VRC MINS 20011004 v � VIEW RESTORATION COMMISSION REGULAR MEETING October 4, 2001 Chairman Alberio called the meeting to order at 7:00pm at Fred Hesse Community Center, 29031 Hawthorne Boulevard. The Pledge of Allegiance followed, led by Commissioner Iseda. Present: Chairman Alberio, Commissioner Drages, Commissioner Franklin, Commissioner Monks, Commissioner De Moraes, Commissioner Dyda, Commissioner Iseda, and Commissioner Ginise. Absent: Vice-Chair Slayden excused absence, and Commissioner Weber absent. Also Present: Senior Project Coordinator Trayci Nelson, Project Coordinator Steven D. Jones, and Recording Secretary William Butler. APPROVAL OF AGENDA Commissioner Dyda moved to approve minutes as amended, seconded by Commissioner Iseda. Motion carried (8-0). COMMUNICATIONS Staff: William Butler stated the need for all Commissioners to fill out the VRC commission form and return it as soon as possible. Commission: NONE CONSENT CALENDAR: 1. MINUTES OF September 20,2001 Commissioner Dyda moved to return the minutes for revisions, seconded by Commissioner Franklin. Motion carried (6-0-2), with Commissioner Iseda and Commissioner Ginise recusing themselves. The commission also directed staff to prepare the minutes in a way that gives a brief summary of the discussion and action. 2. RESOLUTION 2001-03 Commissioner Dyda moved that the corrections presented by Commissioner Franklin be incorporated in exhibit "A" the conditions of approval for View Restoration permit#76. Seconded by Commissioner Franklin. Motion carried (8-0). View Restoration Commission Minutes October 4, 2001 Page 1 of 5 CONTINUED BUSINESS: NONE PUBLIC HEARING: Commissioner Dyda moved to open the public hearing, seconded by Commissioner lseda. Motion carried (8-0). VIEW RESTORATION PERMIT NO. 78: Mr. and Mrs. Hamish Bell, 3666 Greve Drive. (TN) Chairman Alberio: Chairman Alberio asked staff why there was a need to continue this particular item. Trayci Nelson: Ms. Nelson stated the foliage on another property that was not part of the original submittal has since grown into the view frame and now needed to be included. Staff was trying to schedule a pre-app with this person. Ms. Nelson also stated that, after receiving notification of the hearing, another foliage owner wanted to try and negotiate resolution of the matter one final time. December 6 was the earliest date possible to allow time for all of this to occur. Commissioner Dyda moved to continue VRP NO.78 to the December 6, 2001 VRC Meeting, seconded by Commissioner Franklin. Motion carried (8-0). VIEW RESTORATION PERMIT NO.100: Mr. and Mrs., Quintus Guthrie, 6432 Le Blanc Place. (SJ) Commissioner Monks: Monks recused himself from VRP NO# 100. He stated that he was the acting Commissioner at the pre- application meeting for VRP #100. Commissioner Drages: Drages stated that she had a casual relationship with Mrs. Guthrie, and that they had seen one another three times in the last two years. She indicated that this would in no way influence her dealings with the project but asked that if anyone preferred that she not participate, she would recuse herself. The foliage owner, Mrs.Tsai, stated that she did not want Commissioner Drages to participate. As such Commissioner Drages recused herself. View Restoration Commission Minutes October 4, 2001 Page 2 of 5 A roll call was taken to see which Commissioners had visited the sites. Chair Alberio, Commissioners Drages, Commissioner Franklin, Commissioner Monks, Commissioners De Moraes, Commissioner Dyda, Commissioner Ginise, and Commissioner Iseda were present and had visited site at least the applicants' property. Steven Jones: Steven Jones spoke and gave a brief overview of the staff report. In short he stated that the view of Catalina, and the ocean was still blocked by trees located 30160 Matisse Drive. Mr. Quintus Guthrie (Applicant): Mr. Guthrie stated that he made numerous attempts to contact and discuss the view impairment with the foliage owner, but to no avail. He stated that a restored view from the deck was all he wanted. Alana Tsai (Foliage Owner): Alana Tsai stated the trees provided privacy for the swimming pool, and that she had cut the foliage twice. Tsai also stated she didn't want to cut anymore. Mr. Quintus Guthrie (Rebuttal): Mr. Guthrie stated the trees provide no privacy for the pool. Commissioner Dyda moved to close the public hearing, seconded by Commissioner Ginise. Motion carried (6-0). Commissioner Ginise: Commissioner Ginise stated that he concurred with the applicant's statement that the trees provide no privacy for the foliage owner's pool. He agreed with staff's recommendation. Commissioner Iseda: Commissioner Iseda stated that the lots on the peninsula are bought with views, and in accordance with the ordinance, some trees must be cut. She agreed with staffs recommendation. Commissioner Dyda: Commissioner Dyda stated that privacy wasn't an issue, and stated that our arborist has stated that topping 1/3 of a pine would not be a danger to the tree. He agreed with staffs recommendation. Commissioner De Moraes: Commissioner De Moraes stated that one concern of Mr. Tsai was the erosion of the soil. He also said, the applicant should be afforded an informal clarification of the balance of the process. He agreed with staffs recommendation. Commissioner Franklin: Commissioner Franklin stated he had a problem defining the view area, and that the applicant's own bushes block a significant portion of his view. He stated that the conditions of approval should have read that the view was from the outside deck area on the View Restoration Commission Minutes October 4, 2001 Page 3 of 5 r r 11 south end only. He agreed with staffs recommendation, but wanted the language to reflect the changes made in the resolution for VRP#76 options one or two. Commissioner Franklin moved to address the foliage in two parts, first finding that the view of the foliage owner significantly impaired the view from the applicant's backyard deck only, seconded by Commissioner Dyda. Motion carried (6-0). Commissioner Franklin: Commissioner Franklin stated that there were some differences between the resolution, which referred to a banana tree, and the staff report that referred to the bird of paradise tree. He said the conditions of approval should use the same terminology that was used in the earlier three options that were included in the conditions of approval for VRP #76. Commissioner Dyda: Dyda stated that he agreed with the recommendations by Commissioner Franklin that included the three options appropriate for this case. He stated that heavily lacing trees, would not clear the view, it just made it more intrusive He also stated that once you laced the tree it would be difficult to determine what the view might be. Commissioner Franklin moved that the remedy to the view impairment in regards to the bird of paradise tree was that options one or two be imposed, also with regards to the Aleppo pine options one and two, and with regards to the avocado and fig trees as recommended by staff, Seconded by Commissioner Dyda. Motion carried (6-0). Commissioner Dyda moved that the commission accept staff recommendations with the changes just voted on, seconded by Commissioner Iseda. Motion carried (6-0). Trayci Nelson: Ms. Nelson stated that staff would make the appropriate changes and the appeal period would begin tomorrow October 5, 2001 and end on October 19, 2001. Commissioner Dyda: Commissioner Dyda stated, and that the appeal cost is $940. He also stated that staff would help her with information to file the appeal if necessary. ITEMS TO BE PLACED ON FUTURE AGENDAS: Staff: Memo submitted by Commissioner Dyda regarding Clarification/Revision to February 17, 1998 guidelines.
