REGULAR MEETING
MAY 3, 2016
The meeting was called to order at 6:04 P.M. by Mayor Dyda at Fred Hesse Community
Park, 29301 Hawthorne Boulevard.
City Council roll call was answered as follows:
PRESENT: Brooks, Campbell, Duhovic, Misetich, and Mayor Dyda
ABSENT: None
Also present were Doug Willmore, City Manager; David Aleshire, City Attorney; and,
Carla Morreale, City Clerk.

City Attorney Aleshire announced the items to be discussed in Closed Session.

Angeles; and Captain Dan Beringer, Lomita Station, Los Angeles County Sheriff's

PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was led by Community Development Director Mihranian.
CLOSED SESSION REPORT:
City Attorney Aleshire reported on the following Closed Session items: 1) With respect
to the Existing Litigation in the Sharon Yarber et al. vs. City of Rancho Palos Verdes
case, a status report was provided and City Attorney Aleshire stated the case resulted
in a victory for the City; 2) With respect to the Existing Litigation in the Sharon Loveys et
al. vs. City of Rancho Palos Verdes, a status report was provided and no reportable
action was taken; and, 3) With respect to the item regarding Potential Litigation, there
was no discussion.
CEREMONIAL:
Mayor Dyda congratulated Supervisor Knabe, 4th District, County of Los Angeles, on his
upcoming retirement and presented him with a City Proclamation and City Tile
commemorating his long-standing partnership with the City, and a gift representative of
our coastal City as a token of the City's appreciation.
Mayor Dyda recognized Dr. Cassie Jones, business owner, Point Vicente Animal
Hospital, and presented her with a Certificate of Recognition for her contributions of
veterinary care and customer service for the residents of the Peninsula.
MAYOR'S ANNOUNCEMENTS:
Mayor Dyda announced that May is Building Safety Month and noted that staff from the
Building and Safety Division were sponsoring a training and educational workshop on
May 10, 2016 at the Pt. Vicente Interpretive Center for professionals in the building
construction field.

Building Official Christman provided highlights regarding the annual educational
workshop event hosted by the City and introduced the staff members of the Building
Safety Division.
RECYCLE AND EMERGENCY PERSONAL PREPAREDNESS KIT DRAWING:
Mayor Dyda announced Recyclers of the Month from the April 19, 2016 City Council
meeting: Betty Bellucci and Tom Carter. He indicated that all winners receive a check
for $250 representing a year of free refuse service and urged everyone to participate in
the City's Recycling Program. He noted that in addition to winning the Recycler
Drawing, the two individuals had also won a Personal Emergency Preparedness Kit
from the City at a value of$60.00.

Councilman Misetich moved, seconded by Councilman Duhovic, to approve the
agenda, as presented.

PUBLIC COMMENTS: (Audience Comments regarding Items Not on the Agenda)
Noel Weiss, provided comments regarding the vaults which are being stored on the
rooftop of Inspiration Slope Mausoleum at Green Hills Memorial Park.
The following people provided comments regarding concerns pertaining to the Pacific
Terrace Mausoleum and Inspiration Slope Mausoleum at Green Hills Memorial Park:
Noel Weiss; Debbie Landes, Vista Verde Owners Association (WOA) Lomita; Lori
Brown, Vista Verde Condominiums, Lomita; Joanna Jones-Reed, WOA, Lomita; and
Sharon Loveys, WOA.
Sharon Yarber, Rancho Palos Verdes, provided comments regarding the following
topics: vaults that are being stored on top of the Inspiration Slope Mausoleum at Green
Hills Memorial Park; two new members of the Sheriff Department that were recently
hired to police the Palos Verdes Nature Preserve (Preserve), noting objections to their
traversing the Preserve via All-Terrain Vehicles; a tent that was recently found in the
Preserve, and parking issues at Del Cerro Park.

City Manager Willmore invited Recreation Services Manager Trautner to the podium to
speak about the City's Healthy RPV Program.
Recreation Services Manager Trautner reported on the City's new Healthy RPV
Program, noting the emphasis on encouraging the health, well-being, and fitness of the
residents of Rancho Palos Verdes. He introduced Palos Verdes Peninsula High School
student Chelsea Liu as the winner of the Healthy RPV Logo Design Contest and
presented her with a Certificate of Recognition.
CONSENT CALENDAR:
City Clerk Morreale reported that there were no requests to speak regarding items on
the Consent Calendar.
Mayor Dyda noted a necessary correction to the Minutes of the April 11, 2016
Adjourned Regular Meeting, stating that on page 4, in the second paragraph under
Sheriff Staffing the mobile speed detectors should read mobile "sound" detectors.
Councilwoman Brooks moved, seconded by Councilman Duhovic, to approve the
Consent Calendar, as amended.

Motion to Waive Full Reading
Adopted a motion to waive reading in full of all ordinances presented at this meeting
with consent of the waiver of reading deemed to be given by all Council Members after
the reading of the title.
Approval of Minutes
Approved the Minutes of the April 5, 2016 Regular Meeting; April 11, 2016 Adjourned
Regular Meeting, as amended; and April 24, 2016 Special Meeting.
Register of Demands
ADOPTED RESOLUTION NO. 2016-16, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF RANCHO PALOS VERDES, ALLOWING CERTAIN CLAIMS AND
DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID.

Consideration and Possible Action to Award a Professional Services Agreement
to Harris & Associates for On-Call Professional Services
1) Awarded a contract for on-call professional services to Harris & Associates;
2) Authorized the expenditure of up to $60,000 for the remainder of FY 2015-16 with a
not-to-exceed amount of$25,000 for any single project; and, 3) Authorized the Mayor
and City Clerk to execute the agreement, subject to approval as to form by the City
Attorney.
Consideration and Possible Action regarding a Claim Against the City by the Yu
Living Trust, Shan Y. Yu and Anna Y. K. Yu
Rejected the claim and directed Staff to notify the claimant.
Consideration and Possible Action to Authorize the City Clerk to file a Notice of
Completion for the Grayslake Road Drainage Improvements Project
1) Accepted the project as complete; 2) Authorized the City Clerk to file a Notice of
Completion for the project with the Los Angeles County Recorder; and if no claims are
filed within 35 days after recordation, send a notice to the surety company to exonerate
the Payment and Performance Bond; and, 3) Authorized the Director of Public Works to
release the 5% construction retention payment to Concept Consultant, Inc., 35 days
after recordation of the Notice of Completion by the Los Angeles County Recorder,
contingent upon no claims being filed on the project, and the contractor posting an
acceptable warranty bond with the City.
Consideration and Possible Action to Award a Professional Services Contract for
the Design of ADA Access and Accessibility Improvements at Fred Hesse Park
1) Awarded a Professional Services Agreement to Creative Design Associates in the
amount of$31,980, including a design contingency of 10% ($3,200), for unforeseen
changes to the scope, plus an amount not to exceed $1,000 for reimbursable items;
and, 2) Authorized the Mayor and City Clerk to execute the Professional Services
Agreement, subject to approval as to form by the City Attorney.
Consideration and Possible Action to Award a Professional Services Agreement to
Sunbeam Consulting, Inc. for the Design of the Miraleste Drive Arterial Roads
Rehabilitation Project
1) Awarded a professional services agreement to Sunbeam Consulting in the amount of
$174,998 for the preparation engineering plans, specification, and cost estimates for the
Miraleste Drive Arterial Roads Rehabilitation Project; and, 2) Authorized the Mayor and
City Clerk to execute the agreement pending City Attorney's approval as to form.

Consideration and Possible Action regarding the March 2016 Cash Balances/
Monthly Treasurer's Report
Received and filed the March 2016 Cash Balances/Monthly Treasurer's Report.
Consideration and Possible Action to Approve the Purchase of a Vehicle for Use
by Preserve/Open Space Staff
Authorized Director of Recreation and Parks to execute a purchase contract with
National Auto Fleet Group in an amount not to exceed $37,916 for the purchase of a
2016 Ford F-150 four-wheel drive truck with assorted attachments for use primarily by
Recreation and Parks' Preserve/Open Space Staff.
Consideration and Possible Action to Implement School Crossing Guards at
Three Locations
Approved the placement of school crossing guards and the associated traffic
improvements near Ridgecrest Intermediate School, Silver Spur Elementary School and
Dodson Middle School.

PUBLIC HEARINGS:
Consideration and Possible Action to Introduce an Ordinance to Permit Special
Events on City Property, Public Rights-of-Way, and on Private Property where the
Public is Invited
City Clerk Morreale reported that notice of the public hearing was duly published, no
written protests received, and there was one request to speak regarding this item.
Mayor Dyda declared the public hearing open.
Director of Public Works Throne provided a staff report and PowerPoint presentation
regarding this item.
Kathy Edgerton, Rancho Palos Verdes, provided comments in support of the proposed
ordinance and noted that she hoped a streamlined approval process for neighborhood
and Homeowners Association events would still be possible.
Discussion ensued among Council Members and staff.

Councilwoman Brooks moved, seconded by Mayor Pro Tern Campbell, to direct staff to
return with a revised ordinance, for introduction, excluding private property events with
modifications to the language as discussed, with the modification of the "Special Event
Committee" to "Special Event Task Force."

RECESS AND RECONVENE:
Mayor Dyda called a brief recess from 8:48 P.M. to 8:59 P.M.
REGULAR BUSINESS:
Consideration of a Proposal from the City Council Subcommittee for a Revised
Storm Drain User Fee and the Next Steps to Establish such a Fee if one is
Enacted
City Clerk Morreale reported that late correspondence was distributed prior to the
meeting and there was one request to speak regarding this item.
Sharon Yarber, Rancho Palos Verdes, provided comments in opposition to the renewal
of the Storm Drain User Fee.
Discussion ensued among Council Members and staff.
Councilman Misetich moved, seconded by Mayor Dyda, to allow the existing Storm
Drain User Fee to sunset on June 30, 2016.

Consideration and Possible Action regarding a Fourth of July Fireworks Display
City Clerk Morreale reported that late correspondence was distributed prior to the
meeting and there was one request to speak regarding this item.
Director of Recreation and Parks Linder provided a staff report and PowerPoint
presentation regarding this item.

Discussion ensued among Council Members and staff.
Councilman Misetich moved, seconded by Mayor Pro Tem Campbell, to: 1) Direct Staff
to not proceed with preparations for a 2016 Fourth of July fireworks display; and,
2) Direct Staff to proceed with preliminary preparations for a potential 2017 Fourth of
July Fireworks show, including identification of potential sponsors.
Diana Feinberg, Rancho Palos Verdes, spoke in support of the staff recommendation,
noting that although she was in favor of a fireworks display show she was not certain
that the City had the appropriate infrastructure to support such an event, highlighting
issues such as parking, traffic and crowd control, and sufficient restroom facilities.
Discussion continued among Council Members and staff.
Councilman Misetich moved an amendment to the motion, seconded by Mayor Pro Tem
Campbell, to: Direct Staff to not proceed with preparations for a 2016 Fourth of July
fireworks display.
The motion passed on the following roll call vote:

Consideration and Possible Action to Address Vehicle Noise and Speeding in the
Palos Verdes Drive East "Switchbacks" Area
City Clerk Morreale reported that late correspondence was distributed prior to the
meeting and there were five requests to speak regarding this item.
Captain Beringer provided a report regarding proposed Sheriff support activities
pertaining to a zero tolerance enforcement plan for the "Switchbacks" area to address
concerns regarding noise, air quality, and speeding problems.
Discussion ensued among Council Members, staff, and Captain Beringer.
Keith Reynolds, Rancho Palos Verdes, provided comments regarding the traffic,
speeding and noise on Palos Verdes Drive East, noting he was in support of a reduction
of the speed limit to 35 mph in the "Switchbacks" area and an increase in Sheriff's
presence at the area.
Diane Smith, Rancho Palos Verdes, provided comments regarding safety issues and
concerns along the "Switchbacks" area along Palos Verdes Drive East and the
City Council Minutes

surrounding canyons, including increased traffic, graffiti, noise issues, and drop off of
runners and bicyclists.
Brett Walker, Rancho Palos Verdes, provided comments regarding the motorcycle noise
and racing along the Palos Verdes Drive East "Switchbacks" area, noting he was in
support of a greater Sheriff presence at the area.
Barbie Lucas, Rancho Palos Verdes, provided comments regarding constant
motorcycle racing and noise along the "Switchbacks" area at any time of the day and
night.
Tim Racisz, Rancho Palos Verdes, provided comments regarding an increase in the
amount of speeding and motorcycle racing along the "Switchbacks" area, noting he was
in support of a reduction in the speed limit and an increase in Sheriffs presence in the
area.
Discussion ensued among Council Members, staff, Captain Beringer, and City Attorney
Aleshire.
Councilman Brooks moved, seconded by Mayor Pro Tem Campbell, to: Direct the
Sheriffs Department to proceed with the "zero tolerance" enforcement plan of the
Switchbacks area; and direct Staff to support the plan by assisting with public outreach,
researching noise mitigation measures; and returning with a status update report in
conjunction with the Sheriffs Department in six weeks.
The motion passed on the following roll call vote:

Councilman Duhovic moved, seconded by Councilwoman Brooks, to continue the
meeting to 10:30 P.M.

that this item would be placed on a future Council Agenda.]

CITY COUNCIL ORAL REPORTS:
Each Council Member reported on his/her attendance at various organization and
association meetings since the last City Council Oral Reports were provided on April 5,
2016. Mayor Pro Tem Campbell noted he would make his report at the next Regular
Council meeting.
