PVPLC - In Lieu Fee Stabilization
• IN LIEU FEE AGREEMENT BY AND BETWEEN THE CITY OF RANCHO PALOS VERDES AND THE PALOS VERDES PENINSULA LAND CONSERVANCY This In-Lieu Fee Agreement is made and entered into this 24 day of April , 2002 by and between the City of Rancho Palos Verdes ("City") and the Palos Verdes Land Conservancy ("Conservancy"). RECITALS WHEREAS, the City is undertaking a public works called as the San Ramon Drainage and Landslide Stabilization Project located in the City of Rancho Palos Verdes, Los Angeles County, California, and such work will involve the discharge of"dredged and/or fill material into waters of the United States;" and, WHEREAS, the Conservancy owns a portion of the Linden H. Chandler Preserve located in the City of Rolling Hills Estates, County of Los Angeles, California, which consists of 0.14 acre for the purpose of providing compensatory mitigation, which adheres to the Corps specified parameters detailed in the City's Conceptual Wetland Mitigation Plan dated December 20, 2001 ("Restoration Plan"), and more particularly described in Exhibit "A" attached hereto and incorporated by this reference (the "Property"); and, WHEREAS, the Property possesses aquatic, wildlife habitat, and biological value (collectively, "conservation values") of great importance to the Corps, and the public in general; and, WHEREAS, the U.S. Army Corps of Engineers' ("Corps") permit for San Ramon Drainage and Landslide Stabilization Project (Corps file no. 2001-0-1329- JLB) includes under Special Conditions 4 and 5x that prior to initiation of construction, the City shall provide an In-Lieu Fee agreement for the purpose of detailing mitigation conformance and implementation plans. This agreement shall provide assurances of mitigation compliance as required by the Corps, California Department of Fish and Game and Water Quality Control Board. WHEREAS, this agreement provides funding to the Conservancy for the purpose of implementing the Corps-approved Restoration Plan ("Plan") for 0.14- acre of land, which is attached hereto as Exhibit "A" and incorporated herein by this reference; and, WHEREAS, on December 18, 2001, the City Council authorized the Conservancy to implement the Corps-approved Restoration Plan and provide maintenance of the project on the Property; and, -.‘ ., .. • • WHEREAS, the City desires to implement mitigation measures as required by the Corps, by funding implementation of the Plan for a portion of the Property that will be performed by the Conservancy. WHEREAS, permanent protection and preservation of the mitigation site is ensured because there is an existing conservation easement recorded for the Property. Furthermore, the Chandler Preserve was partially purchased with Los Angeles County Proposition A funds, which further restrict the use of the site for anything other than conservation purposes. NOW, THEREFORE, in consideration of the mutual promises, covenants, agreements and conditions herein set forth, the City and Conservancy, mutually covenant and agree as follows: 1. The Conservancy agrees to provide 0.14-acre within the Property, which the Corps has found to be necessary for the City to meet the compensatory mitigation required by the Corps. 2. The City shall fund an amount of$10,500, payable to the Conservancy for the purpose of providing the funds necessary for the Conservancy to complete the work detailed in the Restoration Plan. Further monies may be needed for the five years of maintenance called for under the Restoration Plan and shall be determined annually on a time and materials basis by mutual agreement between the City and Conservancy. 3. Upon receipt of the necessary funding from the City, the Conservancy shall commence and diligently pursue implementation of the Restoration Plan. 4. In lieu fee funds shall be used solely for activities directly related to aquatic habitat restoration, enhancement and creation, to include exclusively the following activities: implementation of mitigation and monitoring plans, administrative costs, and long-term management of the 0.14-acre. Administrative costs shall be limited to a maximum of ten percent (10%). Administrative costs include, but are not limited to bookkeeping, mailing expenses, printing, office supplies, bank fees, training, travel and staff time directly related to supporting these expenses and similar activities. Administrative costs do not include project monitoring, permit fees, or long-term management. 5. The Conservancy shall maintain accurate records for expenditure of in-lieu fee funds and documentation of restored areas, including the date restoration work began, the total number of acres restored, and restoration updates. The Conservancy shall provide the Corps with an annual financial report. This report shall be submitted to the Corps and copies to the City by Februarylst of each year. Upon acceptance of the Restoration Plan by the Corps, the Conservancy shall provide a detailed schedule including anticipated time lines for implementation of the Restoration Plan. The acceptable date for the commencement of planting shall not exceed one year past commencement of earthmoving activities associated with the San Ramon Drainage and Landslide Stabilization Project (October 4, 2001). 7. The City shall be responsible for monitoring, and shall provide annual monitoring reports to the Corps with copies to the Conservancy for a minimum of five (5) years from the date of initiation of the restoration work. Helix Environmental Planning, Inc., or another qualified restoration specialists selected by the City and approved by the Corps, shall prepare the monitoring reports. The annual reports shall conform with the Corps- approved Restoration Plan. 8. This agreement shall become effective on the date of signature by all parties. Any party to this agreement may terminate the agreement upon sixty (60) days written notification to the other party. However, upon termination of this agreement, the City will provide notification to the Corps. Upon notification, the Corps shall then determine whether any modification to Corps file no. 2001-0-1329-JBL is warranted. 9. Without written approval of the Corps, the Conservancy shall not be relived of its obligations under this agreement to complete restoration and maintain any portion of the 0.14-acre where restoration has been initiated or for which some funds have already been expended. Provided, however, that if this agreement is terminated by any party under Paragraph 8, the Conservancy shall be relieved of obligations to continue with restoration. City agrees to pay for all continuing costs for maintenance and monitoring all or that portion of the 0.14-acre site for which construction has been completed. If the agreement is terminated by any party pursuant to Paragraph 9, any unused funds maintained by the Conservancy shall be refunded to the City or to an entity designated in writing by the Corps, and used for implementation, maintenance and monitoring of the remainder of the 0.14-acre site that has not been restored at the date of cancellation. 10. The City and Conservancy agree that these measures are in the best interest of all parties involved and agree to be bound by these obligations. This conceptual wetland mitigation plan is intended to provide the framework for mitigation of impacts to U.S. Army Corps of Engineers (ACOE) jurisdictional areas under Section 404 of the federal Clean Water Act and California Department of Fish and Game (CDFG) jurisdictional areas under Section 1603 of the California Fish and Game Code. The preparation of this report is required under permits issued by the ACOE (No. 200101329-JLB), CDFG (No. R5-2001-0211), and Regional Water Quality Control Board (RWQCB;No.01-073). The City of Rancho Palos Verdes, the project applicant, will provide off-site mitigation for the proposed permanent impacts to 0.07 acre waters of the United States by transferring $10,500 to the Palos Verdes { Peninsula Land Conservancy(Conservancy). The fees are for the restoration of a minimum of 0.14 acre of acreage riparian habitat. This corresponds to a 2:1 area replacement ratio for proposed permanent P impacts to the unvegetated streambed in San Ramon Canyon. The mitigation area will be at the Linden H.Chandler Preserve,located on the Palos Verdes Peninsula,in Los Angeles County. Mitigation will be met by cooperative efforts between the City of Rancho Palos Verdes, HELD( Environmental Planning, Inc. (HELIX), and the Conservancy. The restoration will be financed by the City,and restoration work will be completed and overseen by the Conservancy. Technical expertise and monitoring will be contributed by HELIX. aT HELIX Conceptual Wetland Mitigation Plan for the San Ramon Canyon Project/RPV-06.2/December 20,2001 S-1 1 � 2 ...:'^'r ., r I. PROJECT DESCRIPTION A. PROJECT LOCATION The San Ramon Storm Drain and Landslide Stabilization Project site is located in the City of Rancho Palos Verdes in Los Angeles County (Figure 1). The project area is comprised of the uppermost reach of San Ramon Canyon located between San Ramon Drive and Calle Aventura. Vegetation within the southeasterly-trending canyon is mostly native, while developed and disturbed areas dominate the surrounding ridges. s acz, rA�M4 TheP mitigation mitiro osed ation area is in the 28.5-acre Linden H. Chandler Preserve, also located on the Palos Verdes Peninsula (Figures 1 and 2). The majority of the preserve is within the City of Rolling Hills Estates while a small portion is within the City of Torrance. The horse-shoe shaped preserve is flanked by residential development and a baseball field to the south, the Empty Saddle Club and residential developmentneighborhoods to the west, residential nei hborhoods to the north, and a golf course"peninsula" that juts into the preserve from the east (Figure 3). The preserve area contains three ephemeral drainages that flow through Bent Spring Canyon,Phillips Canyon, and Dapplegray Canyon. Patches of native and non- native riparian vegetation grow within and on the banks of these drainages. While native habitat does exist on site,much of the preserve area is dominated by non-native species. B. PROJECT SUMMARY The San Ramon Storm Drain and Landslide Stabilization Project was proposed because the capacity of the existing storm drainage system was exceeded,during recent winter storms, resulting in storm drain overflows. Storm drain overflows have caused property damage and erosion along the drainage, and have activated a landslide within San Ramon Canyon. If left unchecked,the erosion at the bottom of the canyon could continue to undercut and further activate the existing landslide. Therefore, immediate action to repair the landslide and to extend and replace the drainage system before the commencement of the upcoming winter rains was deemed necessary by the City to prevent the loss of or damage to life, health,and property and essential public services. The landslide stabilization and drainage project is designed to replace the undersized storm drainage system south of Palos Verdes Drive East and construct storm drainage and landslide stabilization improvements within San Ramon Canyon. The project involves the construction of permanent drainage facilities and an energy dissipation structure and the placement of approximately 75,000 cubic yards of imported soil to stabilize the landslide. Thep p uppermost area encompasses the u ermost reach of San Ramon Canyon. Project construction would affect vegetated slopes and result in permanent impacts to portions of the natural drainage that runs along canyon Yon bottom. Impacts to 0.07 acre of non-wetland Waters of the U.S.will be mitigated at a 2:1 ratio through creation/restoration of 0.14 acre of native riparian habitat at the Palos Verdes Peninsula Land Conservancy's Chandler Preserve. to, The Chandler Preserve encompasses sandy ridges with moderate to steep slopes and drainages separating them. The 28.5-acre property was dedicated as a preserve in 1994 and had been previously been disturbed by grazing, regular disking and mowing along its borders with residential development. Two drainages that flow through the Chandler Preserve have been selected as potential areas for habitat restoration. The Bent Spring Canyon drainage contains significant patches of giant reed (Arundo donax) and areas of riparian scrub dominated by mule fat(Baccharis salicifolia) and willows(Salix sp.) Sections of this streambed are devoid of native riparian vegetation and therefore present an ideal location for the HELIX Conceptual Wetland Mitigation Plan for the San Ramon Canyon Project/RPV-06.2/December 20,2001 1 110 . restoration work. Tentative restoration plans include removal of non-native species and planting of g �,K,A 4 native riparian vegetation. An unvegetated portion of a second drainage (Phillips Canyon),which flows into the Bent Spring CanYon drainage,would also be restored as part of this mitigation program. . .. C. JURISDICTIONAL AREA TO BE FILLED An ephemeral stream drainage occurs at the bottom of San Ramon Canyon that runs from the head of the p canyon in a southeasterly direction and continues off site. The unvegetated channel is approximately 8- feet wide at the upper reach, widening to 10-feet over most of its length within the project area. This channel is under the jurisdiction of the U.S. Army Corps of Engineers (ACOE) as Waters of the U.S. and also the CDFG, P ursuant to the California Fish and Game Code Section 1603, as a streambed. The entire channel, a total of 0.07 acre of non-wetland Waters of the U.S., would be filled by the San Ramon Storm Drain and Landslide Stabilization Project. E. FUNCTIONS AND VALUES OF JURISDICTIONAL AREA TO BE IMPACTED The jurisdictional drainage channel to be filled by the project is not an ACOE-defined"wetland" and has low habitat functions and values. The banks of the channel are unvegetated and eroded and no wetland vegetation occurs within the drainage. II. The conceptual mitigation program described herein is based on these permit requirements,meetings and conversations. )'' A. TYPE(S)OF HABITAT TO BE CREATED The mitigation for impacts to Waters of the U.S.involves the creation/restoration of 0.14 acre of riparian v. habitat within the Chandler Preserve. A total of 0.14 acre of disturbed wetlands will be enhanced by the removal of giant reed (Arundo donax) and other exotic species and planting native vegetation such as mule fat(Baccharis salicifolia) and willows (Salix spp.). The wetlands to be restored are located within the F Bent Spring Canyon and Phillips Canyon drainages that flow through the Chandler Preserve. Native riparian habitat will be created in areas contiguous with existing southern willow scrub and mule fat scrub habitats(Figure 3). B. FUNCTIONS AND VALUES OF HABITAT TO BE CREATED The drainages to be restored currently have varied habitat functions and values because of their patchy • distribution of native and non-native vegetation. The focus of the restoration effort will be the removal of non-native species and the establishment of riparian vegetation in areas that have low functions and values,and are adjacent to patches of existing native vegetation. The expanded area of native riparian vegetation would enhance the functions and values of the drainages as wildlife habitat. Wildlife diversity and abundance in the Bent Spring Canyon drainage are anticipated to increase with the development of the restored habitats. The enhanced riparian habitat would provide new nesting and foraging opportunities for riparian bird species. In addition, the planted riparian vegetation would expand the flood buffering capacity of the drainage, increase groundwater recharge and reduce erosion and sedimentation. C. TIME LAPSE Mitigation will take place concurrent with construction of the San Ramon Storm Drain and Landslide Stabilization zation Project. D. ESTIMATED COSTS The City will fund the installation of riparian habitat as described in this document via payment of $10,500 to the Conservancy. Additionally, at the City's expense, HELIX will undertake five yearsof biological technical monitoring at the restoration area. A preliminary cost estimate for the monitoring component of the project is $30,000, which includes funding for five years of biological monitoring and reporting. Note, however, that monitoring costs could be reduced if site visits to multiple City-funded projects were conducted on the same day,thereby distributing costs associated with travel time. III. FINAL SUCCESS Wil. The following sections provide standards to determine the successful completion of the mitigation. Attainment of these standards indicates the habitat creation has achieved the goals of the mitigation. :.:.;::.:.:1 Methods to measure these success criteria are described in the following text. A. TARGET FUNCTIONS AND VALUES The goal of the restoration effort is to create riparian habitat of similar or better quality to that found in the on-site Bent g Sp rin Canyon drainage. Revegetation would occur primarily through riparian the installation of native ri arian plant species such as willows and mule fat adjacent to patches of existingnative habitat. The target functions and values will be set to moderately to high for the created g wetland. It is expected that these values will increase over time as the habitat matures, and the achievement of these values will be an improvement over the existing conditions. B. TARGET HYDROLOGICAL REGIME p- The regime target a for the riparian habitat to be created would provide groundwater that is near the surface and seasonal flooding. The long-term source of water to the mitigation area will be rainfall from natural storm events and urban runoff from the surrounding development. C. TARGET JURISDICTIONAL ACREAGE TO BE CREATED At the end of the five-year monitoringperiod, a minimum of 0.14 acre of native riparian habitat that qualifies' 'es as ACOE and CDFG jurisdictional wetland will have been created and will have demonstrated that it is self-sustaining for at least two years. IV. PROPOSED MITIGATION SITE A. LOCATION AND SIZE OF MITIGATION AREA The mitigation site is located in the Linden H.Chandler Preserve, located on the Palos Verdes Peninsula, in Los County Coun Angeles 1 and 2). Mitigation at the Preserve would be in close proximity to the jurisdictional impacts associated with the San Ramon Storm Drain and Landslide Stabffization Project.. P Implementation of the mitigation program at the Chandler Preserve would insure the long-term P g P �' preservation and management of the restoration site. The habitat creation (0.14 acre) will occur in portions of the Bent Springs Canyon and Phillips ps anyon drainages in the Preserve (Figure 3). The presence of extant riparian vegetation within the drainages indicates that the soil and hydrological' conditions in the proposed restoration areas are appropriate for the mitigation project. B. OWNERSHIP STATUS The Linden H. Chandler Preserve was dedicated as a preserve in April 1994 and is jointly owned and managedby the Palos Verdes Peninsula Land Conservancy and the City of Rolling Hills Estates. C. EXISTING FUNCTIONS AND VALUES OF MITIGATION AREA The riparian habitat will be created in an area that is currently disturbed and devoid of quality habitat. • The mitigation area occurs within portions of the Bent Spring Canyon and Phillips Canyon drainages that g are either PP unve g etated or support exotic,invasive plant species. Banks of the drainages have been eroded by seasonal flows such that there is an abrupt transition from the drainage bottom to adjacent upland areas. The existing vegetation within the mitigation areas offers limited habitat functions and values to wildlife. D. PRESENT AND PROPOSED USES OF MITIGATION AREA The mitigation area has beenpreviously disturbed by dumping, clearing and/or discing but is currently g open space protected as within the Chandler Preserve. The proposed use consists of a pP g native wetland habitat preserve area,offering higher habitat functions and values than currently exist. s; E. PRESENT AND PROPOSED USES OF ALL ADJACENT AREAS The 28.5-acre Chandler Preserve is flanked by residential development and a baseball field to the south, `f the Empty Saddle Club and residential development to the west,residential neighborhoods to the north, t.; and a golf course"peninsula" that juts into the preserve from the east. V. IMPLEMENTATION PLAN A. RATIONALE FOR EXPECTING IMPLEMENTATION SUCCESS The areas selected for habitat restoration were recommended by the Preserve director. The restoration sites are directly adjacent to existing riparian vegetation and are expected to have suitable hydrological and soil conditions to sustain native riparian habitat. B. RESPONSIBLE PARTIES The following parties will be responsible for implementing all aspects of the mitigation program from its design through five years of monitoring. 1. Project Proponent The City of Rancho Palos Verdes will be responsible for financing the implementation of this mitigation program. Restoration Installation and Maintenance The restoration work described in this document will be directed and completed by the Palos Veides Peninsula Conservancy. The Conservancy will be responsible for site preparation, installation and maintenance of the restoration area. Restoration work will include, but not be limited to, weed control, debris removal, implementation of erosion control measures, and plant installation/replacement = throughout the five-year habitat establishment period. Restoration Specialist The restoration specialist will provide technical expertise and will monitor the installation and :,:,imaintenance of this mitigation project. The restoration specialist will educate all participants with regard c:/, to mitigation goals and requirements and will oversee the site preparation, planting, maintenance, and monitoring. After each maintenance monitoring event, the restoration specialist will provide the project proponent and the Conservancy with a brief report, including a list of items in need of attention, if any. SCHEDULE Implementation of the mitigation program is expected to begin concurrent with construction of the San .1 RamonP g Ramon Storm Drain and Landslide Stabffization Project. Initial installation activities will include marking ofall mitigation areas and exotic species and debris(trash)removal. Plant installation will occur g in the winter of 2002 (j �Y anu -March). Monitoring of the mitigation effort by the restoration specialist will begin with habitat installation. The monitoring program will continue for five years post installation. An annual report will be prepared and distributed to the City, Conservancy, and permitting resource (ACOE,a encies CDFG, and RWQCB) by January 1 of each of the five years of monitoring. At the g conclusion of the monitoring period a final report will be distributed to these same parties. D. SITE PREPARATION - r 1. Non-native Species Removal All exotic species within the restoration area will be removed by hand prior to habitat installation. Exotics such as giant reed should be cut close to the ground and painted with appropriate herbicide(e.g., 100percent Rodeo). Treatment ofgiant reed will be done on a year round basis, whenever deemed ) necessary,with more frequent treatments taking place in the fall months when herbicide treatments are found to be most effective. Small, outlying patches of giant reed will be removed manually and all excavated rhizomes will be removed from the streambed. Herbaceous weeds such as mustard (Brassica spp.) should be removed byhand and/or sprayed with herbicide. The removal of weeds will be supervised bythe restoration specialist,and removed vegetation will be disposed of in a legal manner. 2. Irrigation ' minimize if not eliminate anyirrigation needs in the winter, a temporary overhead While rainfall will g stem will be installed to ensure successful plant establishment. The irrigation system will not be used past year three of the restoration program. 3. Staking • TheP erimeter of the restoration area shall be adequately staked, flagged,or fenced to prevent damage to ' existing,native vegetation or created habitat. E. The planting will take place in the winter months(December-March)to coincide with natural precipitation. VI. MAINTENANCE DURING FIVE-YEAR MONITORING PERIOD A. MAINTENANCE MONITORING The purpose of this subsection is to outline the maintenance monitoring procedures to be followed and to identify the parties responsible for implementing and conducting these procedures as part of the maintenance monitoring. The primary goal of maintenance monitoring is to provide quality assurance for the maintenance of the newly created habitat. The restoration specialist will monitor the site preparation, planting, subsequent establishment, and growth where applicable in an effort to detect any problems at an early stage. The restoration specialist will file a written memo with the Conservancy after completing each inspection. Each of these memos will identify maintenance concerns and facilitate communication and coordination with the party responsible for installation and maintenance. A five-year maintenance program is provided to ensure the successful establishment of created and enhanced habitats. Maintenance monitoring by the restoration specialist will begin immediately after installation for habitat creation and continue through year five(see Table 2). The maintenance of habitats will involve debris(trash)removal,exotic species removal,and any remedial measures deemed necessary for the success of the mitigation program. Maintenance crews have been taught to distinguish weed Y, species from desirable, native vegetation. Dead or diseased plants in created habitat will be replaced at the direction of the restoration specialist. B. RESPONSIBLE PARTIES preparation,The Conservancy will be responsible for site habitat installation and maintenance of the restoration area. Site preparation and maintenance activities include, but are not limited to, weeding �n prior to and following plant installation,initial sebding and planting, and any necessary re-planting. The g restoration specialist will monitor habitat installation and maintenance and provide technical expertise to ensure the success of the mitigation project. C. SCHEDULE . Maintenance of the mitigation areas is tentatively planned to follow the schedule presented in Table 3. The frequency of maintenance activities may be significantly reduced, as determined by the restoration � solong specialist, as the stated success criteria continue to be met. This may be the case if the proposed p program is as successful as prior wetland restoration activities at the Preserve. MONITORING PLAN 11: :::,• Monitoring will be carried out under the direction of the restoration specialist to supervise maintenance activities (maintenance monitoring) and assess the progress (technical monitoring) of the restoration effort. Maintenance monitoring will rely on visual observations of plant establishment and growth and other site conditions. Technical monitoring will rely on quantitative criteria to measure the success of the mitigation. Yearly and final success criteria are included to measure interim and ultimate habitat r. development. Annual technical monitoring, including quantitative sampling, will be done for the third, fourth, and fifth year of the project. Annual reports will be submitted all five years. However, the primary focus of the first two annual reports will be more on what has been done in the previous year for maintenance and what, if any, adjustments are necessary to ensure ultimate success of the restoration project. A. PERFORMANCE CRITERIA The purpose of this subsection is to define specific performance standards by which to evaluate project progress. Annual technical monitoring will focus•on percent cover of native species to determine the success of the restoration effort(Table 4). In addition, cover by non-native species and species diversity within the restoration sites will be assessed. Table 4 presents success criteria milestones for years three, four, and five following plant installation. 2. Cover by Non-Native Plant Species Non-native plant species are typically a problem with habitat creation, particularly at the beginning of a mitigation project. Many weeds have become locally naturalized, and the tolerance for these species ¢- should reflect what is present in other native riparian habitats. The measure for tolerance should be total cover of weed species. Although weeds are expected to be a problem, focused maintenance efforts will reduce weed cover to an acceptable level. At the end of the 5-year maintenance/monitoring period,non- native species will comprise less than 10 percent of the vegetation cover. In addition, a 100% (or complete) removal goal for the giant reed must be achieved by the end of the 5-year maintenance monitoring period. Photo Documentation In addition to the technical measurements, several permanent stations for photo documentation will be established at each restoration site. Photos will be taken prior to habitat installation and as part of all five annual monitoring reports. Vegetation at the herb (0 to 0.6 meter), shrub (0.6 to 2 meters), and tree (greater than 2 meters)levels will be documented. B. TECHNICAL MONITORING Technical monitoring will be conducted for the first time in June following the third growing season after installation; subsequent annual monitoring will also be done in September. Annual data collection will focus on vegetation cover and species composition, with methods primarily based on the California Native Plant Society(CNPS)Field Sampling Protocol(CNPS 1997). Spec' 'c.data to be collected with each technical monitoring effort include the native vegetation cover, cover of non-native species and species diversity. } The g sam lin method is based on a 50-meter long belt-transect centered in a 50-meter by 5-meter plot that sampling is randomlylocated in a subjectively chosen homogeneous patch of vegetation. Annual reports will include botanical and wildlife use observations of the habitat creation. The report will include a discussion of any monitoring activities and exotic plant control efforts, and will provide information on vegetative cover byplant species as well as percent survival for plantings(i.e.,cuttings and/or container g stock). photographs Representative from designated photo stations shall also be included. Any remedial recommendations will also be made in the annual reports, along with a summary of whether the mitigation is meeting the established success standards. COMPLETION OF MITIGATION A. NOTIFICATION OF COMPLETION ,i4 The,project proponent shall notify the ACOE, CDFG and RWQCB upon completion of the mitigation. effort through the submittal of a final monitoring report. N B. AGENCY CONFIRMATION • project If the meets all success standards at the end of the five-year monitoring period then the mitigation ��� will be considered a success; if not, the maintenance and monitoring program will be extended one year at a time until the standards are met. Specific remedial measures (approved by the permitting resource agencies) will be used during any extension. Monitoring extensions will be done only for areas that fail to meet final success criteria. This process will continue until all year-five standards are met or until the permitting resource agencies determine that other mitigation measures are appropriate. Should the mitigation effort meet all goals prior to the end of the five-year monitoring period, the permitting resource agencies,at their discretion,may terminate the monitoring effort. IX. CONTINGENCY MEASURES A. INITIATING PROCEDURES If theg p ermittin resource agencies determine upon receipt of any of the annual monitoring report that the mitigation effort is not meeting success stancards for the project, the project proponent shall be notified in writing that the effort may require augmentation for successful implementation. The project proponent will have 30 days to respond to the notification. B. ALTERNATIVE LOCATIONS FOR CONTINGENCY MITIGATION No alternative locations are proposed for this mitigation. If the success criteria are not being met within the proposed restoration area,the agencies and project proponent will work toward a mutual solution. • C. FUNDING MECHANISM The City will be responsible for all costs associated with this restoration program's remedial measures. D. RESPONSIBLE PARTIES The City will be the responsible party for any remedial measures. If uncontrollable circumstances occur such as a major storm event which destroys the mitigation, the City will not be required to repeat the mitigation effort but will work with the agencies to remedy the situation. f;;„4 0-1 X. LONG-TERM MAINTENANCE Long-term maintenance beyond the 5-year mitigation monitoring program will be provided by the Conservancy. The "maintenance and restoration of natural habitat" is the top management goal of the Preserve (1996). The restoration area would receive long-term maintenance by Conservancy crews to prevent degradation of existing and restored native habitat. Activities to be performed include the removal of exotic plant species and debris (e.g., landscape cuttings, garbage,etc.) and the maintenance of trails and signs adjacent to preserved habitat. .
