing to their
participation with the City, and a Memorandum of Understanding (MOU) is being
prepared by the City Attorney for the adoption of all three cities.
On April 13, 2017, the City received documents required by the State Board before the
grant can be fully executed. Among the requirements is a signed Agency Resolution
authorizing a City representative as signature authority. The original Resolution was
approved and signed by City Council on May 2, 2017. The State Water Resources
Board updated the wording of the resolution and requested that a revised version be
accepted.
Staff recommends the Director of Public Works be the grant's signature authority to sign
and file a Financial Assistance Application for an assistance agreement from the State
Board for the planning, design, and construction of the Catch Basin Insert Project.
Additionally, the authorizing resolution will allow the Director of Public Works to be the
signature authority for any grant payment requests, status reports, and project
amendments.
ALTERNATIVES:
In addition to the Staff recommendation, the following alternative action is available for
the City Council's consideration:
Decline the recommendation to accept this grant. However, that would
result in foregoing nearly $360,000 in grant funds to implement this
project.

RESOLUTION NO. 2017-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES AUTHORIZING ENTERING INTO A FUNDING
AGREEMENT WITH THE STATE WATER RESOURCES CONTROL
BOARD AND AUTHORIZING AND DESIGNATING A REPRESENTATIVE
FOR THE SANTA MONICA BAY CATCH BASIN INSERT PROJECT
WHEREAS, Proposition 84, the Safe Drinking Water, Water Quality and Supply,
Flood Control, River and Coastal Protection Bond Act of 2006 ("Prop 84"), codified in
Section 1, Division 43 of the Public Resources Code ("PRC"), was approved by California
voters in the general election on November 7, 2006; and
WHEREAS, Prop 84 allocated ninety million dollars ($90,000,000) to the State
Water Resources Control Board to distribute grant money to local public agencies for
coastal water quality improvement projects pursuant to the Clean Beaches Program, PRC
sections 30915, et seq; and.
WHEREAS, the State Water Resources Control Board made eighteen million
dollars ($18,000,000) of the Prop 84 allocation money available to the Santa Monica Bay
Restoration Commission for projects that protect Santa Monica Bay beaches and coastal
waters, including projects to prevent contamination and degradation of coastal waters and
watersheds, and projects to protect and restore the Santa Monica Bay's marine,
freshwater, and terrestrial habitats; and
WHEREAS, Prop 84 requires the Santa Monica Bay Restoration Commission and
the State Water Resources Control Board to work together to ensure that all projects are
consistent with the Clean Beaches Program requirements; and
WHEREAS, the City of Rancho Palos Verdes successfully submitted a project
proposal, named the Santa Monica Bay Catch Basin Insert Project, on or before the
January 15, 2016 deadline, in which the City of Rancho Palos Verdes will partner with the
cities of Palos Verdes Estates and Rolling Hills Estates to install approximately one
thousand three hundred and sixty-eight (1,368) connector pipe screens to reduce storm
water pollution by preventing trash from flowing into the Santa Monica Bay; and
WHEREAS, procedures established by the State Water Resources Control Board
require that before such Prop 84 grant money is distributed the City Council of the City of
Rancho Palos Verdes authorize, by resolution, a City of Rancho Palos Verdes employee
as the Authorized Representative to administer negotiations, sign, and file certain Prop
84 grant documents with the State Water Resources Control Board; and
WHEREAS, the City Council desires to authorize the Director of Public Works as
the Authorized Representative.
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES HEREBY
FINDS, DETERMINES, RESOLVES, AND ORDERS, AS FOLLOWS:

Section 1. The Director of Public Works or designee ("Authorized
Representative") is hereby authorized and directed to sign and file, for and on behalf of
the City Council of the City of Rancho Palos Verdes ("City"), a Financial Assistance
Application for a funding agreement with the State Water Resources Control Board for
the Project.
Section 2. This Authorized Representative, or his/her designee, is designated to
provide the assurances, certifications, and commitments required for the financial
assistance application, including executing a funding agreement from the State Water
Resources Control Board and any amendments or changes thereto.
Section 3. The Authorized Representative, or his/her designee, is designated to
represent the City in carrying out the City's responsibilities under the funding
agreement, including certifying disbursement requests on behalf of the City and
compliance with applicable state and federal laws.
