RECOMMENDATION
Review and approve proposed City Council Policy, via Minute Order.
BACKGROUND
On September 2, 2014, the City Council granted a fee waiver for the coastal permit,
conditional use permit and environmental assessment applications for the conversion of
the former Harden Estate gatehouse at 5500 Palos Verde Drive South into the "Palos
Verdes Heritage Castle Museum." At that time, Staff noted that it was possible that the
conversion of the structure from a private residence to a public/quasi-public facility could
require modifications to the site and structures in order to comply with basic building code
life and safety requirements. In order to allow the property to be modified in a manner
that will minimize adverse impacts upon its historic character, it would be extremely
helpful to be able to apply the State Historic Building Code (SHBC) to the project (rather
than modern building code). However, in order to apply the SHBC, the City Council would
need to formally designate the Harden Estate gatehouse as a historic site. The City does
not have a historic preservation ordinance.
On December 9, 2014, the Planning Commission approved the land use entitlements for
the Palos Verdes Heritage Castle Museum.' The Mitigated Negative Declaration certified
for the project included the following mitigation measure regarding the project's potential
impact upon cultural resources:
CUL -1: Prior to the issuance of a building permit for any modifications to
the building, the City and the applicant shall agree to designate the property
and structures as a historic site for the purposes of utilizing the State

Historic Building Code (SHBC). The means to accomplish said designation
shall be determined and approved by the City Council.
In order to fulfill this mitigation measure, Staff has drafted a City Council policy for the
designation of qualified historic buildings or properties. This draft policy is now presented
for the City Council's review and approval, via Minute Order.
DISCUSSION
The attached draft City Council policy lays out criteria for the City Council to formally
designate qualified historic buildings or properties to allow the application of the SHBC.
Such designation would not confer any additional rights upon buildings or property. Only
structures that are at least seventy-five (75) years old would be eligible for designation.
As such, it only has the potential to be applied to a limited number of structures and sites
developed prior to 1940, including the Harden Estate gatehouse. Most of the other
potentially -eligible structures and sites are single-family residences in the Portuguese
Bend and Miraleste neighborhoods of the City.
In addition to a minimum age criteria, the draft policy also spells out the criteria that a
building or property must meet in order to be considered for designation. These include
at least two (2) of the following criteria:
1. Resources associated with events that have made a significant contribution to the
broad patterns of California's history and cultural heritage.
2. Resources associated with the lives of persons important in the City's past.
3. Resources that embody the distinctive characteristics of a type, period, region, or
method of construction, or represents the work of an important creative individual,
or possesses high artistic values.
4. Resources that have yielded, or may be likely to yield, information important in
prehistory or history.
5. Resources eligible for or listed on the National Register of Historic Places.
6. State historic landmarks.
7. Points of historic interest.
8. Individual historic resources.
9. Historical resources contributing to the significance of an historic district.
In addition, any building or property designated as a historic site by the Rancho de Los
Palos Verdes Historical Society shall qualify for designation under this policy (see
attached brochure and map). Such properties include the Harden Estate gatehouse, Villa
Francesca (1 Peppertree Drive) and the Point Vicente lighthouse.2
The policy envisions that the City Council would confer historic status on buildings or
properties by the adoption of a resolution, based upon evidence presented by the

requesting party and information available in the City's files, public records and from other
sources. The City Attorney has reviewed and provided input on the draft policy.
CONCLUSION
In conclusion, Staff recommends that the City Council review and approve the proposed
City Council Policy for the designation of qualified historic buildings or properties, via
Minute Order.
ALTERNATIVES
In addition to the Staff recommendation, the following alternative actions are available for
the City Council's consideration:
1. Approve the proposed City Council Policy, with further changes to Staff's
recommended language read into the record of tonight's meeting.
2. Direct Staff to make further changes to the recommended language of the
proposed City Council Policy, and continue this matter to a future City Council
meeting for review and approval.
3. Do not approve the proposed City Council Policy.
FISCAL IMPACT
There is no fiscal impact associated with the review of the proposed City Council Policy.
If adopted, Staff anticipates that only a few eligible property owners are likely to avail
themselves of the policy's benefits. Therefore, the additional burden upon City resources
for preparing future designation requests for the City Council's consideration are expected
to be negligible.

SUBJECT: Designation of Qualified Historic Buildings or Properties
POLICY:
To protect the integrity of significant historic resources in the City when
modifications are voluntarily sought to modernize such resources by a property
owner, the City Council may, at its discretion, designate a building or property as
a "Qualified Historic Building or Property," solely for the purpose of applying the
California State Historic Building Code (California Code of Regulations, Title 24,
Part 8) to the review and permitting of such modifications. Designation as a
"Qualified Historic Building or Property" shall not confer upon the property or
property owner any additional rights or benefits beyond eligibility to apply the
California State Historic Building Code. More specifically, designation as a
"Qualified Historic Building or Property" shall not have the effect of conferring upon
the property or property owner any rights to property tax relief pursuant to the Mills
Act (Government Code Section 50280, et seq. and Revenue and Taxation Code
Section 439, et seq.).
The City Council shall designate a "Qualified Historic Building or Property" by
resolution. In so doing, the City Council shall find that the building or property
qualifies for such designation based upon evidence presented for the City
Council's consideration. In order to qualify for designation, said evidence must
demonstrate that the building or property qualifies pursuant to at least two (2) of
the following criteria, which are derived from California Public Resources Code
Section 5024.1:
1. Resources associated with events that have made a significant contribution
to the broad patterns of California's history and cultural heritage.
2. Resources associated with the lives of persons important in the City's past.
3. Resources that embody the distinctive characteristics of a type, period,
region, or method of construction, or represents the work of an important
creative individual, or possesses high artistic values.
4. Resources that have yielded, or may be likely to yield, information important
in prehistory or history.
5. Resources eligible for or listed on the National Register of Historic Places.
6. State historic landmarks.

In addition to the above-mentioned criteria, any building or property designated as
a historic site by the Rancho de Los Palos Verdes Historical Society shall qualify
for designation at as "Qualified Historic Building or Property" by the City Council.
In order for a building to be designated pursuant to this policy, it shall not have
been constructed less than seventy-five (75) years prior to the City Council's
action.
BACKGROUND:
The City of Rancho Palos Verdes still contains a few examples of the early
residential development of the Palos Verdes Peninsula. These include homes and
other structures built during the early 20th Century under the development plans
originally envisioned by Frank A. Vanderlip, Jr. Many of these structures pre -date
the adoption of the State's first building code in 1929. When current owners decide
to upgrade these structures to modern standards, they may be faced with a difficult
choice between maintaining the historical integrity of the structure and complying
with modern building codes. In order to address this dilemma, California has
adopted the State Historic Building Code (SHBC), which may be applied to
"Qualified Historic Buildings or Properties." The SHBC requires a "Qualified
Historic Building or Property" to be "deemed of importance to the history,
architecture, or culture of an area by an appropriate local or state -governmental
jurisdiction." [emphasis added] Therefore, this policy has been enacted in order
to provide the City Council with a policy through which to make such designations
on a case-by-case basis.
This policy only confers the right to utilize the State Historic Building Code Building
for the review and permitting of modifications to existing "Qualified Historic
Buildings or Properties." It does not exempt new construction from the
requirements of the most -recently adopted version of the State Building Code. It
also does not entitle qualifying properties to property tax relief or other financial
incentives.

Minas Yerelian, Rancho Palos Verdes, provided comments regarding concerns about
the CalPERS pension program, noting that the City should withdraw from CalPERS by
offering the employees an alternate plan, such as a 401 K plan.
CITY MANAGER REPORT:
Acting City Manager Petru provided a recap regarding the recent beach closures from
August 25, 2014 through September 1, 2014, at Sacred Cove, Inspiration Point and
Portuguese Point due to unsafe weather conditions and dangerous ocean conditions at
the recommendation of the Abalone Cove Safety Task Force. She thanked the first
responders from the Los Angeles County Lifeguards, Los Angeles County Sheriff's
Department, Mountains Recreation and Conservation Authority Park Rangers, and
Recreation and Park staff for interfacing with the public regarding the reasons for the
closure.

Senior Administrative Analyst Fox provided a brief staff report regarding the request for
a waiver of planning fees related to the conversion of the Harden Estate gatehouse
located at 5500 Palos Verdes Drive South into the Heritage Castle Museum.
Discussion ensued among Council Members and staff.
Charlotte Ginsburg, stated that she was aware of the concerns raised by the public and
the Council. She reported that her intention would be to offer the location to be used by
small docent led groups in the community with an emphasis on teaching and providing
information about the local history of the Peninsula. She concluded that the property
would be preserved in its historic state and was too beautiful to be enjoyed by only one
family, noting that she and her husband wanted to share it with the community.

Vicki Mack, Palos Verdes Estates, stated that this home originally belonged to the sister
of Frank Vanderlip. She noted that the Ginsburgs wanted to make this site available for
future generations and noted that the Palos Verdes Historical Society was recently
reconstituted. She urged the Council to approve the request for waiver of application
fees.
Lloyd Greenlund, stated that this home, which was built in 1929, was to be the
Gatehouse to what was intended to be a palace built on Portuguese Bend with formal
gardens extending out to the water as illustrated on the original drawings. He noted that
part of Frank Vanderlip's vision on large estates was low density development, the
preservation of open space, and protection of open views of the coastline.
Lenee Bilski, Rancho Palos Verdes, stated that she was not in favor of the fee waiver
and noted that public discussion of the merits of the project should take place before the
applicant and City move forward on this item. She noted concerns with the policy of
historical status of homes, traffic, parking, congestion and an overall vision plan for the
Palos Verdes Drive South area. She added that a more appropriate name for
consideration could be Palos Verdes Heritage Museum.
Additional discussion ensued among Council Members.

RECOMMENDATION
Grant the requested fee waiver in the amount of $15,970.
EXECUTIVE SUMMARY
Dr. Allan Ginsburg and Mrs. Charlotte Ginsburg have recently purchased the Harden
Estate gatehouse at 5500 Palos Verdes Drive South, and have expressed a desire to
convert the property into the "Heritage Castle Museum." The facility would serve as a
historical museum, cultural center and event space that would be open to the public. The
Ginsburgs have asked that the application fees for the required planning entitlements be
waived on the basis that the "Heritage Castle Museum" is a registered non-profit
organization, and that the project will be of substantial benefit to the public. Staff believes
that the request is warranted and should be granted.
BACKGROUND
The Harden Estate gatehouse at 5500 Palos Verdes Drive South is among the oldest
remaining structures in the City. Completed in 1929, the gatehouse was intended to serve
a much larger estate that the Hardens planned to build on Portuguese Point. Edward

Harden and his wife were friends and business associates of Frank and Narcissa
Vanderlip. The gatehouse was designed by architect Gordon Kaufmann and the original
landscape design was by Frederick Olmstead. Unfortunately, with the stock market crash
in 1929; the Hardens were unable to complete their dream estate at Portuguese Point.
The Rancho de Los Palos Verdes Historical Society has designated the Harden Estate
gatehouse as a local historical site. The property has passed though the hands of only a
few private owners over the years.
In April 2014, Rancho Palos Verdes residents Dr. Allan Ginsburg and Mrs. Charlotte
Ginsburg purchased the 2.06 -acre property and buildings. A few weeks ago,
Mrs. Ginsburg met with Staff to discuss their proposal for the "Heritage Castle Museum"
on the property. The project description filed by the Ginsburgs on August 21, 2014,
states:
We are a non-profit organization and propose to renovate the gatehouse to
serve as a historical museum, cultural and educational center that will be
open to the public....We envision using the easterly portion of the
gatehouse building as a museum/exhibit space with state-of-the-art display
technology. The facility would be available for small, docent -led tours by
appointment only. We would also like to make the facility available as an
event space serving local non-profit organizations. To the maximum extent
possible, we intend to provide off-street parking for visitors on the site. We
want to be sure to host events and activities on the site are of an appropriate
size and scope so as not to adversely impact our nearest neighbors,
including the City's Abalone Cove Shoreline Park. We would also like to
work with the City to preserve the rich, historic integrity and significance of
the site, including taking advantage of the provisions of the State Historic
Building Code during renovations.
Along with the project description, the Ginsburgs have asked for a waiver of the
application fees for the Conditional Use Permit ($7,222), Coastal Permit ($3,106) and
Environmental Assessment ($5,642) that would be required for this proposal, for a total
of fee waiver request of $15,970. The Ginsburgs have provided copies of the Internal
Revenue Service (IRS) and Franchise Tax Board (FTB) documents demonstrating the
non-profit status of the "Heritage Castle Museum."
DISCUSSION
Pursuant to Section 17.78.010(B) of the Rancho Palos Verdes Development Code
(RPVDC), the City Council may grant a request to waive the fees associated with a
development application if it finds that:
1. The applicant or the beneficiary of the use or activity proposed by the applicant is
a nonprofit corporation registered with the State of California; or

2. The use or activity proposed or the activities of the beneficiary of the use or activity
proposed are charitable, educational or otherwise provide a substantial benefit to
the public; or
3. The applicant has demonstrated a financial hardship, as determined by the City
Council, on a case-by-case basis.
As discussed in the Ginsburgs' letter, the "Heritage Castle Museum" would serve as a
historical museum, cultural and educational center that would be open to the public. The
Ginsburgs are also interested in making the space available local non-profit organizations
for events. Staff understands that Mrs. Ginsburg has already reached out to the Rancho
de Los Palos Verdes Historical Society and the Palos Verdes Peninsula Land
Conservancy for their participation and support. In addition, the "Heritage Castle
Museum" -has obtained non-profit status that is recognized by both the IRS and the FTB
(see attachments). Therefore, Staff believes that granting this fee waiver request is
warranted.
ADDITIONAL INFORMATION
Non -Permitted Construction and Encroachments onto City Property
There are non -permitted structures on the property that have been the subject of City
code enforcement action under previous ownership of the property. Also, it appears that
some of the existing non -permitted structures and permitted hardscape (i.e., portions of
the driveways) may encroach upon adjacent City property (i.e., Abalone Cove Shoreline
Park). It is Staff s intention to work with the Ginsburgs as a part of the proposed planning
entitlements for the "Heritage Castle Museum" to correct existing violations related to non -
permitted construction. In the longer term, Staff desires to work with the Ginsburgs to
resolve any remaining issues with encroachments upon City property.
Historic Building/Site Designation
The City's Building Official has met with Mrs. Ginsburg to review the "Heritage Castle
Museum" proposal. Converting the structure from a private residence to a public/quasi-
public facility will require modifications to the site and structures in order to comply with
basic building code life and safety requirements. In order to allow the property to be
modified in a manner that will minimize adverse impacts upon its historic character, it will
be extremely helpful to be able to apply the State Historic Building Code (SHBC) to the
project (rather than modern building code). However, in order to apply the SHBC, the
City Council will need to formally designate the Harden Estate gatehouse as a historic
site (the designation of the property by the Rancho de Los Palos Verdes Historical Society
does not appear to be sufficient to qualify for the application of the SHBC). Since the City
does not have a historic preservation ordinance, Staff is investigating options to allow this
designation to occur though a parallel process that would also be complete by the end of
2014.

Expedited Planning Review
The Ginsburgs have advised Staff that an anonymous donor has offered to make a
substantial contribution to the "Heritage Castle Museum," contingent upon the Ginsburgs
obtaining planning entitlements from the City by the end of 2014. In order to accomplish
this, Staff has initiated an aggressive and expedited review process for this proposal:

entitlements for this proposal are unlikely to be final by the end of 2014.
Notification
The Ginsburgs have been advised of the City Council's consideration of this request at
tonight's meeting, and have been provided with a copy of the Staff report.
CONCLUSION
Staff believes that the Ginsburgs' request for a waiver of the application fees associated
with the "Heritage Castle Museum" proposal (Planning Case No. ZON2014-00332) is
warranted, based upon the required findings under RPVDC Section 17.78.010(B).
Therefore, Staff recommends that the City Council grant the Ginsburgs' request.
ALTERNATIVES
In addition to Staffs recommendation, the alternatives available for the City Council's
consideration include:
1. Deny the requested waiver of the application fees.
2. Grant a reduction in the application fees, in an amount to be determined by the
City Council.

FISCAL IMPACT
The approval of the requested fee waiver will result in the City foregoing a total of $15,970
in application fees that would otherwise be required for the processing of planning
entitlements related to this proposal. However, Staff time expended for the processing of
these entitlements is not expected to have a significant fiscal impact since the time
required to complete the planning process is already accounted for in the personnel costs
allocated in the Community Development Department's FY 2094-15 budget.

To Whom It May Concern:
This letter provides a brief summary of the proposed "Heritage Castle Museum" at the former
Harden Estate gatehouse at Portuguese Point, located at 5500 Palos Verdes Drive South. We
are a non-profrt organization and propose to renovate the gatehouse to serve as a historical
museum, cultural and educational ce'nterthat will be open to the public. A copy of our mission
statement and our IRS and FT3 documents are attached.
We envision using the easterly portion of the gatehouse building as a museum/exhibit space
with state-of-the-art display technology. The facility would be available for small, docent -led
tours by appointment only. We would also life to make the facility available as, an event space
serving local non-profit organizations. To the maximum extent possible, we intend to provide
off-street parking for visitors on the site. We want to be sure to host events and activities on the
site are of an appropriate size and scope so as not to adversely impact our nearest neighbors,
including the City's Abalone Cove Shoreline Park. We would also like to work with the City to
preserve the rich, historic integrity and significance of the site, including taking advantage of the
provisions of the State Historic Building Code during renovations.
In order to assist our organization with fundraising for this proposal, we have incorporated and
registered as a non-profit organization. To that end, we request consideration of a waiver of the
planning permit fees for this proposal under Section 17.78.010 of the City's Municipal Code.
