Parkland Dedication Fees for Final Parcel Map No. 72999 (Case No. SUB2014- 00004) for Property located at 5656 Crest Road (Kim) Recommendation: Accept parkland dedication (Quimby) fees for Final Parcel Map No. 72999, pursuant to the City's Parkland Dedication Fee formula, in the amount of $42,893.61 F. Utility User Tax (UUT) Refund Update (Cullen) Recommendation: 1) Pay the 11 Utility User Tax (UUT) deficient refund claims that were unsigned, but had no other deficiency; and, 2) Mail a deficiency UUT claim reminder to residents for the remaining 719 deficient claims. The reminder would give residents an additional 30 days to provide the necessary information and/or make the needed corrections to their claim to receive a refund. PUBLIC HEARING: 1. Green Hills Memorial Park Appeal of Planning Commission Decision regarding Annual Compliance Review (Case No. ZON2003-00086); Location: 27501 Western Avenue (Aleshi re/Wi I I more) (90 mins) Recommendation: ADOPT RESOLUTION NO. 2015-_7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, PARTIALLY UPHOLDING THE DECISION OF THE PLANNING COMMISSION AND PARTIALLY MODIFYING THE CONDITIONS OF APPROVAL OF THE CONDITIONAL USE PERMIT AND PERMITTING CONTINUED OPERATION OF MAUSOLEUM WITH CONDITIONS TO MINIMIZE IMPACTS. REGULAR BUSINESS: 2. Master Plan of Drainage and Engineer's Preliminary Report for Storm Drain User Fee 2016 Renewal (Cullen/Throne) (30 mins) Recommendation: 1) Receive and file a summary of the 2015 Master Plan of Drainage (on the City's website since October 1, 2015), and the Draft Preliminary Report for the Water Quality and Flood Protection Program Storm Drain User Fee, 2016 Renewal; and, 2) Schedule a public hearing for January 19, 2016, to consider City Council Agenda November 17, 2015 Page 3 of 5 whether the City should conduct a mail-ballot election of affected property owners, for a 10 year extension of the storm drain user fee with the same fee structure and methodology. CLOSED SESSION AGENDA CHECKLIST Based on Government Code Section 54954.5 (All Statutory References are to California Government Code Sections) Conference with Legal Counsel Potential Litigation against the City: GC 54956.9(d)(2) and (e)(3) A point has been reached where, in the opinion of the legislative body of the local agency on the advice of its legal counsel, based on existing facts and circumstances, there is a significant exposure to litigation against the local agency, based on a letter to the City of Rancho Palos Verdes Planning Commission dated August 6, 2014, from Ellen Berkowitz of Gresham, Savage, Nolan & Tilden. A copy of the letter is on file in the City Clerk's Office. In addition, the threat of anticipated litigation that would be filed by the Vista Verde Homeowners' Association ("HOA") was discussed at the October 28, 2014 Planning Commission meeting by Michael N. Friedman, the attorney who represents the HOA, and on March 23, 2015, claims against the City were received from the following Vista Verde residents: Nadejda V. Gueorguieva, Barbara K. Hughes-Astbury, Veronica E. Lawlor, Paul F. Keye, Jr. and Julie Keye, Sharon L. Loveys, Matthew H. Martin, Lane C. Mayhew, and Rhys Williams. On April 14, 2015, an additional claim was received from Vista Verde resident Julie Reynolds.
