PALOS VERDES SUSTAINING IN PART THE APPEAL OF SAND APPROVING

PERMIT NO 1442,"AN]) ISSUING A FINAL NEGATIVE DECLARATION FOR
ENVIRONMENTAL ASSESSMENT NO. 60.1'FOR A.MASTER,PLAN FO,k THE
DE`7ELOPMENT' JOF GREEN BILLS MEMORIAL PARK CEMETERY.
WHEREAS, Green Hi��la Memorial Park Cemetery has requested
approval of'Gonditional,:Use Permit„No. 1-.55,.Variance No. 26.2,, Grading
Permit No. 1441 'a'' tnvironmental`ssessment No. 601 to allow a Master
Plan for the development of' -Green Hills Memorigl Park Cemetery at
27501 S. Western Avenue; and
WHEREAS., after, notice pursuant to_the D1.evelopment Code,,the
Planning.Commission held public hearings on Lay -,22', June 26, and
July 24, 1990, -at '.which,time. al.l'.interested parties were given the
opportunity to give testimony and present,evidence;.and

WHEREAS, on August '14, 1990, the Planning Commission adopted
P. C. Resolution xo. 9U-43 approving a,port'ion of, the master
development p1an'r, the entire site grading and setback reductions
for the. Pacifica Mausoleum;' and
WHEREAS, the applicant appealed the decision`of:the Planning
Commission and, after notice pursuant to the Development 'Code,, the
City Councilheld public hearings on 'S'eptember4'1$ '-and October' 16,
1990, and pursuant to re -notice, reopened and conducte'd'additi_onal
public hearings on January 15 and February 19, 1.991, at which time
all interested parties were given the opportunity to give.testimony
and present evidence.
NOW., THEREFORH', THE CITY COUNCIL OV.THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE,_AND,RESOLVE AS FOLLOWS:
Section `1: 'That the City Council does hereby declare that a
Negative Declaration was 'prepared in 'compliance with City and State
CEQA Guidelines and that the Council has reviewed and considered'the
contents of the Initial Study in reaching its decision. The City
Council further.finds that.the approval of this project will not
result in a significant impact. upon the environment due: to the
implementation of. the mitigation measures contained in the Negative
Declaration for Environmental'Assessment No. 601;,, -which have been
incorporated into; conditions of approval in Exhibit "A"', attached
hereto and, made a 'part hereof.
Section 2: That the granting of the Conditional Use Permit will
not be contrary to the objectives of the General Plan in.that.the
development of the site in conformance with the proposed Master Plan
and related uses comply with the General Plan and zonin.g.,.land use
designations.
Section 3: That the subject -site s'adequate in size and shape
to accommodate the intended use, sub•ject,tq,the conditions of- approval
contained in'.Exhibit "A",,attached hereto:;
Section 4.: That'the'site, i's serviced by. Western Avenue' the
traffic capacity ,of wh•iFch is adequate to serve_:the site :arid subject
use without suffering significant impacts -to' its level -p:!' service.
Section 5: That the subject use will cause no significant adverse
effect on adjacent property or the permitted.us.e,thereof,,due,to the
conditions of approval contained in`Exhibit •"A", attached`:hereto,
which inc.-lude modification of grades 'and landscaping to control
erosion and visual appearances, proper Oquipment storage, placement'
of structures which minimizes -view impacts, Iimi ed hours'of
construction, landscaping and dust control.
Section 6:That there are exce tional'or. extraordinary

circumstances'or conditions applicable to theproperty 'and "the use
of the property" which cloI not apply generally to 'othe;r properties. -in'
the same zoning district in other southern California cities.
Specifically, while_,the existing _Pacifica Mausoleum encroaches,into
the western property setback abutting church and public utir'ity uses,
reasonable and adequate setbacks are"maintained. Add itionally,,below
ground interments encroaching into setbacks which abut the rear yards
of single-family residential properties, approved and'developed under
the jurisdiction of L. A. County subsequent to .the establishmernt of the
park and.major thoroughfares, are not similar'to above .ground`"
structures, and reasonable setbacks from the adjoining principal
uses are retained.
Section 7: That such'Variance is necessary for the`p'reservation
and enjoyment- of a substantial property right of 'the"Applicant," which
right is possessed by other property owners under like 'conditions in
the same zoning district, since the_.setback for above ground.structures
abutting non-residential distr cts is. more. restri°otive, than the..average
setback in similar zoning `districts in other southern'California'citles
and the expansion of the,Pacifica Mausoleum will, only fill in a corner
of an already developed area and the reduction in the setbadk-for below
ground interments provides a similar and reasonable setbackbetween
adjacent uses' with lafidscaping. ' end screening.
Section 8: That the granting 'of the Variance will not be`
materially'de`tri:mental to the piiblic` w.elfaee,. or injurious PO, property
and improvements in the Brea in.'whi6h the property.i's located, since.
the addition' will not "impact views arid, will match the existing
architecture, screening and buffering with landscaping'in the setback
is required, and only below ground interments will encroach in the
setbacks adjacent to residential..development.
Section 9: That the granting of.such Variance will not be
contrary to the objectives of the Ge' -feral Plan, `since the :proposed
uses are consistent with the `uses allowed in the zoning district`and
the conditions in Exhibit "A" will adequately buffer the uses.

Section 10: That the grading is-:not.excessive beyond that
necessary for the primary permitted use of the lot since the cemetery
is over 110 acres .in size -and; it is necessary fort -'the use td `create a
gently sloping ': site with '-roads with-'rni'imal %percentacje grade, and the
grading is balanced on site.
Section 11: -.That the grading and conotnAdtion do -not adversely ..
affect visual relationships with, nor the views from, neighboring
sites since the finished grades complement the topographic features
of adjacent sites, the finished grade of the northern sided' -of the
site will not exceed the grade as existing in 1983 and above ground
structures are located to minimize view `arid visual -impacts.
Section 12: That.,the,nature of the"cjrading minimizen,disturbance
to the natural',contours: finished contours are reasonably natural,
since the finished grade wil1-not exceed a 3:1 slope and generally is
much less .steep and the proposed grades will be,cohslsitentwith and
blend with the existing site development.
Section 13: � ;Por the ,foregoing reasons; --and based on infdema'tion
and findings included in the staff ,report,• mirimtes and evidence
presented at the public hearings, the City'Coune-il of°the-City of
Rancho Palos Verdes hereby approves Conditional Use Permit No. 155,
Variance No. 262, and Grading Permit No. 1442; and adopts the Final
Negative Declaration for Environmental Assessment Nod 601 subject to
the conditions contained in Exhibit • "A'.,' -attached heretd aril=made a
part hereof,,which are necessary to preserve the public-health, safety,
and general welfare in the area.

45. The applicant shall provide, within 60 days of final approval of
this application, copies of permits from the South Coast Air
Quality Management District and L. A. County Fire Prevention Bureau
for storage of fuel, and permits from the L. A. County Fire
Department, Hazardous Maintenance Division Section and Fire
Prevention Bureau for the chemicals stored in the embalming rooms
in the Administration Building. Permits from the South Coast Air
Quality Management District for the crematory must also be
submitted. Current copies of these permits must be filed with
the City of Rancho Palos Verdes.
46. A consultation audit through Cal OSHA including the establishment
of a training program on the proper handling and safety
requirements of equipment and material for mortuary and crematory
employees is required. Training programs for new employees shall
be conducted on a regular basis in accordance with Cal OSHA
recommendations. Verification of these activities is required to
be filed with the City of Rancho Palos Verdes.
GEOLOGY
47. Prior to issuance of building permits, the developer shall obtain
clearance for construction from the City Geologist and shall submit
a geology and/or soils report of the expansive properties of soils
on all building sites. Such soils are defined by Building Code
Section 2904 (b) or the appropriate current section.
PERMITS
48. The applicant shall provide, within 60 days of final approval of
this application, copies of permits or licenses from the State
Cemetery and Funeral Board. Current copies of these permits must
be filed with the City of Rancho Palos Verdes at all times.
MITIGATION MONITORING
49. The responsibility for monitoring these mitigation measures shall
be jointly vested with the Department of Environmental Services and
the Department of Public Works. Periodic reports required of the
applicant shall be provided to the Department of Environmental
Services and they will be maintained in the Project Address File.
