Consideration and possible action to re -appoint Lowell Wedemeyer as chair of the
Infrastructure Management Advisory Committee (IMAC).

BACKGROUND AND DISCUSSION:
Chair Wedemeyer tendered his resignation from the IMAC on September 2, 2016, due
to his concerns related to the then -required statement of economic interests
(Attachment A). On September 6, 2016, the City Council subsequently rescinded the
requirement that committee members complete the statement of economic interests,
ultimately deciding that it was an unfair and unnecessary burden to place on volunteers
on advisory committees. In the intervening period, the City Clerk was obligated to open
a recruitment for the vacancy. However, as the underlying concern expressed by Mr.
Wedemeyer in his resignation is no longer germane, and he has rescinded his
resignation and indicated to Staff that he is willing to resume his role on the Committee,
it is recommended that he be re -appointed to the Committee as chair, and that the City
Clerk close the recruitment for this vacancy.
ALTERNATIVES:
In addition to the Staff recommendation, the following alternative actions are available for
the City Council's consideration:

Direct the City Clerk to conduct the recruitment for the IMAC vacancy, and
return to the City Council with possible candidates at a future date.

Honorable City Council:
I hereby resign, effective immediately, from the Infrastructure Management Advisory
Committee.
On August 22, 2016 1 received an email from the City Clerk's office demanding that I file a
Fair Political Practices Commission Form 700. There was no such requirement when I
applied for and accepted appointment, so imposition of this new requirement is entirely
involuntary from my point of view.
The verification section of Form 700 requires a sworn statement that "I have used all
reasonable diligence in preparing this statement." Accordingly, I have endeavored to do so
within the very short time limits allowed. I have concluded that it is not feasible to do so.
Disclosure categories 5 and 6, Appendix C, page 2 of 3 (D-8) describe " ... persons and
business entities ... that provide, plan to provide, or have provided within two years prior
to the time a statement is required under this conflict of interest code, supplies, services
or public works within the jurisdiction subject to the inspection, review or approval of the
Public Works Department. (referencing Schedules A-1, A-2 and C of the Form 700.) As best
I can determine, the two year period is added by the City's new code, when Form 700
appears to ask only for the past 12 months.
I have no idea how to obtain a reliable, historic list of "supplies, services [and] public works
within the jurisdiction subject to the inspection, review or approval of the Public Works
Department" for the "two years priorto the time a statement is required". I am not aware of
any such list published by the Public Works Department or the City. This new, retroactive
standard applies to both "5. Reportable income..." and "6. Reportable investments...."
Similarly, the City has provided no list of, and I have no means to identify, the "persons and
business entities" who so provided to the City. I have no control over (and generally no right
of access to) the historic record-keeping of other "persons and business entities" who may
have dealt with Public Works.
