AGREEMENT, dated for the purposes of reference only, ▪ 3 ZE / <-IG) 4 19 is made byand between the COUNTY OF LOS ANGELES, c..) rrn-- (do ill rn GO 5 - reinafter referred to as "COUNTY", and the CITIES OF RANCHO PALOS VERDES GI 1-4 6 .. o� ROLLING HILLS, AND ROLLING HILLS ESTATES, hereinafter referred as "CITIES". o 7 r-CD RECITALS: r- 8 (a) The Cities are desirous of contracting with the County for the 9 performance of the hereinafter described law enforcement functions within 10 their boundaries by the County of Los Angeles through the Sheriff thereof. 11 (b) The County of Los Angeles is agreeable to rendering such services 12 on the terms and conditions hereinafter set forth. 13 (c) Such contracts are authorized and provided for by the provisions 14 of Sections 56 1/2 and 56 3/4 of the Charter of the County of Los Angeles 15 and Article 1, Chapter 1, Part 2, Division 1 , Title 5 of the Government Code 16 of the State of California. 17 (d) The Cities have previously contracted for law enforcement services 18 under a regional agreement and desire to continue such services. 19 THEREFORE, THE PARTIES AGREE AS FOLLOWS: 20 1. The County agrees, through the Sheriff of the County of Los 21 Angeles, to provide, and the Cities agree to accept, police protection 22 within the corporate limits of these cities to the extent and in the manner 23 hereinafter set forth. 24 Except as otherwise hereinafter specifically set forth, such services 25 shall only encompass duties and functions of the type coming within the 26 jurisdiction of and customarily rendered by the Sheriff of the County of Los 27 Angeles under the Charter of said county and the statutes of the State of 28 California. 1 76T 5 76T ' • ti 1 1 2. The rendition of such service, the standards of � erformance the P 2 discipline of officers, and other matters incident to the performance of P 3 such services and the control ofersonnel so employed shall remain in the P 4 County. In the event of a dispute between the parties as to the extent of Y P 5 the duties and functions to be rendered hereunder, or the minimum level or 6 manner of performance of such service, the determination thereof made bythe 7 Sheriff of the Countyshall be final and conclusive as between the parties 8 hereto. 9 3. Basic law enforcement service will be provided by the County on 10 the basis of a general law enforcement patrol car, or multiple or fraction 11 thereof, and a station detective, or multiple or fraction thereof. It is 12 hereby agreed that the minimum level of basic law enforcement service shall 13 be determined by the County as provided in Paragraph 2 herein. 14 4. Services performed hereunder may include, if requested in writing 15 by the Cities, traffic enforcement, license inspection and enforcement, the 16 supplying of crossing guards and school safety officers and any other 17 services in the field of public safety, law enforcement, or related fields 18 within the legal power of the Sheriff to provide. 19 Should any one of the cities desire to receive any service from the 20 Sheriff not specifically listed above, the City Council's written request 21 must contain a statement indicating the Sheriff's willingness to provide 22 such service. Provision of such service shall be contingent upon the 23 Sheriff's willingness to provide it. 24 5. There is hereby created an Administrative Committee which shall 25 consist of the City Manager of each city and the Sheriff of the County, or 26 their respective representatives. Said committee shall meet at the request 27 of any one (1) member of the Committee at a time and place mutually 28 agreeable to all members. This request shall consist of a written or verbal 2 76T 5 76T 1 notice given to all members of this Administrative Committee setting forth 2 the requesting member's desire to call such a meeting. The matters q g g 3 discussed at this meetingmayinclude the review of the overall aspects of P 4 the Regional Law Enforcement Plan, the amount of service to be rendered to g 5 each Cityunder the Plan, the allocation of the percentage of total cost of P g 6 the Plan to be paid by each City, operational standards, and any other 7 matters relatingto the administration of the Regional Law Enforcement Plan. g 8 The Sheriff of the County or his authorized representative, shall present 9 upon request, statistics evaluating the effectiveness of the plan and other 10 such information as may be useful in evaluation of the plan. 11 6. For the purpose of performing said functions, County shall furnish 12 and supply all necessary labor, supervision, equipment, communication 13 facilities, and supplies necessary to maintain the level of service to be 14 rendered hereunder. 15 When and if the County and any one of the cities concur as to the 16 necessity of maintaining a law enforcement headquarters within said City 17 which would not normally be provided by the Sheriff, said City shall 18 furnish, at its own cost and expense, all necessary office space, furniture 19 and furnishings, office supplies, janitor service, telephone, light, water 20 and other utilities. It is expressly further understood that in the event 21 such local office is maintained in that said City, such quarters may be used 22 by the Sheriff of the County of Los Angeles in connection with the 23 performance of his duties in territory outside of said City and adjacent 24 thereto, provided, however, that the performance of said outside duties 25 shall not be at any additional cost to said City. 26 Notwithstanding the foregoing, it is agreed that in all instances where 27 special supplies, stationery, notices, forms, and the like must be issued in 28 the name of said Cities, the same shall be supplied by said City at its own 3 76T 5 76T 1 cost and expense. 2 7. All persons employed in the performance of such services and 3 functionsursuant to this agreement for said Cities shall be County g 4 employees, and no City employee as such shall be taken over by said County, 5 and no person employed hereunder shall have any City pension, civil service, 6 or any right. or ri ht. 7 For the ur ose of performing services and functions, pursuant to this P P 8 agreement and only for the purpose of giving official status to the 9 performance thereof, every County officer and employee engaged in performing 10 any such service and function shall be deemed to be an officer or employee 11 of said City while prforming service for said City, which service is within 12 the scope of this agreement and is a municipal function. 13 8. Cities shall not be called upon to assume any liability for the 14 direct payment of any salaries, wages, or other compensation to any County 15 personnel performing services hereunder for said City. 16 Except as herein otherwise specified, the City shall not be liable for 17 compensation or indemnity to any County employee for injury or sickness 18 arising out of his employment. 19 9. The Assumption of Liability Agreement executed by the parties to 20 this agreement and approved by the Board of Supervisors on December 27, 21 1977, currently in effect is hereby made a part of and incorporated into 22 this agreement as if set out in full herein unless said Assumption of 23 Liability Agreement is expressly superseded by a subsequent agreement 24 hereafter entered into between the parties hereto. 25 10. Unless sooner terminated as provided for herein, this agreement 26 shall be effective July 1, 1990, and shall remain in effect until June 30, 27 1995. At the option of the Board of Supervisors and with the consent of 28 each City Council, this agreement may be renewable for successive periods of 4 76T 576T t i I i 1 not to exceed five years each. 2 In the event Cities desire to renew this agreement for any succeeding 3 City period, the Councils, not later than December 31 next 4 preceding the expiration date of this agreement, shall jointly notify the 5 Board of Supervisors of said Countythat theywish to renew the same, P 6 whereupon said Board of Supervisors, not later than the last day of January, 7 may notify said City Councils in writing of its determination concerning 8 such renewal for an additional five-year period or such other term as Y 9 mutually agreed upon, otherwise this agreement shall finally terminate on 10 the above specified dated. 11 Notwithstanding the provisions of this paragraph hereinbefore set 12 forth, anypartymayterminate this agreement as of the first dayof of g July 13 any year upon notice in writing to the other parties of not less than sixty 14 (60) days prior thereto. In the event of such notice of termination by any 15 g City, this agreement will be deemed terminated as to all parties as of the 16 first day of the first July following said notice. 17 Notwithstanding any provision herein to the contrary, any City may 18 terminate this a agreement upon notice in writing to the County given within g 19 sixty (60) days of receipt of written notice by the County of any increase 20 in the rate for any service to be performed hereunder, and in such an event 21 this agreement shall terminate sixty (60) calendar days from the date of any 22 City's notice to the County aforementioned. 23 11. Beginning with the first fiscal year of this Regional Law 13 Enforcement Services Agreement, each City shall pay a percentage of the 14 total cost of the law enforcement service level. As agreed upon by the 15 Administrative Committee, such percentages shall be established based upon a 16 formula which includes time expended, numbers of cases handled and called 17 for service experienced during the preceeding fiscal year period, or such 18 other factors as may be recommended by the Administrative Committee. 19 Changes in this percentage cost, payable by each City, shall be 20 effective only upon unanimous agreement of all member cities. 21 13. The cost of other services requested pursuant to this agreement and 22 not set forth in Paragraph 11 shall be determined by the Auditor-Controller 23 in accordance with the policies and procedures established by the Board of 24 Supervisors of County. 25 14. The County, through the Sheriff of the County of Los Angeles, 26 shall render to said Cities within ten days after the close of each calendar 27 month a summarized invoice which covers all services performed during said 28 month, and said Cities shall pay County therefore within thirty (30) days 7 76T576T • 1 after date of said invoice. 2 If suchYm a ent is not delievered to the County office which is P 3 described on said invoice within thirty days da s after the date of the 4 invoice, the County is entitled to recover interest thereon. Said interest 5 shall be at the rate of ten (10) percent per annum or any portion thereof 6 calculated from the last day of the month in which the services were 7 performed. 8 15. If such payment is not delivered to the County office which is 9 described on said invoice within thirty (30) days after the date of the 10 invoice, the County may satisfy such indebtedness, including interest 11 thereon, from any funds of any such City on deposit within the County 12 without giving further notice to said City of County's intention to do so. 13 16.
